Abstract

<P>PROBLEM TO BE SOLVED: To prevent a breach of contract by enabling the prior recognition of the past breach-of-contract history of the renter or purchaser of a real estate and to prevent an illicit action related to a real estate business by enabling the prior recognition of the past illicitness history related to real estate business of a real estate company employee. <P>SOLUTION: In a server 13 performing communication with each personal computer 11a-11n through a communication network 12, real estate credit information including predetermined personal information of an individual who performs a business for mediating the lease and trade of the real estate and information showing the content of the illicit action or damage related to real estate business of the individual is registered in a database. When a retrieval request using the personal information is received, in the server 13, the personal information is retrieved from registered information by a retrieval control part 26, and the real estate credit information including the personal information, in the detection of the personal information, or non-detection information, in no detection thereof, is reported to the personal computer 11b that is the retrieval requester. <P>COPYRIGHT: (C)2004,JPO

【発明の属する技術分野】
本発明は、不動産の賃貸借並びに売買を仲介する不動産業者が、不動産の借り主や購入者の過去の契約違反履歴を事前に認識することで契約違反を防止すると共に、不動産会社社員（従業員）の過去の不動産業務に係わる不正履歴を事前に認識することで不動産業務に係わる不正行為を防止するための不動産信用情報検索システム及び不動産信用情報検索方法に関する。

【従来の技術】
現在、不動産業者がアパート、マンション、駐車場及び土地等の不動産物件の賃貸借又は売買を仲介する場合、所定の契約書に、借り主や購入者の氏名・本籍・電話番号・学校・勤務先等の個人情報を記載して貰い捺印後、借り主や購入者の希望する不動産物件を賃貸又は売買する方法が実施されている。なお、この不動産賃の仲介に関して、後述する本発明内容のシステムに該当する先行技術文献情報は見あたらない。

【発明が解決しようとする課題】
ところで、上述した従来の不動産の仲介を行う方法においては、仮に、借り主が過去に賃貸滞納などの契約違反の常習者であった場合でも、不動産業者が仲介時に、その違反履歴を認識することができないため、再度違反が行われる可能性がある。同様に、購入者が契約違反の常習者であった場合でも、不動産業者が仲介時に、その違反履歴を認識することができないため、再度違反が行われる可能性がある。

また、仲介を行う不動産会社社員が、仲介手数料の抜き行為（業務上横領）や敷金返金の偽装行為（詐欺）などの不正行為の常習者であった場合でも、その不動産会社経営者又は管理者が、その不正履歴を認識することができないため、再度不正行為が行われる可能性がある。更に、先の不正行為を犯した個人が、新たに就職を希望する場合、採用試験時などではその不正履歴が判らないため、その個人を入社させた場合、再度不正行為が行われる可能性がある。

本発明は、かかる点に鑑みてなされたものであり、不動産の借り主や購入者の過去の契約違反履歴を事前に認識可能とすることにより契約違反の防止を図ることができ、不動産会社社員の過去の不動産業務に係わる不正履歴を事前に認識可能とすることにより不動産業務に係わる不正行為の防止を図ることができる不動産信用情報検索システム及び不動産信用情報検索方法を提供することを目的とする。

【課題を解決するための手段】
上記課題を解決するために、本発明の不動産信用情報検索システムは、コンピュータ機能及び通信機能を有する多数の端末機と通信網を介して通信を行うサーバに、端末機から入力され、不動産の賃貸借並びに売買を仲介する業務を行う個人の予め定められた個人情報及び、上記個人の不動産業務に係わる不正行為又は被害の内容を示す情報を含む不動産信用情報を、データベースに登録する登録制御手段と、端末機から上記個人情報を用いた検索依頼を受信した際に、その個人情報を上記データベースの登録情報から検索する検索手段と、上記検索手段の検索による上記個人情報の検出時に、この検出された個人情報を含む不動産信用情報を検索依頼元の端末機に通知し、未検出時に未検出の情報を同端末機に通知する通知手段とを備えたことを特徴としている。

また、上記登録制御手段は、上記端末機を上記サーバに回線接続するための固有のＩＤ番号が割り当てられた会員の情報を上記データベースに登録し、上記検索手段は、上記データベースから検出された上記不動産信用情報に、この情報を入力した会員への連絡必要の情報が含まれる場合、上記データベースに登録された会員の情報から連絡先情報を読み出し、上記通知手段は、上記検索手段で読み出された連絡先情報を上記不動産信用情報とともに検索依頼元の端末機へ通知することを特徴としている。

【発明の実施の形態】
以下、本発明の実施の形態について、図面を参照して詳細に説明する。

図１は、本発明の実施の形態に係る不動産信用情報検索システムの構成を示すブロック図である。

この図１に示す不動産信用情報検索システム１０は、本システム１０を統括管理する会社に設置された管理用パソコン（パーソナルコンピュータ）１１ａと、本システム１０を利用する会員である多数の不動産会社に設置された会員用パソコン１１ｂ〜１１ｎと、各パソコン１１ａ〜１１ｎが接続された電話回線又は専用回線などの通信網（含むインターネット）１２と、通信網１２に接続されたサーバ１３とを備えて構成されている。但し、各パソコン１１ａ〜１１ｎに代え、通信網１２に接続された図示せぬ無線基地局と通信を行う携帯電話機を用いてもよい。

サーバ１３は、図２に示すように、送受信部２１と、入力画面表示制御部２２と、会員情報登録制御部２３と、個人情報登録制御部２４と、登録情報修正削除制御部２５と、検索制御部２６と、検索結果通知制御部２７と、会員情報記憶部２８と、問題社員情報記憶部２９と、家賃滞納者情報記憶部３０とを備え、各々の構成要素２１〜３０がバス接続されて構成されている。なお、各記憶部２８〜３０によってデータベースが構成されている。

送受信部２１は、通信網１２を介して各パソコン１１ａ〜１１ｎと種々の情報データの送受信を行うものである。

入力画面表示制御部２２は、図３〜図１３に示す各入力画面（後述で詳細に説明する）を各パソコン１１ａ〜１１ｎに表示するための入力画面情報を、送受信部２１及び通信網１２を介して各パソコン１１ａ〜１１ｎへ通知する制御を行うものである。

会員情報登録制御部２３は、管理用パソコン１１ａにおいて入力されたのち通信網１２を介して送受信部２１で受信された会員情報（会員である不動産会社の名称、住所、電話番号などの固有の情報）を、会員情報記憶部２８に記憶して登録する制御を行うものである。

個人情報登録制御部２４は、各パソコン１１ａ〜１１ｎにおいて入力されたのち通信網１２を介して送受信部２１で受信された個人情報である問題社員情報又は家賃滞納者情報を、問題社員情報記憶部２９又は家賃滞納者情報記憶部３０に記憶して登録する制御を行うものである。

ここで、問題社員情報とは、不動産会社社員が、仲介手数料の抜き行為（業務上横領）や敷金返金の偽装行為（詐欺）などの不動産業務に係わる不正行為を行った際の被害の内容、並びに問題社員の個人情報（住所、氏名、生年月日などの固有情報）である。

家賃滞納者情報とは、不動産の借り主が、過去に家賃滞納などの契約違反を行った際の滞納状況及び契約違反の内容、並びに借り主の個人情報（住所、氏名、生年月日などの固有情報）である。但し、問題社員情報並びに家賃滞納者情報を、不動産信用情報とも称す。

また、個人情報登録制御部２４は、不動産会社社員の不動産業務に係わる不正行為又は被害が解消されたことを示す情報を各パソコン１１ａ〜１１ｎから受信した際に、その個人の不動産信用情報をデータベースから削除する。また、不動産の借り主の不動産賃貸借に係わる契約違反又は被害が解決されたことを示す情報を受信した際に、その借り主の不動産信用情報をデータベースから削除する。その削除は即時又は所定期間後に行われる。

登録情報修正削除制御部２５は、各記憶部２８〜３０に登録された情報を修正又は削除する制御を行うものである。この制御は、各パソコン１１ａ〜１１ｎにおいて入力されたのち通信網１２を介して送受信部２１で受信された登録情報修正削除情報に応じて行われる。

検索制御部２６は、管理用パソコン１１ａにおいて入力されたのち通信網１２を介して送受信部２１で受信された会員情報と一致する会員の登録情報を、会員情報記憶部２８から検索する制御を行うと共に、各パソコン１１ａ〜１１ｎにおいて入力されたのち通信網１２を介して送受信部２１で受信された問題社員情報又は家賃滞納者情報と一致する個人情報を、問題社員情報記憶部２９又は家賃滞納者情報記憶部３０から検索する制御を行うものである。また、検索制御部２６は、登録情報の中からパソコン入力された個人情報と一致する問題社員情報又は家賃滞納者情報が検索された際に、その検索情報に後述で説明する指名手配中である旨が設定されている場合、その指名手配を行った会員の連絡先を、会員情報記憶部２８から検索する制御を行う。

検索結果通知制御部２７は、検索制御部２６での検索結果に係わる所定の情報を、送受信部２１及び通信網１２を介して各パソコン１１ａ〜１１ｎへ通知する制御を行うものである。

次に、入力画面表示制御部２２の制御によって各パソコン１１ａ〜１１ｎに表示される図３〜図１３に示す各入力画面の説明を行う。

図３に示す固有のＩＤ（Ｉｄｅｎｔｉｆｉｅｒ）及びパスワードの入力画面３１は、各パソコン１１ａ〜１１ｎが、最初にサーバ１３にアクセスした際に表示されるものである。この入力画面３１には、本不動産信用情報検索システムを統括管理する管理者のＩＤ又は会員のＩＤを入力するＩＤ入力欄、管理者又は会員のパスワードを入力するパスワード入力欄、ログイン釦、入力情報をリセットするためのリセット釦が表示される。

図４に示すメニュー画面４１は、入力画面３１のログイン釦のクリックによってログインされた際に表示されるものである。このメニュー画面４１には、問題社員データベースに係わる１．データベースへの登録の記述行、２．登録データの修正削除の記述行、３．データベースの検索の記述行と、家賃滞納者データベースに係わる４．データベースへの登録の記述行、５．登録データの修正削除の記述行、６．データベースの検索の記述行とが表示される。

図５に示す問題社員の個人情報入力画面５１及び、図６に示す問題社員による被害内容入力画面６１は、メニュー画面４１における１．データベースへの登録の記述行がクリックされた際に表示されるものである。

問題社員による被害内容入力画面６１には、退社したときの理由（持ち逃げ・使い込み・詐欺・家主データの持ち逃げ）のチェック設定部、被害金額（５０万円未満・５０万円〜１００万円・１００万円〜２５０万円・２５０万円〜５００万円・５００万円〜１０００万円・１０００万円以上）のチェック設定部、被害届提出有無（提出済み・未提出）のチェック設定部、被害届受理番号の入力欄、被害内容を書き込むためのメモの入力欄、顔写真・添付ファイルの入力欄、本案件の解決状況（解決済み・未解決）のチェック設定部、前述した指名手配をかけるための連絡必要の有無（必要・不要）のチェック設定部、入力内容をデータベースに登録するための登録釦、リセット釦、メニュー画面４１へ戻るためのメニューへ戻る釦が表示される。

家賃滞納者による契約違反入力画面１１１には、契約違反の内容（動物飼育・騒音・転貸・暴言暴力行為・集会・特約違反）のチェック設定部、事故歴の発生年月：内容の入力欄、顔写真・添付ファイルの入力欄、前述した指名手配をかけるための連絡必要の有無（必要・不要）のチェック設定部、登録釦、リセット釦、メニューへ戻る釦が表示される。

図１２に示す家賃滞納者登録情報の修正削除入力画面１２１は、メニュー画面４１における５．登録データの修正削除の記述行がクリックされた際に表示されるものである。家賃滞納者登録情報の修正削除入力画面１２１には、氏名の入力欄、読み仮名（フリガナ）の入力欄、読み仮名（アルファベット）の入力欄、住民票コード番号の入力欄、登録日の入力欄、修正削除を行う登録情報の検索の実行釦、リセット釦、メニューへ戻る釦が表示される。

図１３に示す家賃滞納者情報のデータベース検索入力画面１３１は、メニュー画面４１における６．データベースの検索の記述行がクリックされた際に表示されるものである。家賃滞納者情報のデータベース検索入力画面１３１には、氏名の入力欄、読み仮名（フリガナ）の入力欄、読み仮名（アルファベット）の入力欄、住民票コード番号の入力欄、保証人の名前の入力欄、生年月日の入力欄、検索の実行釦、リセット釦、メニューへ戻る釦が表示される。

次に、このような構成の不動産信用情報検索システム１０による不動産信用情報の登録、修正削除、検索の各処理を説明する。

例えば、本不動産信用情報検索システム１０を適用する旨の契約を交わした社員Ａが、不動産業務に係わる不正行為を行った場合に、その不動産会社（会員Ｂとする）の経営者又は管理者が、会員用パソコン１１ｂを使用して、その問題社員Ａの個人情報をデータベースに登録するものとする。

会員用パソコン１１ｂからサーバ１３へのアクセス操作が行われると、入力画面表示制御部２２の制御によって図３に示す入力画面３１が表示される。この入力画面３１において、会員ＢのＩＤ及びパスワードが入力されたのちログインが実行されると、入力されたＩＤ及びパスワードが通信網１２を介してサーバ１３の送受信部２１で受信される。この受信されたＩＤ及びパスワードは、入力画面表示制御部２２によって検証され、正しければ図４に示すメニュー画面４１をディスプレイ表示するための情報が、送受信部２１及び通信網１２を介して会員用パソコン１１ｂへ通知される。これによって、会員用パソコン１１ｂにメニュー画面４１が表示される。なお、ＩＤ及びパスワードが正しくない場合は、メニュー画面４１は表示されず、入力画面３１が表示された状態となる。

会員Ｂがメニュー画面４１において、１．データベースへの登録の記述行をクリックすると、このクリック実行情報が通信網１２を介してサーバ１３の送受信部２１で受信され、入力画面表示制御部２２によって、図５に示す問題社員の個人情報入力画面５１及び図６に示す問題社員による被害内容入力画面６１をディスプレイに表示する情報が、会員用パソコン１１ｂへ通知される。これによって、会員用パソコン１１ｂに入力画面５１及び６１が表示される。

ここで、会員Ｂは入力画面５１に問題社員Ａの個人情報を入力及び設定すると共に、入力画面６１に問題社員Ａが起こした被害内容情報を入力及び設定する。この入力及び設定時に内容の誤りに気付き、入力及び設定内容を取り消す場合は、リセット釦をクリックして内容を取り消し、再度入力及び設定を行う。

入力及び設定後に、登録釦がクリックされると、問題社員Ａの個人情報及び被害内容情報が通信網１２を介して送受信部２１で受信される。この受信された情報は、個人情報登録制御部２４の制御によって問題社員情報記憶部２９に登録される。

この登録後、会員Ｂが登録内容の誤りに気付き修正又は削除を行う場合、入力画面６１においてメニューへ戻る釦をクリックすると、メニュー画面４１が表示されるので、ここで、２．登録データの修正削除の記述行をクリックする。この実行に応じて入力画面表示制御部２２の制御によって図７に示す問題社員登録情報の修正削除入力画面７１が表示される。
