Example 1
In order to solve the problems that the monitoring of the current patent is inconvenient, the patent of the user is invalid and the patent of a competitor is not dynamically understood, the embodiment provides a patent monitoring and early warning method, the user monitors the patent of an authentication object by performing authentication on a patent monitoring and early warning platform, the authentication object is a patent applicant or a patentee, the tedious process of monitoring the patent by a form utilized by an enterprise or an office is improved, the loss of patent right and patent application right caused by misoperation is avoided, and meanwhile, the user can better master the patent layout condition of the competitor and the partner.
The patent monitoring and early warning method is realized based on a webpage developed by a Personal Computer (PC) end or an applet developed by an application program (APP) based on a mobile phone or a tablet.
Referring to fig. 1, fig. 1 is a schematic flow chart of a patent monitoring and early warning method provided in this embodiment, and the method mainly includes the following steps:
s101, the user completes authentication on a patent monitoring and early warning platform, and the authentication object is a patent applicant or a patentee.
And the patent monitoring and early warning platform judges whether the authentication is passed or not, and prompts re-authentication if the authentication is not passed. In this embodiment, the user may perform authentication for an individual or an enterprise in the patent monitoring and early warning platform, including enterprise authentication and personal authentication. The authentication information included in the enterprise authentication is at least one of an enterprise name and a unified social credit code, a contact person and a contact phone, and the authentication information included in the personal authentication is a name and optionally can also include a contact phone. That is, the business authentication information must contain the business name and the personal authentication must include the personal name.
S102, receiving an external authentication instruction, automatically acquiring a patent of an authentication object in an original patent database based on the external authentication instruction, and obtaining a first patent data packet, wherein the first patent data packet comprises all patents taking the authentication object as an applicant or a patentee.
During execution of the authentication instruction, a first inquiry message is generated to determine whether the patent to be authenticated is a self-owned patent. Acquiring a first operation instruction of the first inquiry message from the outside, and executing whether to define the patent of the authentication object as the owned patent or not based on the first operation instruction.
The first inquiry message includes a determination and cancel button, and the performing whether to define the patent of the authentication object as the own patent based on the first operation instruction includes:
when the first operation instruction is the operation of clicking the determined button, defining the patent of the authentication object as the owned patent is executed; when the first operation instruction is an operation of clicking a cancel button, the definition of the patent of the authentication object as an own patent is cancelled, namely the definition of the patent of the authentication object as an external monitoring patent is cancelled.
S103, when the original patent database has new patents, matching the new patents with the authentication objects, if the matching is successful, adding the new patents into a first patent data packet to obtain a second patent data packet, and then pushing a first reminding message, wherein the first reminding message comprises information of the new patents, and the second patent data packet comprises all patents of which the authentication objects are taken as applicants or patentees.
The matching process of the newly added patent and the authentication object comprises the steps of comparing the applicant or the patentee of the newly added patent with the authentication object, if the applicant or the patentee of the newly added patent contains the authentication object, the matching is determined to be successful, and if the applicant or the patentee of the newly added patent does not contain the authentication object, the matching is determined to be unsuccessful.
In this embodiment, the information of the newly added patent is pushed to the user, and at least part of the information of the newly added patent is displayed, so that the user can conveniently know the application condition of the own patent and the layout condition of the competitor patent in time, and can timely perform patent monitoring and early warning work. The user receives the patent layout situation of the competitor at the first time, and knows the development dynamics of the competitor product. When a user is interested in a patent, the user clicks to check the patent to further know the detailed information of the patent.
After step S102 or S103 is completed, setting requirements according to patent official fees and legal states to determine whether to monitor at least one operation of the patent official fees and the legal states of the patents in the first patent data packet or the second patent data packet; alternatively, the first and second electrodes may be,
and directly monitoring at least one of official patent fee and legal state of the patents in the first patent data packet and the second patent data packet.
According to different requirements of users, different monitoring modes are set for patents of different applicants in a self-defined manner. For example, if the patent in the first patent data packet or the second patent data packet is a self-owned patent, the official fee and the legal state of the patent are directly monitored at the same time by default without being set by a user; if the patent in the first patent data packet or the second patent data packet is not the own patent, generating a second inquiry message, acquiring a second operation instruction of the second inquiry message from the outside, and executing whether to monitor the official expense and the legal state of the patent in the first patent data packet or the second patent data packet based on the second operation instruction. If the patent in the first patent data packet or the second patent data packet is not a self-owned patent, monitoring of the official expense of the patent is cancelled, monitoring of the legal state is determined, or monitoring of both the official expense of the patent and the legal state is cancelled. The user can select whether to monitor patent official expenses and legal states by oneself, and this embodiment does not do the restriction to this, can select according to the control demand is nimble.
In this embodiment, a single patent may be operated, or a plurality of patents may be operated simultaneously to monitor patent official fees and legal states. Optionally, the same patent applicant or the patentee can be set after authentication, different monitoring modes are defined according to whether the patent of the authentication object is the own patent, and if the patent of the authentication object is the own patent, the official charge and the legal state of the patent are set to be monitored, so that the patent of the authentication object defaults to directly monitor the official charge and the legal state of the patent without independently setting the monitoring mode for each patent; if the patent is not a self-owned patent, the legal state is determined to be monitoring, and the monitoring of the official expense of the patent is cancelled, so that the patent to be authenticated is monitored by default according to a set mode, and a monitoring mode does not need to be set for each patent independently.
In other embodiments of the present invention, after the new patent is successfully matched with the authentication object, a third inquiry message is generated at least partially for the new patent to determine whether to add the new patent to the second patent data packet. If the patent is owned, adding the newly added patent to the first patent data packet; if the new patent is not the own patent, the new patent is displayed, and a third inquiry message is generated to determine whether to add the new patent to the second patent data packet. If the newly added patents of competitors or partners are different from the product types of own patents and do not need to be monitored, the newly added patents are not added into the first patent data packet, and unnecessary workload of patent monitoring is reduced.
In at least one of steps S102 to S103, a supplementary patent based on the subject of authentication as the applicant or the patentee is added. In the patent monitoring process, a user can add a supplementary patent taking an authentication object as an applicant or a patentee in the patent monitoring early warning platform at any time. Before adding the supplementary patent, matching the applicant or the patentee of the patent to be supplemented with the authentication object, and determining whether to add the patent to be supplemented as the supplementary patent to the first patent data packet or the second patent data packet based on the matching result, wherein the steps comprise: matching the applicant or the patentee of the patent to be supplemented with the authentication object, adding the successfully matched patent to be supplemented as a supplementary patent to the first patent data packet or the second patent data packet, if the matching is unsuccessful, generating a prompt message, and checking whether the input keyword is correct. If the applicant or the patentee of the supplementary patent includes the authentication object, the matching is considered to be successful. In the process of adding the patent to be supplemented, at least one of a plurality of keywords may be input for matching, where the keyword includes, but is not limited to, an applicant, a patent owner, a patent name, an application number, and the like, and this embodiment does not limit this. The patent to be added which is not matched successfully cannot be added to the first patent data packet or the second patent data packet. The condition that the matching is unsuccessful includes that the keyword input is wrong, for example, the digit number input by the application number is incorrect, the applicant or the patentee of the patent to be supplemented does not contain the authentication object, and the like, and different prompt messages are generated according to the input of different keywords. In order to avoid the problem that patent monitoring and early warning are incomplete due to incomplete patent data in the original database, the supplementary patent can perfect and supplement the monitored patent.
