TITLE

Procedure for the signing of electronic documents that satisfy the requirement of the written form by affixing an advanced electronic signature by means of the voice.

THE PROBLEM NOT YET SOLVED

At present, the problem arises of having two or more subscribers sign an IT document, at least one of whom does not have a digital signature certificate and / or a device capable of using this digital signature certificate, or the subscriber does not intends to use it, or for cases in which the conditions for its use do not exist in the place and time in which the document itself is to be signed, or for cases in which at least one of the subscribers has a signature certificate corresponding to a different standard from that of other digital certificates used by other subscribers.

Even when it is possible to resort to advanced electronic signature procedures based on graphometric signature devices, these devices must be suitably configured and connected to the IT system that contributed to the formation of the IT document, so that it can receive the IT document in good time, present it to the subscriber to allow consultation, collect signature data, integrate such data indissolubly into the electronic document, and transfer everything to an electronic archive capable of providing an original copy to the subscriber and making it a replacement.

Although the connection can be wired or even wireless, if neither is available, the subscriber cannot proceed.

Furthermore, the subscriber is forced to sign the document before being able to dispose of the copy for himself.

In all these cases it is necessary to have recourse to the analogical formation of the originally computerized document, in the copies of the necessary number, and to the subsequent analogical signature of all the copies by affixing their own handwritten signature.

The direct consequence of this is the lack of dissemination on a sufficient scale of digital behaviors and habits, which would make it possible to reduce the costs, times and expenses of all the actors involved in signing the IT document.

The advanced electronic signature procedure that will be described below allows you to overcome the aforementioned obstacles, since:

1. guarantees the identification of the subscriber

2. guarantees the unique connection of the signature to the subscriber 3. guarantees the exclusive control of the signer over the signature generation system

4. guarantees the possibility of verifying that the signed electronic document has not undergone any changes after the signature has been affixed

5. guarantees the possibility for the subscriber to obtain evidence of what has been signed

6. guarantees the identification of those who provide advanced electronic signature solutions in order to use them in relationships with third parties for institutional, corporate or commercial reasons, creating them on their own or even making use of solutions created by subjects who, as business enterprise, create advanced electronic signature solutions for the aforementioned subjects

7. guarantees the absence of any element in the electronic document capable of modifying the acts, facts or data represented therein

8. guarantees the unique connection of the signature to the signed document

9. does not require any IT device to display the IT document to be signed, 10. is not subject to the different technological standards for the use of digital certificates,

11. does not force the subscriber to sign the document before disposing of the copy for himself

UTILITY OF THE INVENTION

The procedure is useful in cases where it is necessary to sign electronic documents having a written form requirement by one or more subscribers with the use of the word, in a place where it is possible to proceed with the digital recording of the voice, and in the presence of a context in which at least one of the following conditions is met:

• At least one of the persons who intend to subscribe does not hold any qualified electronic signature certificate • At least one of the persons who intend to subscribe holds at least one qualified electronic signature certificate which, however, does not intend to use for signing that document, or in that moment

• At least one of the persons who intend to subscribe holds at least one qualified electronic signature certificate, but at the time of signing the electronic document he does not have one

• At least one of the persons who intend to subscribe holds at least one qualified electronic signature certificate, but at the time of signing the electronic document does not have an IT device for its use • At least one of the persons who intend to subscribe holds at least one qualified electronic signature certificate, at the time of signing the IT document it has an IT device for its use, but the device is not able to use the qualified signature certificate

• At least one of the people who intend to subscribe has at least a qualified electronic signature certificate but can make a reduced use of the upper limbs even only temporarily, and therefore cannot proceed with it

• At least one of the people who intend to sign does not have qualified electronic signature certificates, can write but can make limited use of the upper limbs and therefore cannot proceed with an autograph signature on an analog copy of the original electronic document

• It is the will of at least one of the people who intend to sign the electronic document to obtain before signing an analog copy that gives a guarantee of enforceability to third parties

• It is the will of at least one of the signatories to sign the electronic document using their own voice

• The electronic document subject to subscription must be signed by several people, at least one of whom is in a context similar to at least one of the aforementioned contexts

• In the place where the subscription is to take place, there are no IT devices and / or an IT connection

EXPOSURE OF THE INVENTION

Definitions

For the correct understanding of the procedure, the following definitions are introduced:

Analog document on paper: Document formed using paper as the physical medium.

• IT document: IT representation of legally relevant deeds, facts or data.

• Computer evidence: sequence of binary symbols (bits) that can be processed by a computer procedure.

• Fingerprint of a computer document: sequence of binary symbols (bits) of predefined length generated by applying a suitable hash function to the computer document

• Hash function: function that has computer documents as its domain and computer evidence as its domain;

• Phonetic hash function: hash function which has the set of computer documents as its domain and the set of phonemes of a given linguistic system as its range.

• Phonetic imprint of an IT document: sequence of phonemes generated by applying a suitable phonetic hash function to the IT document.

• Phonetic function: function which, given a linguistic system, associates one and only one phonetic hash function HF with a hash function H such that, having taken any computer document, the imprint I obtained by applying H to the computer document is in one-to-one relationship with the IF fingerprint obtained by applying HF to the same IT document.

• Phonetic version of the fingerprint of a computer document:

the phonetic imprint IF of a given IT document such that there is a phonetic function of H in HF where: o H is the hash function that applied to the IT document generates the imprint I

o HF is the phonetic hash function that, applied to the IT document, generates the phonetic imprint IF

• Issuer: body responsible for preparing the electronic document

• Transducer body: body that is responsible for associating a phonetic imprint to a given IT document

• Subscriber body: person able to read aloud and clear an arbitrary sequence of phonemes according to a linguistic system known a priori, who intends to sign by means of his own voice a computer document with the characteristics of a document written according to a linguistic system also known a priori although possibly different from the one mentioned above.

• Derived IT document

IT document obtained by joining a computer document with its fingerprint I obtained by applying a hash function H and its fingerprint IF obtained by applying a phonetic hash function HF such that IF is the phonetic version of the fingerprint I according to a known phoneticization function F.

Description of the procedure

Let it be given that:

1. The ISSUER has formed an IT document called IT DOCUMENT intended to be signed also by a subscriber body called SUBSCRIBER ENTITY which is in at least a context similar to those indicated in the paragraph on the usefulness of the procedure.

2. ISSUER has charged the transducer body TRANSDUCER ENTITY to make it possible for the SUBSCRIBING ENTITY to sign an IT DOCUMENT by means of the voice

3. ISSUER has appointed another body, including the TRANSDUCER BODY itself, to have the IT document signed by other subscribers other than the SUBSCRIBER BODY

4. The subscribers other than the SUBSCRIBING BODY also intend to proceed as the SUBSCRIBING BODY, or with procedures other than the procedure described in this document and nevertheless valid for the purpose of signing electronic documents.

Then proceed as follows:

5. TRANSDUCING ENTITY selects a hash function H (es) and a phonetic hash function HF (es) according to a selected linguistic system so that the phonetic imprint IF of any computer document is the phonetic version of the imprint I of the IT document itself through an appropriate phonetic function F (H (es); HF (es))

6. TRANSDUCING BODY communicates to the ISSUING BODY the function H (es) to be used for the formation of the IT DOCUMENT to be signed by the SUBSCRIBER

7. ISSUING BODY forms the electronic document and calculates the I (es) footprint using the H (es) function.

8. ISSUING BODY transmits electronically to the TRANSDUCING BODY the I (es) imprint and the IT DOCUMENT and to be signed by the SUBSCRIBING BODY

9. TRANSDUCING ENTITY verifies that the imprint I (es) is actually corresponding to the imprint obtained on IT DOCUMENT using the hash function H (es) and then proceeds with the generation of the phonetic imprint IF (es) applying the phonetic hash function HF (es)

10. TRANSDUCER BODY proceeds with the generation of a new IT document called DERIVATIVE IT DOCUMENT, obtained by joining IT DOCUMENT with I (es) and IF (es)

11. TRANSDUCER BODY proceeds with the calculation of the footprint

I (derivative; es) of the DERIVATIVE COMPUTER DOCUMENT and the conservation of the DERIVATIVE COMPUTER DOCUMENT itself

12. TRANSDUCER BODY proceeds with the generation of an analog copy, preferably on paper, of the DERIVATIVE COMPUTER DOCUMENT 13. TRANSDUCER BODY takes action to send to the SUBSCRIBING BODY the analog copy of the DERIVATIVE DOCUMENT, directly or through intermediaries in charge with a generic device on the market for recording sounds capable of recording on

digital with a minimum sampling rate of 8,000 Hertz. These include the common portable recorders on the market, portable digital recorders, mobile phones operating on GSM or later standards, landline phones, tablets, notebooks or personal computers equipped with sound card and built-in or external microphone, etc. . It is also possible to use a fixed or mobile telephone line, by means of which to call an appropriate telephone number to which a generic telephone communications recording device is connected.

SUBSCRIBING INSTITUTION receives the analog copy of the DERIVATIVE COMPUTER DOCUMENT, reads its content and thus forms its will whether to sign the DERIVATIVE COMPUTER DOCUMENT or not

If the SUBSCRIBING ENTITY wishes to sign the DERIVATIVE COMPUTER DOCUMENT, it will follow the instructions contained therein so that the phonetic fingerprint IF (es) is recorded on the device for recording the sounds on digital support and preferably its personal details and the current date as well as possibly additional phrases pronounced aloud to facilitate the subsequent spectroacoustic examination.

TRANSDUCER BODY obtains digital support from the SUBSCRIBING BODY or through appointed intermediaries

TRANSDUCER BODY extracts the audio content from the device used for recording and performs the spectroacoustic examination of the recorded voice to verify that it is a human voice

TRANSDUCER BODY performs the analysis of the voice to verify that the phonetic fingerprint is contained IF (es) TRANSDUCER BODY calculates the I (audio; es) fingerprint of the audio content

TRANSDUCER BODY will keep the audio content in a substitute regime

TRANSDUCING ENTITY populates a data structure containing the following minimum information:

22. TRANSDUCER ENTITY shall keep the data structure in a replacement regime

23. TRANSDUCER BODY transmits the data structure and preferably the DERIVATIVE IT DOCUMENT to the ISSUING BODY.

CONSIDERATIONS ON THE DEVICE FOR THE RECORDING OF SOUNDS ON DIGITAL MEDIA

The device for recording sounds on digital support may also not be in the custody of the intermediary in charge, or of the SUBSCRIBER ENTITY itself, but rather be available remotely and used by telephone call to a predetermined telephone number and the possible presence of a access filter consisting of switchboard personnel or an automatic interactive responder.

In this case, the SUBSCRIBER ENTITY dials the pre-established telephone number and interacts with the access filter to be identified. Once identified, it proceeds with the registration of the phonetic fingerprint IF (es). In this case, it is preferable that the sounds emitted by the SUBSCRIBING ENTITY are also recorded on digital support, and always preferably also the telephone number used by the SUBSCRIBING ENTITY to make the telephone call, the date and time of the start of the conversation and the duration of the conversation itself.

Claims (5)

CLAIMS 1. Procedure for signing electronic documents by affixing an advanced signature by means of the voice, comprising the following steps: a) selection of a finite subset of distinct phonemes, of arbitrary cardinality not less than 2; b) selection of the set of binary sequences "0" (zero), "1" (one) and any further combinations of "0" and "1" so that there are no two identical binary sequences and in such a way that the cardinality of the set is not greater than the cardinality of the finite subset of phonemes selected in the previous phase a); c) association, to each binary sequence belonging to the ensemble selected in the previous step b), of one and only one phoneme among those belonging to the subset of the previous step a) not yet associated with any binary sequence; d) transposition of the electronic document in binary representation; e) starting from the first binary element present in the binary transposition of the IT document, selection of the maximum number of binary elements contiguous to each other such that the sequence thus obtained is identical to a binary sequence present in the set referred to in point b) above, and such that the binary sequence that would be obtained by adding the next binary element of the binary transposition of the computer document would not belong to the set of binary sequences referred to in step b) above; f) application of the hash function to this maximum number of binary elements selected as in the previous step e) so that they are replaced by the phoneme associated with the binary sequence as indicated in the previous step c); g) starting from the first binary element remaining in the binary transposition of the IT document, selection of the maximum number of contiguous binary elements such that the sequence thus obtained is identical to a binary sequence present in the set referred to in point b) above, and such that the binary sequence that would be obtained by adding the next binary element of the binary transposition of the computer document would not belong to the set of binary sequences referred to in step b) above; h) replacement of this maximum number of binary elements selected as per the previous stage g) with the phoneme associated with the binary sequence as indicated in the previous stage c); i) repetition of steps g) and h) until the binary transposition of the IT document has been completely replaced by phonemes; j) application of an arbitrary hash function to the phoneme sequence thus obtained, in order to obtain a well-given binary sequence k) derivation of the new IT document obtained by joining the original IT document with the instructions intended for the subscriber so that he can proceed with the signing, and with the binary sequence referred to in step j) above; l) generation of an analog copy of the IT document derived from the previous phase k) m) delivery of the analogue copy to the subscriber; n) reading by the subscriber of the instructions to proceed with the subscription; o) reading aloud by the person, subscriber of the full content analogue of the derived IT document, and contextual recording on a device for digital recording of sounds; p) spectroacoustic analysis of the recording referred to in the previous step o) comprising at least one of the following numerical parameters: fundamental frequency - amplitude of vocal emission jitter shimmer - spectral energy balance diplophony momentary stops of vocal output q) replacement storage of the digital recording referred to in the previous phase o). 2. Process according to claim 1, in which said spectroacoustic analysis takes place during recording on a device for digital recording of sounds 3. Process according to claim 1 or 2, wherein the spectroacoustic analysis includes the comparison between the numerical parameters of the digital recording and those of a digital recording obtained in previous times, referable or not to the subscriber, based on the same linguistic system or even on a different one. 4. Process according to claims 1 to 3 wherein the derivation of the computer document is obtained by combining the computer document with the binary sequence in turn obtained from the arbitrary hash function applied to the phoneme sequence. 5. Process according to claims 1 to 4 in which the replacement of the binary transposition of the computer document with the sequence of phonemes is obtained by applying an arbitrary phonetic hash function such that the phonetic imprint is in one-to-one correspondence with the imprint of the computer document, second - associates to a hash function H one and only one phonetic hash function HF such that, having taken any computer document, the imprint I obtained by applying H to the IT document is in a one-to-one relationship with the imprint IF obtained by applying HF to it IT document.
