Abstract
The invention discloses a method for generating a contract file, which comprises the following steps: acquiring first identification information of a contract initiator and a corresponding electronic contract; acquiring a first digital certificate from a third party authority according to the first identification information; digitally signing the electronic contract by adopting a first digital certificate to obtain a first signed file; sending the first signed file to a third party authority, and receiving a second signed file returned by the third party authority after digital signing based on the first signed file; sending the second signed document to the contract responder and receiving a third signed document returned by the contract responder after digital signature based on the second signed document; a final contract is formed from the third signed document. The invention also discloses a file generation device, contract file generation equipment and a readable storage medium. The invention reduces the butt joint between the signer of the electronic contract and the third party authority, and simultaneously ensures the legal effectiveness of the electronic contract.
Description
Technical Field
The present invention relates to the field of network security, and more particularly, to a method and apparatus for generating a contract document, a device for generating a contract document, and a readable storage medium.
Background
With the development of internet technology, electronic contracts are widely used due to the advantages of high efficiency, order, high safety and the like. All parties signing the electronic contract at present need to apply for a digital certificate to a digital certificate management organization in advance so as to sign when the electronic contract is signed, and the electronic contract is required to be provided to the digital certificate management organization to notarize the content of the electronic contract in the process of signing the electronic contract so as to ensure that the electronic contract has legal efficacy.

acquiring a first digital certificate from a third party authority according to the first identification information;
digitally signing the electronic contract by adopting the first digital certificate to obtain a first signed file;
sending the first signed file to the third party authority and receiving a second signed file returned by the third party authority after digital signing based on the first signed file;
sending the second signed document to a contract responder and receiving a third signed document fed back by the contract responder after digital signature is carried out on the basis of the second signed document;
and forming a final contract between the contract initiator and the contract responder according to the third signed file.
Optionally, the step of obtaining the first identification information of the contract initiator and the corresponding electronic contract includes:
acquiring first identification information of the contract initiator;
determining the contract response party and a corresponding loan approval result according to the first identification information;
acquiring a contract template corresponding to the contract responding party;
and generating the electronic contract according to the contract template and the loan approval result.

The main solutions of the embodiments of the present invention are: acquiring first identification information of a contract initiator and a corresponding electronic contract; acquiring a first digital certificate from a third party authority according to the first identification information; digitally signing the electronic contract by adopting a first digital certificate to obtain a first signed file; sending the first signed file to a third party authority, and receiving a second signed file returned by the third party authority after digital signing based on the first signed file; sending the second signed document to a contract responder and receiving a third signed document returned by the contract responder after digital signature is carried out on the basis of the second signed document; a final contract between the contract sponsor and the contract responder is formed from the third signed file.
Because the prior art integrates the generation device of the files of the financial products of different financial institutions, when a user agrees with the financial institutions to sign an electronic combination, the process is complicated, so that the development cost and the butt joint cost of all parties of the electronic combination are higher.
The invention provides the solution, and reduces the butt joint between the signing party of the electronic contract and the third party authority, simplifies the signing process of the electronic contract and reduces the development cost and the butt joint cost of the signing of the electronic contract while forming an effective evidence chain.
The embodiment of the invention provides a method for generating a contract file, as shown in fig. 1, which comprises the following steps:

After the third party authority receives the notarization request, identifying whether second preset information exists, if so, extracting a first signed file in the notarization request, digitally signing the first signed file by using a private key of the third party authority, and generating a third password sequence, wherein the third password sequence and the first signed file form a second signed file.
Step S50, the second signed document is sent to a contract responder, and a third signed document returned by the contract responder after digital signature is carried out on the basis of the second signed document is received;
the file generating device sends the second signed file to the contract responder after receiving the second signed file returned by the third party authority. Wherein the contract responder may make a determination based on the first criteria identification information of the contract initiator. And after the contract initiator applies for the loan and the provider of the loan product passes the verification, the provider of the loan product is associated with the first standard identification information of the contract initiator, and the provider of the loan product is used as a contract responder.

Specifically, the public key is adopted to carry out hash calculation on the electronic contract containing the first identification information in the third signed file to obtain a second password sequence, the first password sequence and the second password are compared to see whether the first password sequence and the second password are consistent, if the first password sequence and the second password sequence are consistent, the first password sequence on the third signed file passes verification, and the final contract can be formed according to the third signed file.
Through the mode, the verification of the first password sequence in the third signed file is beneficial to avoiding modification of the electronic contract in the transmission and signing processes, so that the effectiveness of the electronic contract is ensured, and the interests of all parties signing the electronic contract are ensured.
Further, as shown in fig. 6, when the first password sequence is consistent with the second password sequence, before the step of forming a final contract between the contract initiator and the contract responder according to the third signed file, the method further includes:
step S531, identifying a second characteristic field in the third signed file;
step S532, extracting second identification information of the contract responder in a second target area corresponding to the second characteristic field;
step S533, second standard identification information corresponding to the contract response party is obtained;
step S534, comparing whether the second identification information is consistent with the second standard identification information;
and step S535, if the comparison results are consistent, executing the step of forming a final contract between the contract initiator and the contract responder according to the third signed file.
When the contract responder digitally signs the second signed document, the second identification information of the contract responder may be added to the second signed document in the same manner as the first identification information of the contract initiator is added, and then the second signed document containing the second identification information is digitally signed to obtain a third signed document.
A financial institution (i.e., potential contract responder) that cooperates with the document's generation means to provide financial products may provide its identifying information (e.g., official seal patterns, institution names, etc.) to the document's generation means. The file generating means stores identification information of different financial institutions in association with the financial institutions to form second standard identification information. When the file generating device receives the third signed file, the second identification information of the contract responding party can be extracted from the third signed file, the second standard identification information is obtained and compared with the second identification information, and when the comparison result is consistent, a final contract is formed according to the third signed file. By the mode, the validity of the signed electronic contract can be traced back through various verifications.
Specifically, as shown in fig. 7, the step of forming a final contract between the contract initiator and the contract responder according to the third signed file includes:
step S61, obtaining a second digital certificate of a generation device of a document providing a contract signing service for the contract initiator and the contract responder;
step S62, carrying out digital signature on the third signed file by adopting the second digital certificate to obtain a fourth signed file;
and step S63, generating a PDF file from the fourth signed file to form a final contract between the contract initiator and the contract responder.
The file generation device itself may also claim a digital certificate, i.e. the second digital certificate described above, to a third party authority. And carrying out digital signature on the third signed file by adopting a private key in the second digital certificate to obtain a fourth signed file, wherein the fourth signed file can be stored after generating a PDF file as a final contract signed between the contract initiator and the contract responder.
The signature of the file generating device can provide notarization of the signed electronic contract between the contract initiator and the contract responder, so that the validity of the electronic contract is ensured; further, since the generation apparatus of the document serves as an intermediary for connecting the contract initiator and the contract responder, terms related to the generation apparatus of the document may be added to the electronic contract to ensure the validity of the electronic contract.
In addition, the embodiment of the invention also provides a file generating device, which comprises:
the user information acquisition module is used for acquiring the first identification information of the contract initiator and the corresponding electronic contract;
the certificate claim module is used for acquiring a first digital certificate from a third party authority according to the first identification information;
the signing module is used for digitally signing the electronic contract by adopting the first digital certificate to obtain a first signed file;
the first transmission module is used for sending the first signed file to the third party authority and receiving a second signed file returned by the third party authority after digital signing based on the first signed file;
the second transmission module is used for sending the second signed document to a contract responder and receiving a third signed document returned by the contract responder after digital signature is carried out on the basis of the second signed document;
and the contract generation module is used for forming a final contract between the contract initiator and the contract responder according to the third signed file.
The specific implementation manner of each module in the file generating device of the present invention is basically the same as each embodiment of the contract file generating method, and will not be described herein.
In addition, as shown in fig. 8, the embodiment of the present invention further proposes a contract document generation apparatus, where the contract document generation apparatus includes: a processor 1001, such as a CPU, a network interface 1002, a user interface 1003, a memory 1004, a communication bus. Wherein the communication bus is used to enable connection communication between these components. The user interface 1003 may include a Display, an input unit such as a Keyboard (Keyboard), and the optional user interface 1003 may further include a standard wired interface, a wireless interface. The network interface 1002 may optionally include a standard wired interface, a wireless interface (e.g., WI-FI interface). The memory 1004 may be a high-speed RAM memory or a stable memory (non-volatile memory), such as a disk memory. The memory 1004 may also optionally be a storage device separate from the processor 1001 described above.
It will be appreciated by those skilled in the art that the device structure shown in fig. 8 is not limiting of the device and may include more or fewer components than shown, or may combine certain components, or a different arrangement of components.
As shown in fig. 8, an operating system, a network communication module, a user interface module, and a contract file generation program may be included in the memory 1004, which is one type of computer storage medium.
In the device shown in fig. 8, the network interface 1002 is mainly used for connecting to a background server, and is in data communication with the background server; the user interface 1003 is mainly used for connecting a client (user side) and performing data communication with the client; and the processor 1001 may be used to call the contract document generation program stored in the memory 1004 and perform the relevant operations of the steps in the above contract document generation method
The specific implementation manner of the contract file generating device of the present invention is basically the same as the above embodiments of the contract file generating method, and will not be described herein.
Further, the embodiment of the present invention also proposes a readable storage medium having stored thereon a generation program of a contract file, which when executed by a processor, implements the steps of the generation method of a contract file as mentioned in the above embodiment.
The specific implementation manner of the readable storage medium of the present invention is basically the same as the above embodiments of the contract file generation method, and will not be described herein.
It should be noted that, in this document, the terms "comprises," "comprising," or any other variation thereof, are intended to cover a non-exclusive inclusion, such that a process, method, article, or system that comprises a list of elements does not include only those elements but may include other elements not expressly listed or inherent to such process, method, article, or system. Without further limitation, an element defined by the phrase "comprising one … …" does not exclude the presence of other like elements in a process, method, article, or system that comprises the element.

From the above description of the embodiments, it will be clear to those skilled in the art that the above-described embodiment method may be implemented by means of software plus a necessary general hardware platform, but of course may also be implemented by means of hardware, but in many cases the former is a preferred embodiment. Based on such understanding, the technical solution of the present invention may be embodied essentially or in a part contributing to the prior art in the form of a software product stored in a storage medium (e.g. ROM/RAM, magnetic disk, optical disk) as described above, comprising instructions for causing a terminal device (which may be a mobile phone, a computer, a server, an air conditioner, or a network device, etc.) to perform the method according to the embodiments of the present invention.

Claims (10)
1. The contract file generation method is characterized by comprising the following steps of:
acquiring first identification information of a contract initiator and a corresponding electronic contract;
acquiring a first digital certificate from a third party authority according to the first identification information;
digitally signing the electronic contract by adopting the first digital certificate to obtain a first signed file;
sending the first signed file to the third party authority and receiving a second signed file returned by the third party authority after digital signing based on the first signed file;
sending the second signed document to a contract responder and receiving a third signed document returned by the contract responder after digital signature is carried out on the basis of the second signed document;
forming a final contract between the contract initiator and the contract responder according to the third signed file;
the step of receiving a second signed document returned by the third party authority after digital signing based on the first signed document comprises:
forming a notarization request according to the first signed file and second preset information and sending the notarization request to the third party authority, wherein the third party authority is used for identifying whether the notarization request has the second preset information, if yes, extracting the first signed file in the notarization request, digitally signing the first signed file by using a private key of the first signed file to generate a third password sequence, and generating a second signed file according to the third password sequence and the first signed file;
and receiving a second signed file returned by the third party authority.
2. The method for generating a contract document according to claim 1, wherein the step of acquiring the first identification information of the contract initiator and the corresponding electronic contract thereof includes:
acquiring first identification information of the contract initiator;
determining the contract response party and a corresponding loan approval result according to the first identification information;
acquiring a contract template corresponding to the contract responding party;
and generating the electronic contract according to the contract template and the loan approval result.
3. The method for generating a contract document according to claim 2, wherein after the step of acquiring the first identification information of the contract initiator and the corresponding electronic contract thereof, the method further comprises:
acquiring the identity of the contract initiator;
acquiring corresponding first standard identification information according to the identity of the contract initiator;
comparing whether the first identification information is consistent with the first standard identification information;
and if the comparison results are consistent, executing the step of determining the contract response party and the corresponding loan approval result according to the first identification information.
4. The method of claim 3, wherein the step of digitally signing the electronic contract using the first digital certificate to obtain a first signed document comprises:
identifying a first feature field in the electronic contract;
adding the first identification information to a first target area corresponding to the first characteristic field;
carrying out hash calculation on the electronic contract containing the first identification information by adopting a private key in the first digital certificate to obtain a first password sequence;
and adding the first password sequence to the electronic contract containing the first identification information to obtain the first signed file.
5. The method of claim 4, wherein prior to the step of forming a final contract between the contract initiator and contract responder based on the third signed file, further comprising:
obtaining a public key paired with the private key;
carrying out hash calculation on the electronic contract containing the first identification information in the third signed file by adopting the public key to obtain a second password sequence;
comparing whether the first code sequence is consistent with the second code sequence;
when the first and second sequences of passwords agree, a step of forming a final contract between the contract initiator and contract responder from the third signed file is performed.
6. The method of claim 5, wherein when the first cryptographic sequence is consistent with the second cryptographic sequence, the step of forming a final contract between the contract initiator and the contract responder from the third signed file is preceded by the step of:
identifying a second feature field in the third signed file;
extracting second identification information of the contract responder in a second target area corresponding to the second characteristic field;
acquiring second standard identification information corresponding to the contract response party;
comparing whether the second identification information is consistent with the second standard identification information;
and if the comparison results are consistent, executing the step of forming a final contract between the contract initiator and the contract responder according to the third signed file.
7. The method of generating a contract document according to claim 6, wherein the step of forming a final contract between the contract initiator and a contract responder from the third signed document includes:
obtaining a second digital certificate of a generating device of a document providing contract signing services for the contract initiator and the contract responder;
digitally signing the third signed document with the second digital certificate to obtain a fourth signed document;
and generating a PDF file from the fourth signed file to form a final contract between the contract initiator and the contract responder.
8. A document generation apparatus, characterized in that the document generation apparatus includes:
the user information acquisition module is used for acquiring the first identification information of the contract initiator and the corresponding electronic contract;
the certificate claim module is used for acquiring a first digital certificate from a third party authority according to the first identification information;
the signing module is used for digitally signing the electronic contract by adopting the first digital certificate to obtain a first signed file;
the first transmission module is used for sending the first signed file to the third party authority and receiving a second signed file returned by the third party authority after digital signing based on the first signed file;
the second transmission module is used for sending the second signed document to a contract responder and receiving a third signed document returned by the contract responder after digital signature is carried out on the basis of the second signed document;
the contract generation module is used for forming a final contract between the contract initiator and the contract responder according to the third signed file;
the first transmission module is further configured to form a notarization request according to the first signed file and second preset information, and send the notarization request to the third party authority, where the third party authority is configured to identify whether the notarization request has the second preset information, if yes, extract the first signed file in the notarization request, digitally sign the first signed file by using a private key of the first transmission module to generate a third password sequence, and generate a second signed file according to the third password sequence and the first signed file; and receiving a second signed file returned by the third party authority.
9. A contract document generation apparatus, characterized in that the contract document generation apparatus includes: a memory, a processor, and a contract document generation program stored on the memory and executable on the processor, which when executed by the processor, implements the steps of the contract document generation method according to any one of claims 1 to 7.
10. A readable storage medium, wherein a contract document generation program is stored on the readable storage medium, which when executed by a processor, implements the steps of the contract document generation method according to any one of claims 1 to 7.
