STATO DELLA TECNICA STATE OF THE TECHNIQUE

Attualmente non esiste in Italia alcun dispositivo manuale di apertura e chiusura delle persiane di un’abitazione con caratteristiche simili al trovato. Esiste invece un dispositivo automatico elettromeccanico, anche se é assai poco diffuso dato l’alto costo, che viene denominato nel relativo depliant pubblicitario “senatore automatico di persiane" . Tale dispositivo é sostanzialmente diverso dal trovato di cui chiedo la protezione, infatti Tesistente é concepito concettualmente come i chiudi porta automatici a braccio pieghevole, ( tanto usati e collocati in alto sulle porte dei locali commerciali), soltanto che al posto della molla che chiude la porta é stato semplicemente inserito un motorino che può ruotare nei due sensi aprendo e chiudendo la persiana. Il trovato, oggetto della presente richiesta di concessione di brevetto, non ha nulla a che vedere con Tesistente, se non lo scopo finale di chiudere ed aprire le persiane. Uno dei punti di forza e di sostanziale diversità che caratterizza il trovato é un costo assai ridotto, molto piu basso del chiuditore elettromeccanico citato, tanto da prevedere per il trovato una larga diffusione, anche nelle abitazioni dotate di finiture standard, cosa improponibile per il sistema automatico esistente che é effettivamente relegato ad abitazioni prestigiose e quindi naturalmente dotate di accessori molto costosi. Un altro punto di forza del trovato é la semplicità d’uso e l’affidabilità del sistema, dovuta al ridotto numero di componenti utilizzati, tutti meccanicamente non crìtici e di facile ed economica realizzazione. Da un punto di vista estetico poi, il trovato non si vede per nulla dall’esterno dell’abitazione, sia con persiane aperte che chiuse, essendo nascosto sotto il davanzale, mentre 1’esistente si caratterizza per la presenza dei due antiestetici braccetti delegati alla movimentazione. Nulla vieta di realizzare, in futuro, il trovato automatizzandolo tramite motorino elettrico, infatti le caratteristiche di novità del trovato rispetto all’esistente non si esauriscono, come sarà chiaro in seguito, nell’azionamento manuale piuttosto che automatico del dispositivo ma nella stessa concezione del dispositivo stesso che ad esempio, non usa per nulla bracci pieghevoli, ma ruota i cardini inferiori delle persiane. La tavola numero uno evidenzia la vista in pianta del congegno meccanico già montato sotto un davanzale ed azionante una persiana liscia, classica del nord Italia, si evidenziano i seguenti particolari: A = davanzale lato esterno, B = trasmissione a catena della rotazione, C = anta della finestra, D = maniglia di comando. La descrizione dettagliata del prototipo é stata fatta allo scopo di descrivere compiutamente l’oggetto della richiesta di brevetto, ma si intende proteggere non solo la particolare realizzazione espressa dal prototipo ed ampiamente descritta, bensì in separata rivendicazione, la stessa idea inventiva che ha originato la particolare realizzazione; piu nel dettaglio le caratteristiche qualificanti dell’idea inventiva sono il ruotare dei cardini inferiori tramite semplice meccanismo meccanico incassato nella muratura, questa caratteristica da sola rende sostanzialmente diverso dall’esistente il trovato e sicuramente al di sopra della portata del tecnico medio nell’esercizio delle normali funzioni. La sequenza delle operazioni da svolgere per aprire le imposte é la seguente: tirando la maniglia di manovra si effettua lo sbloccaggio della stessa e quindi delle persiane, ruotandola si mette in movimento la prima persiana, quella piu esterna che inizia ad aprirsi, successivamente, ruotando ancora la maniglia entrambe le persiane si aprono. CLAIMS 1) I claim the patent protection of the manual device described in detail, suitable for opening, closing and locking the shutters in certain positions.

2) I claim the protection of the device referred to in the first claim even if operated by an electric motor, since also in this case the invention is substantially different and innovative with respect to the existing one.

3) I claim the protection not only of the particular realization of the inventive idea as described, but the same idea of opening, closing and locking the shutters by acting on the controlled rotation of the hinges which are made integral with the lower (or possibly upper) hinges of the shutters, whether it is done manually or by means of an electric motor.
