本発明は、特許権、実用新案権、意匠権及び商標権の年金(更新費用を含む)の管理業務を、依頼者が管理者に移管するための方法に関するものである。

特許権の取得を目指す企業の多くは、特許事務所の弁理士を代理人として特許出願を行う。特許出願は特許庁において審査され、法定の拒絶理由が存在しない特許出願についてのみ、特許査定が下される。日本国特許法のもとでは、特許査定となった後に第1年から第3年までの登録料(いわゆる設定登録料)の納付が必要である。この納付の後に特許権の設定登録がなされ、独占権が発生する。設定登録料の納付手続は、企業の依頼を受けて、出願代理人である弁理士が行うのが通例である。

特許権は、4年目以降は、年ごとの登録料(以下「年金」と称される)の納付によって存続する。年金の納付は、出願手続を代理した弁理士が行うことがあるし、企業(特許権者)が自ら行うこともある。いずれの場合も、企業は、コンピュータシステムによって納付期限を管理する。年金管理には、人手がかかる。しかも年金管理では、ミスが許されない。年金管理は、企業にとって煩わしい業務である。

企業に代わって年金管理業務を代行する会社も存在する。この管理会社は年金管理に適したコンピュータシステムを保有しており、多数の企業の年金を一括管理する。管理会社における管理は、企業における管理よりも効率的であり、低コストである。

【発明が解決しようとする課題】
管理会社への年金管理業務の移管のため、企業はまず、自らのコンピュータシステムに格納されたデータベースから、移管すべき特許権を抽出する。そして、この抽出された特許権のリストを、管理会社に送る。管理会社は、受け取ったリストを元に、当該特許権を自らの管理下に置くための処理(具体的にはコンピュータシステムへの入力作業)を行う。管理会社は、この処理が完了したことを、企業に報告する。この報告を元に、企業は自らのデータベースを更新する。当該特許権の年金管理を代理人である弁理士が行ってきている場合は、企業はさらに、年金の二重納付を防止する目的で、この弁理士に移管が完了した旨を報告する。報告を受けた弁理士は、当該特許権を自らの年金管理システムからはずす。これら一連の作業により、当該特許権に関して年金管理を行う責務は、弁理士から管理会社へと移行する。

これら一連の移管作業には手間がかかる。しかも、この作業は、入力ミス等の人為的ミスを招来する要因をはらんでいる。ミスにより、企業の意図に反し、年金不納を理由とする特許権の消滅が招来されることもある。

本発明はこのような実状に鑑みてなされたものであり、効率的で、しかもミスの生じにくい年金管理業務移管方法の提供を目的とするものである。

【課題を解決するための手段】
本発明に係る年金管理業務移管方法は、以下のステップを含む。
(1)工業所有権に関する書誌データを備えたデータベースが格納された記憶手段、演算手段及び入力手段を備えたコンピュータを保有する依頼者が、この入力手段から検索条件データを入力する入力ステップ。
(2)入力された検索条件データとデータベース中の書誌データとを演算手段に対比させ、検索条件に合致する工業所有権を抽出させる抽出ステップ。
(3)抽出された工業所有権に関する電子データを、回線を通じて管理者に送信する移管依頼ステップ。
(4)管理者において移管処理が完了した工業所有権に関する電子データを、回線を通じて管理者から受領する受領ステップ。
