The entire process of querying the patent information associated with company a is cumbersome. Accordingly, patent query methods based on patent knowledge graph are provided herein.
The patent query method based on the patent knowledge graph provided by the application can refer to fig. 1, and fig. 1 is a flow diagram of the patent query method based on the patent knowledge graph provided by the embodiment of the application, which is applied to a server. The embodiment of the application specifically takes the scene of inquiring patents by using a computer as an example. The method includes steps S101 to S103.
S101, responding to a patent query operation of a user, wherein the patent query operation comprises first enterprise information.
In the above steps, the server responds to the patent query operation of the user, and the query operation has many forms, such as inputting characters in a search box, inputting voice, inputting characters in a recognition picture, and the like, which is not limited herein; the server responds to perform the next steps of the application only when the user inputs enterprise information; because if the user inputs a part of keywords which are patent names, the server can search a plurality of patents from different unit applications, and although a patent map can be provided for each searched patent application unit or other attribute information, the interface is certainly complicated under the scene of searching a plurality of patents, and the user needs to perform information screening; the enterprise information herein may include various information such as company names, names of staff in the company, etc.; the enterprise information is not limited to the information of the enterprise of the company, but also includes institutions, institutions and the like which can apply for patent; the present embodiment is described for convenience, and is exemplified by searching for enterprise information, specifically, by searching for company names for patent retrieval.
For example, the server responds to the user entered enterprise information "company A".
S102, inquiring a patent map corresponding to the first enterprise information in a preset patent map library; the preset patent atlas library comprises a corresponding relation between first enterprise information and a patent atlas, the patent atlas comprises second enterprise information with a preset relation with the first enterprise information, the second enterprise information comprises one or more pieces of patent information, the preset relation comprises a patent invalid relation or a patent transfer relation, and the patent information comprises a patent text, an inventor, a current right person and quoted patent information.
In the step, the server searches a patent map corresponding to the enterprise information input by the user in a patent map library constructed in advance, wherein the patent map stores other enterprise information with a preset relation with the enterprise information; the preset relationship comprises a patent permission relationship, a patent cooperation relationship, a patent authorization relationship and a patent infringement relationship in addition to a patent invalidity relationship and a patent transfer relationship; the patent invalidation relationship, the patent transfer relationship, the patent permission relationship, the patent authorization relationship and the patent infringement relationship in the above relationship relate to the direction problem, if a patent transfer relationship exists between a and b, the patent can be transferred to b or b to a, and both cases are in the application range of the embodiment, that is, both cases of the above relationship with the direction problem are in the application range of the method of the present application; this embodiment is described in terms of a patent invalidity relationship and a patent transfer relationship for ease of expression.
It should be noted that, the enterprise information input by the user is not identical to the enterprise information in the corresponding patent map, and the enterprise information input by the user is a part of the enterprise information in the corresponding patent map, which also accords with the scene of searching by the user with short characters; the enterprise information in the corresponding patent map is expressed as a node in the patent map, and if the details of the node need to be checked, the user needs to click the node; the details of the enterprise information in the corresponding patent map comprise patent information, patent quantity, honor of the obtained patent field, obtained subsidy items, enterprise persistence state, main business label, establishment date, address, telephone and the like of the patents owned by the enterprise corresponding to the enterprise information; patent information represents detailed information of a patent, including abstract, application number, application date, public (bulletin) number, public (bulletin) date, estimated invalidation date, original applicant, current right person, invention (design) person, agency, acceptance office, right requirement number, document page number, IPC classification number, national economic industry classification, war new classification, claims, specification, drawing, PDF original document, citation information, legal information, etc.; it should be noted that, after the user clicks the enterprise information node, in order to make the interface content relatively simple, in the details of the enterprise information, each patent only displays a part of patent information, for example, only displays shorter characters such as a patent name, a filing date, a disclosure date, an inventor and an IPC classification number, if the user needs to view the detailed information of one patent, the user needs to click the area where the patent is located in the page to display the detailed information of the patent.
For example, after the server responds to the enterprise information "company a" input by the user, the server retrieves the patent atlas of company a in the preset patent atlas library, which is named atlas a herein; in the map a, the company a and the company B have a patent transfer relationship or a patent invalidation relationship, and of course, the relationship can also be other relationships listed above; for convenience of explanation and confusion avoidance, it is assumed that company a and company B have a patent transfer relationship, company a and company C have a patent invalidation relationship, and the map a may further include other relationships between company a and other companies; specifically, a patent owned by company B (named patent B) is set to invalidate a patent previously owned and authorized by company a (named patent a), and a patent (named patent C) is assigned to company a by company C.
In one possible implementation, it is determined whether the first enterprise information and the second enterprise information have a patent invalidation relationship, by: judging whether patent information of a first patent exists in a plurality of pieces of patent information included in the first enterprise information, wherein the first patent is a patent related to patent invalidation; if the patent information of the first patent exists in the plurality of pieces of patent information included in the first enterprise information, confirming that the patent information of the first patent relates to a patent invalid relationship; and acquiring second enterprise information corresponding to the second patent, wherein the second patent corresponds to the first patent and relates to the patent invalid, so as to confirm the second enterprise information which has the patent invalid relation with the first enterprise information.
Specifically, confirming which preset relations between the enterprise information input by the user and which enterprise information are specific, wherein the number of related enterprise information and the number of relation are more, so that whether the patent invalid relation exists between the enterprise and the user input enterprise is taken as an example in the step; the specific judgment mode is to traverse the patent atlas corresponding to the enterprise input by the user, find whether the patent atlas has the patent which is invalid to the enterprise input by the user through an invalid field, or the patent which is invalid to the enterprise input by the user is invalid to the patent which is owned by other enterprises, and the specific judgment mode is to find through the field, because the detailed information of each patent can be input when the preset patent atlas library is constructed and updated, the detailed information comprises the quote information and the legal information, and the corresponding labels can be added to the information when the information is input, so that the patent atlas is convenient to classify and find; if the patent information can be found, two patents related to invalid relationships are confirmed, and the respective enterprise names of the two patents are acquired, namely, the patent invalid relationships exist between the two enterprises.
In the above example, the server traverses the map a, searches that the patent B fails to function as the patent a, and obtains the enterprise information of the patent B, namely, company B, so that the company a and the company B have a patent failure relationship in the map a.
In one possible implementation manner, before a patent map corresponding to the first enterprise information is queried in a preset patent map library, a patent map is constructed; wherein, the construction of the patent map specifically comprises: and constructing a patent map corresponding to the first enterprise information, wherein the patent map comprises a first node, a second node and edges connecting the first node and the second node, the first node comprises the first enterprise information, the second node comprises the second enterprise information, and the edges connecting the first node and the second node represent the invalid patent relation.
Specifically, before the relationship judgment is performed by the server, a preset map library needs to be constructed and updated; for convenience of description, only a patent map constructed by two enterprise information is described herein, that is, the patent map includes two nodes, the two nodes are connected by an edge, the nodes represent enterprise information, the enterprise information is not enterprise detailed information, and preferably, the nodes only display enterprise names; edges represent the relationship between two enterprises, and in this step, the edges represent the patent invalidity relationship; under the condition that two enterprises have a plurality of relations, two nodes can have a plurality of edges, or the edges can be integrated into one edge, and after a user clicks the edge, the detailed relation can be seen; the step is described by two nodes, and in an actual application scene, the patent map can relate to a plurality of nodes, and the method can still be used for constructing or updating the patent map.
In the above examples, the construction of the patent map specifically includes: company a corresponds to node a, company B corresponds to node B, and the edge ab connecting node a and node B can be specifically referred to fig. 2a, and fig. 2a is a patent query result display page diagram.
In one possible implementation, the method further includes determining whether the first business information and the second business information have a patent transfer relationship by: judging whether patent information of a first patent exists in a plurality of pieces of patent information included in the first enterprise information, wherein the first patent is a patent related to patent transfer; if the patent information of the first patent exists in the plurality of pieces of patent information included in the first enterprise information, confirming that the patent information of the first patent relates to a patent transfer relationship; and acquiring second enterprise information corresponding to the second patent, wherein the second patent corresponds to the patent related to the patent transfer for the first patent so as to confirm the second enterprise information in the patent transfer relation with the first enterprise information.
Specifically, this step is taken as an example of judging whether a patent transfer relationship exists between an enterprise and a user input enterprise; the specific judgment mode is to traverse the patent map corresponding to the enterprise input by the user, and find out whether the patent transferred to other enterprises by the user input enterprise or the patent transferred to the user input enterprise exists in the patent map through the transfer field; if the business information can be found, two businesses related to the transfer relationship are confirmed, and business information is acquired, namely, the two businesses have patent transfer relationship.
In the example above, the server traversed graph a, retrieving company C assigned patent C to company a. Obtaining the enterprise information of the patent C, namely the company C, and obtaining that the company a and the company C have a patent transfer relationship in the map a.
