Abstract

Access control system without physical barriers constituted from an enclosure (17) in which a control module (1), a detection module (2), an identification module (3), various emitting devices are housed. visual (8) and audible (9) signals; and on the other hand a surveillance camera (10) as well as devices for the emission of visual (6) and audible signals (7) in the workplace of the room security officer, so that following a specified procedure, the access control without imposing barriers in the access to the restricted area or the need to have security personnel in each of the accesses. The system authorizes access when the detection module and the identification module send signals that the control module (1) interprets as meeting the requirements for the entry of people.

 2. Statement motivated according to articles 29.6 and 29.7 of the Regulations for the execution of Law 11/1986, of March 20, on Patents on novelty and inventive activity; quotes and explanations in support of this statement D01 is considered the state of the art document closest to the object of the claimed application. Following the wording of the independent claim, D01 describes a customer recognition system in a space intended for the public (therefore, without physical barriers: see summary) constituted, among others, by the following technical elements:

 An envelope or terminal (see reference 110 in figure 1 and paragraph [0041])

 A control module associated with the terminal (see reference 50 in figure 1)

 A detection module that detects the presence of the customer through a sensor (see paragraph [0026]). Specifically, in D01, the sensors described are cameras that capture the image of the customer (see paragraph [0020]). Once the presence of the client is detected, the appropriate signal is sent to the control module to operate accordingly.

 An identification module consisting of a biometric face recognition system (see paragraph [0020] and claims 7 and 8) consisting of a set of cameras that send the collected information to the control module for comparison with a database (see paragraph [0031]). The recognition system described in D01 admits various possible locations and, in one of its possible embodiments, is located at the entrance or access to the public space (see paragraph [0025]) in a position suitable for the detection of the passage of people. Once the customer is identified, a personalized welcome message is generated (see paragraphs [0012] and [0025]). In one of the possible embodiments of the invention described in D01, the control system includes a system of recognition of unauthorized persons and their presence is notified to security personnel (see paragraphs [0021 and [0038]). On the other hand, the list of unauthorized persons is obtained from local or governmental security sources, private security systems, etc ... (see claim number 9). With regard to independent claim number 1, and taking into account the content of D01, it is considered that all the technical elements claimed in R1 that allow the resolution of the technical problem raised are described implicitly or explicitly in D01 where they develop the same technical function considering the differences between R1 and D01 mere design options, so it is concluded that R1 lacks inventive activity within the meaning of article 8.1 of the Patent Law. Specifically, the devices emitting light and sound signals (both inside the enclosure and at the workplace of the person in charge of the security of the room) are not described in D01 although its existence and nature would be obvious to the expert in the matter, so this difference is considered a mere design option devoid of inventive activity. With reference to the dependent claim number 2, it lacks inventive activity in the same way as the independent claim on which it depends since the technical elements included therein (surveillance camera) are identically described in D01. It is considered that the dependent claims numbers 3, 4, 5 and 8 lack inventive activity within the meaning of article 8.1 of the Patent Law since the technical elements they incorporate (pushbuttons, light signaling devices, etc ...) thus As its specific characteristics, design options are considered. In relation to claim number 6, the main difference between R6 and D01 is that D01 does not describe infrared sensors but only surveillance cameras. However, the use of infrared sensors in access control and surveillance systems is widespread as reflected in document D02 representative of the state of the art in the sector. Therefore, it is considered that R6 lacks inventive activity within the meaning of Article 8.1 of the Patent Law. As regards dependent claim 7, the main difference between it and D01 is that, although in D01 there is mention of biometric identification systems, the use of a fingerprint reader is not specifically mentioned . However, the use of this type of readers in access control and surveillance systems is widespread as reflected in document D02 representative of the state of the art in the sector. As regards the incorporation of an electronic ID reader, it is considered that this technical element is already described in D01 since it is equivalent to the card reader (see reference 60 in figure 1 and paragraph [0030]) which is part of the invention described in D01. Therefore, R7 is considered to lack inventive activity within the meaning of Article 8.1 of the Patent Law. In relation to dependent claim number 9, although D01 does not explicitly mention the possibility of internet connection as well as the automatic update of the list of prohibited persons to the restricted area, these are considered usual technical characteristics within the technical sector in question which do not imply inventive activity themselves (see D02 paragraph [0303] as an example).

 WRITTEN OPINION As regards the independent claim of procedure number 10, D01 is considered the state of the art document closest to the object of the claimed application. Following the wording of independent claim number 10, D01 describes a procedure whereby an identification module informs a control module that the identification of a person has been made in the access to a public space. When the access of an authorized person is detected, a personalized welcome message is generated (see paragraphs [0012] and [0025]). In one of the possible embodiments, upon detecting the access of an unauthorized person, their presence is notified to security personnel (see paragraph [0021]). Based on the above, it is considered that the differences between R10 and D01 are mere design options (for example the type of light or sound signals that are activated when an authorized person accesses or how exactly the access of a non-person is communicated authorized to the security personnel by means of light or audible signaling at the checkpoint), so R10 lacks inventive activity within the meaning of article 8.1 of the Patent Law. In relation to the dependent claim number 11, it lacks inventive activity in the same way as the independent claim on which it depends since the process of consultation and transmission of data between the identification module and the control module described in D01 is constant whenever there is an event or person accessing the restricted area. R12 lacks inventive activity according to reasoning analogous to that proposed for R5. D03 and D04 are documents representative of the state of the art in the sector.
