本発明は、決済意思確認用装置、決済意思確認用端末装置、決済意思確認システム、決済意思確認方法、意思確認決済システムおよび決済意思確認用プログラムに係り、特にカード決済において不正使用による不本意な決済実施を、利用者側において有効に阻止することのできる、決済意思確認用装置、決済意思確認用端末装置、決済意思確認システム、決済意思確認方法、意思確認決済システムおよび決済意思確認用プログラムに関する。
【従来の技術】

キャッシュカード、クレジットカード、デビットカード等のカードによる決済では、これらの使用による決済依頼を行う者がそのカードの正当な所有者であるか否かの確認すなわち本人確認の手段が有効に講じられていることが、特に所有者側にとって重要である。コンピュータシステムによるカード決済では、特定の所有者の所有に係る特定のカードにより決済実施の依頼がなされること自体が、まず第一の本人確認手段ではあるが、通常はこれに加えて暗証番号の設定という第二の手段がとられ、これによって、カードの紛失や盗難等の事態が発生してカードが他人の所持するところとなった場合にも、その他人による不正使用の阻止が図られている。また暗証番号の設定に替えて、あるいはこれに加えて、自筆署名による本人識別も用いられている。

すなわち典型的なカード決済の例を挙げれば、キャッシングやショッピング等においてカードを使用する場合、カード内に記録された情報と暗証番号の入力情報を、カード用端末装置を介して決済者の管理に係る決済用コンピュータに送り、これらの情報が決済用コンピュータに保存されている該カード所有者の情報(本人情報)と一致すれば、決済実施の依頼を行っているカード使用者はカード所有者本人であると確認され、本人の口座の預金残高に基づく使用可能限度額その他の必要な条件を満たせば、決済が実施される。

図11は、従来のカード決済システムの構成例を示すブロック図である。図において従来の決済システム50は、決済依頼手段であるATM等カード端末機51と決済端末装置55が専用回線等の回線53で接続された構成を、基本とする。カード利用者がカード所有者本人Pであれ、他人Nであれ、所定のカード59がカード端末機51に対して用いられ、かつ正しい暗証番号が入力される限り、決済者側の決済システム50はこれを正常な決済依頼と認識し、決済が実行される。

しかし、カードや暗証番号は日常頻繁に使用するものではないため、カードが紛失・盗難等により他人の所持するところとなっても、これにすぐには気が付きにくく、不正使用を阻止するための決済者への連絡も遅れがちになるという問題がある。つまり、利用者個人レベルで情報管理を徹底し、その漏洩を防止することは困難である。

加えて、暗証番号の知得は不可能ではなく、特に磁気的な読取り手段等が利用可能となったことにより暗証番号盗用の危険性はむしろ増大しており、暗証番号設定による安全保障、信頼性のレベルは低下しているのが実態である。一方、自筆署名による本人識別方法は、これを模倣する技術の高度化により、安全保障、信頼性のレベルには自ずと限界がある。

このような状況の下、紛失や盗難の可能性がカードよりは低い携帯電話機を決済実施依頼の手段として用い、カードを不要とする決済方法が提案されている。このうち、「利用料金の非現金決済方法及びシステム」(後記特許文献1 特開2002−183612号公報)は、携帯端末のみを携帯するだけで全ての商取引における決済を現金・各種のカードを用いることなく行うことができる非現金決済方法の提供を課題とする。そしてその解決手段として、商品・電話を使っての情報提供サービスを除くサービスの料金支払に際し、利用者が決済依頼用端末である管理装置から電話番号等の入力をすることにより、該管理装置と接続されている決済管理装置が利用者所持の携帯端末に電話を掛け、少なくとも請求原因とその金額を提示して決済を行うことを許諾するか否かの問合せを行う手順(ステップ1)と、該携帯端末から該管理装置に対して決済許諾の入力を確認する手順(ステップ2)と、該決済管理装置が利用者の支払口座に商品・サービスの特定、利用日時、利用料金等の利用明細と関連して利用料金を課金する手順(ステップ3)と、そして、該決済管理装置が商品・サービスの提供サイトに対し前記携帯端末の支払口座への課金処理が終了した旨の通知を行う手順(ステップ4)とを含んで構成されるシステムが提案されている。

すなわちこの提案では、携帯することが、場合によっては煩雑に感じられることもあるカードを一切使用しないことを前提に、これに替わる手段としては携帯端末(携帯電話機)を採用し、決済依頼用端末である管理装置を新たに構成し、また決済管理装置には本人許諾確認のために利用者の携帯端末に対する通信手段を設け、さらに決済に当たっては利用者の携帯端末用支払用口座に対し課金を行う手段を設ける構成として、カードは使用せず携帯端末のみに依存する態様で、決済における本人許諾確認手段の担保を図っている。

これを決済依頼手段の安全保障、信頼性の点から評価すると、該携帯端末を所持し、あるいはこれに加えて該携帯端末もしくは利用者に係る必要情報を知得している者によりなされる許諾を、利用者本人によりなされる決済許諾として取り扱い得るシステムが提案されている。

また、「携帯電話を利用した決済方法」(後記特許文献2 特開2002−042017号公報)は、 飲食および商品購入の決済を、携帯電話によって実施できる決済システム及び決済方法を課題とする。そしてその解決手段として、クレジット会社情報センター端末と小売店あるいは飲食店のオーダ用あるいは会計用端末が通信回線により接続されて会計情報の送受信が行われ、また、クレジット会社情報センター端末と利用者の携帯電話が電話回線により接続されて決済情報の送受信が行われることにより、現金およびクレジットカードを持たずに飲食及び商品購入ができ、また、利用者の行動内容と時間に応じた柔軟な決済処理の行える決済システムが提案されている。

すなわちこの提案では、携帯することを忘れることもあるクレジットカード等を一切使用しないことを前提に、これに替わる手段としては携帯端末(携帯電話機)を採用し、予め小売店あるいは飲食店の前記オーダ用あるいは会計用端末から前記情報センター端末へ送信された会計データ等を、該携帯端末との間の通信により照合し、かつ該通信のみにより利用者本人の意思確認を行うこととしている。これを決済依頼手段の安全保障、信頼性の点から評価すると、該携帯端末を所持し、あるいはこれに加えて該携帯端末もしくは利用者に係る必要情報を知得している者によりなされる決済依頼を、利用者本人によりなされる決済依頼として取り扱い得るシステムが提案されている。

【発明が解決しようとする課題】
しかしこれら先行技術に示されるように、カード決済のシステムに替えて携帯電話機を非現金決済の決済依頼手段とするシステムは、上述のようにカードの不使用、廃止を前提としたシステムであり、少なくとも当面しばらくの間は決済システムの中心として機能し続けていくだけの需要が確立しているカード決済システムにおける、利用者本人確認の安全保障、信頼性を改善するための対策には、何らなり得ない。つまり、カード所有者にとって有効な「カード不正防止策」とはならない。

確かにカードと比較すると携帯電話機は利用者による携帯機会が一般に多く、かつサイズや重量もあるため、紛失や盗難等により他人の所持することとなっていることに気づかないという事態はカードよりも低頻度であるといえるが、係る事態がまったく起きない保証はなく、現実にそのような事態は発生している。つまり上記各先行技術は、あくまでも単一の決済依頼手段兼本人確認手段(意思確認媒体ともいえる。)として、カードに代替する携帯電話機を用いることによって、幾分安全保障レベルの向上が図られたものであり、本人確認手段が単一であることにより本人確認には限界があるという問題は、これらの方法によっても依然解決されていない。

また、単一の決済依頼手段兼本人確認手段によって従来以上に信頼性レベルの向上を図るためには、結局上記先行技術の例に示されるように本人確認のための項目数増加や個人情報としての程度を上げなくてはならず、手間や時間がかかり、また個人情報漏洩の危険性の点でも問題がある。

また上記先行技術の方法・システムは、これらが発明の主要適用対象としている駐車場料金や飲食店での決済など特定の決済目的で新たに構築されるシステムは別として、既存のシステムをできる限り生かして構成するには、自ずと限界がある。以上のような問題点は、利用者側の視点に立った安全保障や信頼性、利用者の便宜の向上が、必ずしも充分になされてこなかったことを示唆する。すなわちサービス提供者側以上に、利用者側の視点に立った課題抽出が求められる。

つまり、不正使用によるカード犯罪の増加が懸念される中、決済システムのセキュリティーは強化されているが、ユーザー側本位の有効な対策はなされておらず、また消費者が個人的にカード管理を徹底することは困難でもある。したがって消費者保護、企業の社会的責任の上からも対策が必要である。

本発明が解決しようとする課題は、上記従来技術の欠点を解決し、カード決済システムにおける利用者本人確認の安全保障、信頼性を改善するための対策、つまりカード所有者にとって有効な「カード不正防止策」たり得る手段を提供することである。

つまりカード決済において、本人確認手段が決済依頼手段を兼ねて単一であることによる本人確認の限界の問題を解消して、不正使用による不本意な決済実施を有効に阻止することができ、手間や時間がかからず、また個人情報漏洩の危険性の点でも問題がなく、既存のカード決済システムをできる限り生かすことのできる、決済意思確認用装置、決済意思確認用端末装置、決済意思確認システム、決済意思確認方法、意思確認決済システムおよび決済意思確認用プログラムを提供することである。

【課題を解決するための手段】
本願発明者は上記課題について鋭意検討した。その結果、カード不正使用の成立する条件は、本人データが揃っていること、かつそれに本人が気付いていないことの二点であることを踏まえ、気が付いていない本人に気付かせることで不正使用を防止でき、本人が知った後の判断には本人の意思が反映されるシステムを構成することにより課題を解決できることを見出した。つまり、携帯通信端末をカード決済における本人確認のための第二かつ必須の手段(意思確認媒体)として用い、つまり決済依頼手段であるカードとは別の意思確認媒体に対して決済依頼の情報をフィードバックして決済同意意思を確認できるシステムを構成するという課題解決手段を見出し、本発明に至った。すなわち、本願において特許請求される発明は、次のとおりである。

(1)キャッシュカードやクレジットカード等のためのカード用端末装置とこれに接続する決済端末装置とを備えてなる決済システムを用いてカードによる決済が行われる際に、該カードの所有者の決済同意意思を確認するために用いる決済意思確認用装置であって、該決済意思確認用装置は、
(1−1)決済意思確認に係るカードの識別用情報(以下、「カード情報」という。)を接続手段を介して該決済システムから受信するためのカード情報受信手段と、
(1−DB)少なくとも利用者の所有に係る後記携帯通信端末の情報(以下、「携帯端末情報」という。)を保存するデータベース(以下、「利用者データベース」という。)に接続して該カード情報に係る利用者に係る該携帯端末情報を検索するための利用者データベース検索手段と、
(1−2)検索された該携帯端末情報に係る携帯通信端末に対し通信回線を介して接続するための、携帯端末接続手段と、
(1−3)接続した携帯通信端末に対し該カード情報に係る決済について同意意思の有無の回答を要求する送信を行う、意思決定要求手段と、
(1−4)該意思決定要求手段によりなされた意思決定要求に対する該携帯通信端末からの回答返信状況を判別処理して決済可否を示す信号(以下、「決済可否指令信号」という。)を発生させる、回答判別処理手段と、
(1−5)該回答判別処理手段により発生した決済可否指令信号を該決済システムに対し前記接続手段を介して送信する、決済可否指令送信手段と、
を備えることにより、決済に対する同意の確認を複数の意思確認媒体により行うことを可能とする、決済意思確認用装置。

すなわち本発明は、カード決済においてカードが使用される都度、カード所有者本人の決済同意意思を確認するために本人の携帯する携帯電話機等の携帯通信端末に対し通報する手段を、その中核とするものである。決済同意意思確認の方法としては、カード使用者がカード所有者本人であって当然に決済同意意思がある場合には、「決済に同意する」の回答が決済意思確認用装置に返信され、一方該通報が携帯通信端末を携帯しているカード所有者本人にとって身に覚えがなく、決済に同意できない場合には、「決済に同意しない」の回答が決済意思確認用装置に返信されて、係る意思確認結果に沿った処理がなされる構成をとることとする。

つまり、カードや暗証番号が盗難、紛失、偽造等により他人の所持、知得するところとなった場合であっても、該他人がカードを使用して不正に決済依頼しようとしたときには、カード所有者本人の携帯する携帯通信端末に対してその決済依頼の情報がフィードバックされ、決済同意意思の有無の確認がなされるため、本人の意思のみによって所有するカードの不正使用を未然に阻止することができる。また、通常の本人使用時には、カード所有者本人および決済者の双方にとって、決済同意意思の確認のためのフィードバック、および決済同意意思の入念な確認として作用するため、安心感を与え、カード決済における安全保障、信頼性を高めることができる。

本発明において決済意思確認用装置とは、上述した決済意思確認のための各手段が連結構成されてなる総体の決済意思確認手段が含まれた何らかの実体をいう。したがって、それが独立して使用されるか否かは問われず、決済端末装置など他の装置の内部に内蔵されて設けられる端末装置の付属部品の形態や、あるいは外部に外付けされる周辺装置の形態でもよく、また独立した端末装置すなわち決済意思確認用端末装置としての形態も含まれる。
