2. Statement motivated according to articles 29.6 and 29.7 of the Regulations for the execution of Law 11/1986, of March 20, on Patents on novelty and inventive activity; quotes and explanations in support of this statement

The object of the invention patent is, according to the content of claim 1, a device for the collection of tree fruits comprising a frame with a portable ladder, in which the frame supports two layers of tissue fastened by hooks , springs or elastic and where the upper layer of tissue is made cuts in the central area through which the fruits fall to the lower layer. Additionally, the portable ladder can be of adjustable inclination by means of arms or braces that join the same with the frame (claim 2), and where the support of variable height on which the frame sits is constituted by legs, skates or wheels ( claim 3). Documents D01-D06 only reflect the state of the art. Document D01 shows a device for collecting tree fruits comprising a compact set of horizontal frame with a ladder (60) connected by arms or braces (258) to the frame on one of its sides. The frame supports a layer of fabric (200) that occupies its entire surface and has a cut (56) made in its central area through which the fruits fall to the lower layer; In addition, the portable ladder can be adjustable by means of the arms (258) that join it with the frame. One of the differences found in document D01 is that the collection of fruit that falls by gravity from the upper layer is not carried out in a lower layer of tissue but in a conveyor; and although we find in other documents of the state of the art, such as D02 a fruit collection device comprising a frame that supports two layers of tissue (130 and 131) where the upper layer has cuts or openings (130b) for fruit fall to the lower layer of tissue, the configuration of said device does not meet the characteristics as recommended by the invention. Documents D03, D04, D05 and D06 show different devices for collecting tree fruits where the frame comprises a layer of tissue where the fruit is collected and where by gravity it falls towards different collection systems. None of said documents shows an arrangement as described in claims 1 to 3 and therefore cannot be considered as prior. On the other hand, it is not obvious that, from said documents, a person skilled in the art could conceive a similar arrangement, with the characteristics mentioned in said claims. The invention claimed through the content of claims 1 to 3 seems to bring obvious improvements over what is already known in the field of tree fruit harvesting devices and therefore can be considered to be new, involves inventive activity and has industrial application of in accordance with articles 6 and 8.1 of Law 11/86 of March 20 on Patents.
