2. Statement motivated according to articles 29.6 and 29.7 of the Regulations for the execution of Law 11/1986, of March 20, on Patents on novelty and inventive activity; quotes and explanations in support of this statement

The main object of the invention is a refrigerator protector that adheres to the surface of the tray. This object is achieved by the characteristics established in the characterizing part of claim 1, wherein it is detailed that the protector is constituted from a roll of silicone foil with adhesive layer on the bottom surface. The upper surface can contain an advertising space or decorative designs (reiv. 2), can present a cross-sectional lines, parallel to each other and equidistant, favoring a quick and easy cut (reiv. 3). The sheet can be completely transparent (reiv. 4).

Document D01 is considered the closest in the state of the art to the object of claim 1, and discloses (the references in parentheses correspond to this document): a roll (70) containing several protective sheets (74) of the trays of the refrigerator (14). The protective sheets (74) are separated by perforation lines (76). Each protective sheet (74) is composed of a non-permeable layer (77) at the bottom and an absorbent layer (78) fixed to the previous one. The non-permeable layer (77) prevents liquids from passing, while the absorbent layer (78) absorbs a specific volume of liquid. The non-permeable layer (77) may be composed of various materials such as, and not limited to vinyl, plastic or the like. Each protective sheet (74) can have a desired specific color and design, to coordinate with the refrigerator (12) and the kitchen.

The difference between document D01 and the technical object of claim 1 of the application is that on the one hand, it does not have an adhesive layer on the lower surface and on the other hand the silicone material is not specified.

With respect to the material, in D01 several are named vinyl or plastic that can be equivalent to silicone, since they also have impermeable properties.

And in relation to the adhesive layer, the underlying technical problem is that the sheet cannot be fixed to the tray. For any expert in the field, it would be obvious to put a layer of adhesive on the bottom to solve the technical problem.

Even so, it can be seen, for example, in document D02, which discloses (the references in parentheses correspond to this document): a lighting system (7) for the trays of a refrigerator, which has a protective layer (18 ), which can be a sheet of insulating material, for example plastic, with an adhesive surface.

Therefore, the object of claim 1 lacks inventive activity (Art. 8.1 LP 11/1986).

With respect to dependent claims 2 to 4, the main difference between D01 and the claimed object is that it is not specified that the perforation lines are parallel to each other, nor equidistant, nor that the sheet is transparent, however, these characteristics design features and mere obvious executions are considered for an expert in the material.

Therefore, claims 2 to 4 also have no inventive activity (Art. 8.1 LP 11/1986).
