The terminology used herein is for the purpose of describing particular embodiments only and is not intended to be limiting of the application.
The intellectual property right early warning method and system of the invention are a technology applying big data, which stores intellectual property right information resources on a memory and allows external users to search the information resources through a graphical retrieval interface and process the information resources.
Fig. 1 is a flowchart of a method of an intellectual property right warning method according to an embodiment of the present invention, and as shown in fig. 1, the intellectual property right warning method according to the embodiment includes the following steps:
s100, patent early warning, monitoring the technical field concerned by the user, and realizing technical increment early warning, patent increment early warning, legal state early warning, competitor early warning and patent payment early warning.
And S200, trademark early warning, namely monitoring a newly registered enterprise trademark to provide infringement early warning, and performing similar early warning and overdue early warning on the trademark set by the user.
Fig. 2 is a flowchart of a patent pre-warning method according to an embodiment of the present invention, and as shown in fig. 2, the patent pre-warning method includes the following steps:
and S110, carrying out technology increment early warning.
The technology increment early warning is used for establishing patent early warning and legal state early warning in the technical field concerned by the user.
Specifically, a user needs to determine a concerned technical field first, and establishes a patent target library according to a result set obtained by searching through constructing a related search formula of the current technical field. And regularly monitoring the patent target library, counting and reporting newly added patents in the technical field, and counting and reporting patents with changed legal states in the patent target library.
And S120, carrying out patent increment early warning.
The patent increment early warning is used for establishing the patent increment early warning for the technical field concerned by the user.
Specifically, a user firstly sets a concerned technical field, a related retrieval formula of the current technical field is constructed, a result set obtained by retrieval is used as a monitored patent special question bank, and patent increment early warning is set. And (4) carrying out statistics and reporting on newly added patents in the patent special topic library through the constructed retrieval formula for the patent increment early warning.
After the patent topic database is constructed, the system reports the conditions of the patent topic database, such as the total amount of patents, the patent overview and the like, for the first time. The subsequent system will periodically scan the patent library, and if there is a hit in the incremental patent, it will report the hit condition, including the hit time, the hit number, and the hit patent overview. The user can click the overview to check the details of the hit patent and inform the hit condition to the user in the form of mails, short messages and the like.
And S130, early warning of legal state.
The legal state early warning is used for establishing the legal state early warning for the technical field concerned by the user.
Specifically, according to the constructed patent subject database, the system reports the current legal state conditions of the patents in the subject database for the first time, including the current legal state, the legal state announcement date, the early warning time, the legal state overview and the like. And subsequently, the patent base is regularly scanned, if the legal state of the patent changes, the legal state is reported, and the reported information is reported for the first time. Except for system reporting, the system can inform the user of the legal state early warning condition in the forms of mails, short messages and the like.
And S140, early warning of competitors.
Specifically, the competitor early warning carries out patent increment early warning on the concerned competitor. The method comprises the steps that a user firstly determines a concerned competitor, searches the competitor according to a search algorithm to generate a patent subject database, sets patent increment early warning in the subject database, periodically monitors newly added patents of the competitor, and reports newly added conditions including newly added quantity, early warning time, patent overview and the like once the newly added patents are hit.
In addition, the user can check the details of the newly added patent by clicking the patent overview. Meanwhile, the system can inform the user of the hit condition in the forms of mails, short messages and the like.
And S150, patent payment early warning.
Specifically, patent payment early warning monitoring is realized through user-defined setting. And the user selects a patent which needs to be monitored, and incorporates the retrieval result into a monitored target patent library. After the user determines the patent to be monitored, the patent payment early warning function is triggered, the system can monitor regularly, and once the patent to be paid in the target patent library is found, payment information is reported.
In one embodiment, the setting of the payment early warning function further comprises setting a payment tolerance period. The calculation is carried out according to the difference between the payment due date of the current patent and the application date of the patent, and if the difference is less than the tolerance period, the current patent is regarded as the patent to be paid.
The reported payment information comprises information such as a patent application number, a patent application date, a payment due date, a fee type, early warning time and the like, and the user is informed of payment early warning conditions in the forms of mails, short messages and the like.
Fig. 3 is a flowchart of a trademark pre-warning method according to an embodiment of the present invention, and as shown in fig. 3, the trademark pre-warning method includes the following steps:
and S210, early warning of trademark infringement of the newly registered enterprise.
The early warning of the piracy of the newly registered enterprise trademark is only opened to a specific user or a related functional department. Specifically, a market subject library and a trademark library are first constructed and periodically updated, the market subject library is used for storing newly registered enterprise information, and the trademark library is used for storing specific trademark information. In the process of establishing the trademark library, the system can utilize the word segmentation technology of an open source search engine elastic-search to perform lexical processing on the trademark name, and an inverted index is established according to the segmented terms, so that the efficiency of fuzzy retrieval is improved; when the data of the trademark base library is updated, the inverted index is updated again.
When the system regularly synchronizes the main body data of the newly registered enterprise, the data in the trademark database are matched in a fuzzy manner according to the name of the enterprise, and once the data are hit, the suspected trademark infringement is reported to the administrative district administrator user. The infringement information includes: and the suspected trademark infringing enterprise information, the suspected infringed trademark name and the like are simultaneously informed to the user in the forms of mails, short messages and the like so as to be conveniently consulted by the user in time.
And S220, early warning similar trademarks.
Specifically, the system firstly establishes a monitoring target library, supports a user to set a certain trademark as a similar trademark monitoring object, and brings the trademark into the monitoring target library. The user can manage the monitored object at any time and support the operations of adding, deleting and the like.
In one embodiment, the similar trademarks are determined by fuzzy matching, for example, if the trademark name of a certain trademark hits the trademark data in the target library by fuzzy matching, it is considered as a similar trademark.
In addition, the system can periodically synchronize the newly registered trademark to be inserted into the trademark base library, and if the newly registered trademark is a similar trademark, the system can report an early warning message to the target monitoring user. The early warning information content comprises the following steps: target trademark name, suspected infringement trademark information and the like, and meanwhile, the system can inform the early warning condition to the user in the forms of mails, short messages and the like.
And S230, early warning of expired trademarks.
Specifically, the system supports the user to set the designated trademark as an expired trademark monitoring object, and the system brings the designated trademark into an expired trademark monitoring target library. The user can manage the own monitoring object and support the addition, deletion and the like of the monitoring object.
In one embodiment, in the expired trademark judgment process, the user can firstly define the tolerance period. The system calculates according to the difference between the scanning day and the registration day, and if the difference is less than the tolerance period, the system is regarded as an expired trademark.
In addition, the system can regularly scan the data in the monitoring target library, and once the expired trademark is found, the early warning information is reported, wherein the reported information comprises the following steps: registration number, trademark name, registration date, early warning date and the like, and simultaneously informs the user of the early warning condition in the forms of mails, short messages and the like.
