Statement motivated according to articles 29.6 and 29.7 of the Regulations for the execution of Law 11/1986, of March 20, on Patents on novelty and inventive activity; quotes and explanations in support of this statement La invención definida en la reivindicación 1 consiste en un dispositivo configurado para acoplarse sobre el cuello abrazándolo de delante hacia atrás, que consiste en un cuerpo en forma de U, con una rama central que se sitúa entre el mentón y pecho del usuario, y dos ramas laterales posicionadas para apoyar elásticamente sobre los laterales del cuello, cuya rama central tiene un borde superior libre, destinado a servir como apoyo al mentón, y un borde inferior libre, a través del que apoya dicha rama central en el pecho; y cuyas ramas laterales sobresalen del cuerpo central en posición sensiblemente paralelas, dirigidas hacia un mismo lado, y tienen cierta capacidad de deformación elástica en el plano definido por dichas ramas. Se considera D01 el documento del Estado de la Técnica anterior más próximo al objeto de la reivindicación 1. D01 divulga (referencias de D01) un: Dispositivo apropiado para prevenir lesiones cervicales formado por un cuerpo en forma de U (10), configurado para acoplarse sobre el cuello, abrazándolo de delante hacia atrás, con una rama central (10a) que está dimensionada para situarse entre el mentón (20) y pecho del usuario, para servir como medio de separación entre ambas partes, y dos ramas laterales (10b, 10c) posicionadas para apoyar elásticamente sobre los laterales del cuello, cuya rama central tiene un borde superior libre, destinado a servir como apoyo al mentón (20), y un borde inferior libre, a través del que apoya dicha rama central en el pecho; y cuyas ramas laterales sobresalen del cuerpo central en posición sensiblemente paralelas, dirigidas hacia un mismo lado, y tienen cierta capacidad de deformación elástica en el plano definido por dichas ramas. No existen diferencias entre D01 y la primera reivindicación. Por tanto, la invención definida en la reivindicación 1, no tiene novedad (Ley 11/1986 de Patentes, Art. 6) La reivindicación 2 añade al contenido de la reivindicación 1 el hecho de que al menos la rama central, está compuesta por una pared externa rígida, y un recubrimiento interno elástico que sobresale parcialmente respecto de los bordes superior e inferior de la pared externa. El documento D01 divulga que al menos la rama central, está compuesta por un recubrimiento interno elástico (14). La diferencia existente entre el contenido de D01 y lo que añade la reivindicación 2 es: -En la reivindicación 2 al menos la rama central, está compuesta por una pared externa rígida. En el estado de la técnica existen múltiples soluciones para impedir la incorrecta flexión del cuello. Así, en D02 (referencias de D02), se divulga un soporte para el cuello en el que, al menos la rama central, está compuesta por una pared externa rígida (17). El hecho de incluir que el recubrimiento interno elástico sobresale parcialmente respecto de los bordes superior e inferior de la pared externa, es una opción de diseño para el experto en la materia, sin un efecto técnico sorprendente añadido al ya conocido, no suponiendo más que una alternativa evidente para un hombre del oficio. Por lo que el experto en la materia podría combinar las características técnicas incluidas en el documento D01 con las incluidas en el documento D02 para llegar a la invención definida en la reivindicación 2. Por tanto, la invención definida en la reivindicación 2, tiene novedad (Ley 11/1986 de Patentes, Art. 6) pero no tiene actividad inventiva (Ley 11/1986 de Patentes, Art. 8). El resto de reivindicaciones divulgan: el recubrimiento interno se prolonga sobre la superficie interior de las ramas laterales (reivindicación 3); las ramas laterales son de menor altura que la rama central y sobresalen como prolongación de la capa externa de dicha rama central, en alineación con el borde superior libre de la misma (reivindicación 4); la rama central y ramas laterales presentan aberturas o vaciados intermedios (reivindicación 5). Las reivindicaciones 3 a 5 están contenidas o son meras variaciones de diseño con respecto a lo divulgado en la combinación de documentos D01 y D02, ya que añaden características que están presentes en el Estado de la Técnica (ver documentos D01 a D05), o se derivan de él de forma evidente para el experto en la materia. Por tanto, las invenciones definidas en las reivindicaciones 3 a 5, tienen novedad (Ley 11/1986 de Patentes, Art. 6) pero no tienen actividad inventiva (Ley 11/1986 de Patentes, Art. 8). There are no differences between D01 and the first claim. Therefore, the invention defined in claim 1 is not new (Patent Law 11/1986, Art. 6) Claim 2 adds to the content of claim 1 the fact that at least the central branch is composed of a rigid outer wall, and an elastic inner lining that partially protrudes from the upper and lower edges of the outer wall. Document D01 discloses that at least the central branch is composed of an elastic internal covering (14). The difference between the content of D01 and what is added by claim 2 is: - In claim 2 at least the central branch is composed of a rigid outer wall. In the state of the art there are multiple solutions to prevent incorrect neck flexion. Thus, in D02 (references of D02), a neck support is disclosed in which, at least the central branch, is composed of a rigid outer wall (17). The fact that the elastic internal coating partially protrudes with respect to the upper and lower edges of the external wall is a design option for the person skilled in the art, without a surprising technical effect added to that already known, assuming only a Obvious alternative for a man of the trade. Therefore, the inventions defined in claims 3 to 5 are novel (Law 11/1986 of Patents, Art. 6) but have no inventive activity (Law 11/1986 of Patents, Art. 8).
