2. Statement motivated according to articles 29.6 and 29.7 of the Regulations for the execution of Law 11/1986, of March 20, on patents on novelty and inventive activity; quotes and explanations in support of this statement

D01 is considered the closest prior art document to the claimed object. Following the wording of the claims, describe the following:

A device for representing elastic information comprising a display for the emission of the message, wherein said display comprises a deformable matrix of light elements of information, for issuing information of variable content. These light elements are LEDs. Said light emitting diodes are arranged on a flexible laminar support, on which the corresponding conductive tracks are arranged, by way of an LED curtain. The device has a control unit and event detection sensor means, as well as wireless programming means. (See paragraphs [0007], [0013], [0019], [0021], [0037], [0058] and ﬁ gures1a7)

The characteristics of independent claim 1 are already known from the base document, therefore this claim is not new in view of the state of the known art. (art 6.1 LP) Likewise, the characteristics of claims 3, 4, 13 and 15 are also disclosed in D01, so that these claims would also not satisfy the novelty requirement according to article 6.1 LP. The same reasoning would apply after the study of D02 with respect to claims 1, 2, 3, 4 and 15.

Dependent claims 5, 6 and 7 differ from the base document in which the laminar support is transparent, opaque

or translucent. These characteristics do not have a technical effect in relation to the technical problem posed. Therefore, these claims, in light of the disclosure made by D01, would suffer from a lack of inventive activity. After the study of D02, the same conclusion would be reached.

Dependent claims 8, 9, 10 and 11 differ from D01 in that the light elements are selected from the group consisting of thermochromic inks, nanotubes, graphites or electroluminescent elements. These elements are technical equivalents of the LEDs disclosed in D01. Therefore, this claim would not enjoy inventive activity, both for the disclosure made in D01 and for the one made in D02. (art 8.1 LP)

Dependent claim 12 differs from D01 in that the device has programming means to be operated from a control unit. D01 has a control unit and talks about its possible control wirelessly. The use of wired programming instead of wireless is a feature that does not contribute to the result of the invention, so this claim would not satisfy the requirement of inventive activity. This reasoning would also apply to D02.

Dependent claim 14 differs from D01 in that it has means of retransmission of action to the display. In D01 the sensor is part of this display, which would not require retransmission to the display. An equivalent design option would be the placement of the sensors outside the display and their retransmission to it. The use of retransmission means is of common general knowledge, so this claim would not enjoy inventive activity. (art 8.1 LP)
