Abstract

Escrow Electronic Commerce Process adds new methods to standard electronic commerce (e-commerce) processes. In standard electronic commerce a customer "visits" a merchant's web site and selects items to purchase, selects a shiping method, then enters their credit card payment identification numbers and selects a "submit"
button to send this information to the merchant's sever computer, usually the selecting of the "submit" button causes a Secure Socket Layer (SSL) to open between the customer's computer and the merchants server computer, encrypts the data string and sends it to the merchants server compute where the Credit Card information is verified and if "approved" then the order is processed as the merchant has the custom's funds via their merchant credit card bank account. A problem has arisen, mainly with small businesses, that some merchants have kept the customer's money and have not shipped the product, or have shipped the product and the shipment has not arrived at the customer's address. Also, the merchant has access to the customer's credit card information. Since electronic commerce is suitable for transactions between a customer and a merchant, who are unknown, to each other and at great distances from each other, the customer's fear that products ordered and paid for may not be shipped and their concern over giving credit card information to numerous merchants has resulted in loss of customs confidence in doing electronic commerce, particularly with small businesses. The escrow electronic commerce process adds new methods and modifies the standard electronic commerce process to ensure that the funds are not obtainable by the merchant until the customer has received the shipment by interjecting a third party, called the Escrow Agent who is a "certified credit card processor" into the standard electronic commerce process such that the credit card information is processed by the Escrow Agent and if "approved" then the Escrow Agent "holds" the funds and notifies the merchant that a specific customer has made an order for specific product(s) products to be delivered to a specific address and that the funds have been verified and are being "held' for the merchant pending shipment of the goods to the customer, when the shipment has been verified the Escrow Agent releases the funds to the merchant. Finally, when the order transaction is complete the Escrow Agent destroys the custom's credit card information so the customer's concern for credit card security is removed.

The Escrow Electronic Commence Process ensures that the customer's funds are not obtainable by the merchant until the customer has received tl~ shipment by interjecting a third party, called the Escrow Agent into the standard Elec-tronic commerce process such that the credit card information is processed by the Escrow Agent and if "approved" then the Escrow Agent "holds" the funds and notifies the merchant that a speck customs has made an order for specific products, to be delivered to a specific address and that the funds have been verified and are being "held' for the merchant pending shipment of the goods to the customer, when the shipment has been verified the Escrow Agent releases the funds to the merchant.
The parties to the Escrow Electronic Commerce Process are:
the Escrow Agent who is a certified credit card processor working directly with credit card companies and banks;
the Merchant who has goods and/or services to sell via electronic commerce over the Internet usually with a web site;
the Customer, who is a business or a person wishing to purchase the goods and/or services of the merchant.
The Escrow Electronic Commerce Process describes a way that the customer can purchase goods and/or services from the merchant that will give the customer greater security over who has access to their credit card information (includ-ing future PIN and passwords), what happens to this information, and greater security over the actual delivery of the items ordered than is common with ezisting "non-escrow" electronic commerce processes.
The customer "visits" the merchant's web site and selects the "Order Form Link" 3. The "Order Form Link" is put on the raerchant's web site by the merchant after generating it in the "Escrow Electronic Commerce Order Form Maker" 1 program. The putting of the "Order Form Link" can be done manually by adding the required HTML code to the merchant's web site or it can be done automatically if the Merchant is using a web site generator program that has integrated the "Escmw Electronic Commerce Order Form Maker" to it.
This request, resulting from selecting the special "Order Form Link" submit actin opens a "Secure Socket Layer"
(SSL) 4 between the Customer and the "Escxow Agent's Secure Web Server Computer", and sends the coded informa-tion on the "Order Form Link" to a "Re-Direct" 5 program which is activated by this code.
The "Re-Direct" program finds the Merchants Universal Resourrx Locator Address (URL) by comparing the submitted information with the information in the "Merchant Lookup Table". This "Merchant Lookup Table", is created (or added to) when the merchant obtains their Merchant's Certified Escrow Agent Identification Number. Once the Re-Direct program finds the URL it sends a request to that address which is to a specifrc directory inside the merchant's web site on the me'rchant's Web Hosting Server and retrieves the merchant's most recent Escrow Electronic Commerce Order Form.
The Mire Escrow Electronic Commerce Order Form made by the merchant using the 'Escrow Electronic Commerce Order Form Maker" program is returned to the "Escrow Agent's Secure Web Server Computer". The Escrow Elec-tronic Commerce Order Form includes:
- security, - bonefides, - complete product information in a catalog format including images and tent descripti~s, - prooduct ordering entry form, - shipping selections entry form, - fazes and discounts automatically calculated, - summary automatically calculated, - credit card payment entry form , - password protection for Members Discounts, - information about privacy, - information about escrow e-commerce, - other relevant Information files, - opportunity to enter special instructions, - opportunity to send e-mail messages directly to the Merchant.

DISCLOSURE

When the Escrow Electronic Commerce Order Form has arrived at the Escrow Agent's Secure Web Server computer a special unique Order Number 6 is generated and appec>ded to the Escrow Electronic Commerce Order Form and then this Mod~ed Escrow Electronic Commerce Onier Form is sent to the Customer 7 in the SSL.
The Order Number is a unique number, in this instance it is made up of the date, the Merchant's Certified Escrow Agent Identification Number and the number of this order for that particular merchant for that particular day It is an important reference number used to Identify this part~ular order.
The customer now has the complete Mod~ed Escrow Electronic Commerce Order Form, with a unique Order Number 19, via a SSL, and the customer begins the decision maidng process of filling out the Order Form 8 by selecting links to view summary descriptions of products or detailed product descriptions including images and tent, of reading requested information and finally selecting products to indicate which ones and how many are to be purchased.
The customs can then select shipping methods from those listed and enter in their credit card payment information.
The customs may also enter a password if the the "Members Discount Club" has been created by the merchant when they created or updated this Escrow Electronic Commemx Order Fonm to obtain discounted prices.
The Customer can access the various information files and enter "Special Instructions" and/or send an e-mail message directly from the Escrow Electronic Commerce Order Form to the merchant.
When the "Modified Escrow Electronic Commerce Order Form" is completed to the custmners satisfaction then they click the "submit" button" 9, when this is done a message appears requesting the Customer to either print the entire order by clicking the "print" butts or to, at least, copy down the Order Form's Order Number which is prominantely displayed at this point.
This "submit" button request, causes the information enteaed into and selected on the Modified Escrow Electronic Commerce Order Form, to be encrypted and sent to the Escrow Agent's Secure Web Server computer where the data stream is automatically de-crypted and a check of this information is made for completeness 10, if any errors are found, a web page "Message" is displayed to the Customer informing them of the particular errors) and requesting they try to correct the problem and re-submit the "Modified Escrow Electronic Commerce Order Form".
When the submitted information passes the completeness review the "Credit Card Processor" 11 program then compiles the credit card information from the submitted data string and dials up the approyiate credit card processing number to process the credit card information for account authenticity and availability of funds. If the funds are available they are usually reserved by a credit card processing process known as "pre-authorization".
If the funds are not available or another problem is encountered with processing the Credit Card information a web page "Message" is displayed to the Customer informing them of the particular problem e~ountered. The range of problems usually encountered are mistakes in the entered Credit Card information a insufficient funds available to complete the request. A suggestion is made to the Customer that they may wish to use a different credit card if the one used does not have su~c~nt funds to meet the request 12.
If the credit card authorization transaction is successful then the "Credit Card Processor" program adds the credit card transaction number to the Order Number and enters the order form submit string to the order form submit string database. The rest of the order form submit 9 string, except for the customer's credit card information is sorted through to make up an "Certified Order Request" 15 which includes:
- the list of items ordered - their quantity, - their cost, - the shipping method and shipping address, including customer name, - the taxes and discounts if any, - the total amount of the order - any special instruction message, and, - a declaration that these funds are being "held" in escrow.

DISCLOSURE

This "Certified Order Rexltiest" 15 is sent to the Merchant via E-Mail from the Escrow Agent 16 and a true, complete copy of this Certified Order Request is also sent to the Customer via e-mail.
Note: the customer's credit card information, (including PIN and passwords in the future) are not passed onto the merchant and are held by the Escrow Agent only until this entire process is complete at which point this credit card information is destroyed by the Escrow Agent.
Upon receipt of the "Certified Order Reguest", the Merchant is required to ship the items to the customer before they can obtain the funds from the Escrow Agent according to the level of "Escrow Hold" 20 that the merchant has selected in the "Escrow Electronic Commerce Order Form Maker" program when they made up the "Escrow Electronic Com-merce Order Form".
The level of "Escrow Hold" 20 determines the conditions that the funds may be released from the Escrow Agent to the merchant. These 'Escrow Hold" conditions are prominantly published on the Escrow Electronic Commerce Order Form for the Customer to see. The "Escrow Hold" levels are: A or B.
Level A: 21 The funds are released by the Escrow Agent to the Merchant only after the Escrow Agent has received the "Shipping Dexlaration Affidavit" 17 from the merchant which includes:
- a statement by the Merchant that they have shipped the named products to the named customer at the named address according to the named order number via the named shipping way bill number, as follows:
- Customer's Name, - Customer's Address, - Products Shipped, - Or~r Number, - shipping companies Way Bill Number, and the Escrow Agent has e-mailed the "Shipping Declaration Affidavit" to the Custom Note: Level A 21 is the minimum level and must always be present for the Electronic Commerce Process to be designated "Escrow Electronic Commerce" or 'Escrow E-Commerrx".
Level B: 23 The funds are released by the Escrow Agent to the Merchant only after the Escrow Agent has received the "Shipping Declaration Affidavit" from the Merchant which includes:
- a statement by the Merchant that they have shipped the named products to the named customer at the named address according to the named order number via the named shipping way bill number, as follows:
- the Customer's Name, - Address, - Products Shipped, - Order Number, - the shipping companies Way Bill Number, and, - a Hold Funds Notice form, a Release of Hold Funds Notice form, and instructions on how to use these to put a hold on and how to take a hold off the merchant's funds that are being held in escrow, and the Escrow Agent has e-mailed this certificate to the Customer and the time period in the Specified Hours or Days has elapsed without the Hold Funds Notice being received by the Escrow Agent in the specified e-mail manner.
If a "Hold Funds Notice" 23 is placed by a Customer on a particular Order designated by the Order Number, then the merchant is required to 'rove" 26 to the Escxow Agent that the goods were received by the customer, (a copy of a signed shippers delivery notice is usually considered sufficient "proof 27, before the funds will be released from the Escrow Agent to the merchant.
After the funds have been transfered to the merchant 27 the Escrow Agent destroys all records of the transaction including the customer's credit card information except for the credit card company's transit reference number, the Order Number, and the total dollar amout of the order. This ensures that the customers credit card information is al~olutely secure, because it does not exist in the system.

DISCLOSURE

Finally the Escrow Agent sends a monthly order summary 28 to each merchant during the first week of the following month Although only a single embodiment of the Escrow Electronic Commerce Process has been described and illustrated, the present invention is not limited to the features of this embodiment, but includes all variations and modifications within the scope of the claims.

Claims (4)

  1. Claims THE EMBODIMENTS OF THE INVENTION IN WHICH AN EXCLUSIVE PROPERTY OR PRIVILEGE
    IS CLAIMED ARE
    DEFINED AS FOLLOWS:

    A method for escrow electronic commerce comprising the following steps in the sequence set forth:
    step a:
    a first computer program, called the order form maker program, that enables a merchant to enter data, make settings and compile the html and java script code that makes the escrow electronic commerce order form which the customer can view and interact with on their browser, requires the merchant to enter:
    a previously obtained identification number from an escrow agent as part of an escrow agent's certification process which includes:
    - demonstration by testing that the merchant can operate the order form maker program, - establishment of a merchant bank account in a bank approved by the escrow agent, - delivery to the escrow agent the merchant accounts bank transit numbers, the merchants web site universal resource locator address, the merchant's e-mail address, and, - a signed copy of the escrow electronic commerce contract of terms and conditions, and the order form maker program requires the merchant to enter the following data:
    a title for the order form;
    names of goods or services to be offered for sale;
    unique identification number for each good or service;
    retail and discount prices for each good or service;
    (optional) long description up to 1,000 words of each good or service;
    (optional) an image of each good or service;
    the weight in pounds or kilograms of each good or service (if relevant);
    the size in kilobytes or megabytes of each good or service (if relevant), and the order form maker program requires the merchant to select a shipping optic from the following:
    by electronic download shipping;
    by physical shipping;
    by both, electronic and physical shipping; and, if, by electronic download shipping is select, then the merchant may select:
    to charge a fee;
    to not charge a fee;
    w display a notice that no fee is charged for electronic download shipping;
    to display a notice showing the total file size that is being downloaded, and, if, to charge a fee is selected, then, the merchant may enter a number in united states dollars for the fee in a text box, if, to not charge a fee is select, then, the merchant does nothing more in this item, if, to display a notice that no fee is charged for electronic download shipping is selected, then, the merchant does nothing more in this item, if, to display a notice showing the total file size that is being downloaded, then, the merchant does nothing more in this item, if, by physical shipping is selected, then, the merchant does the following routine for as many different shipping methods as the merchant is offering to its customers:
    first, the merchant enters in a name for a shipping carrier and service type, second, the merchant selects a country and or state and or province from drop down lists, or, enters in a country name in a designated text box, and, third, selects either.
    pounds or kilograms to be the weight type that the shipping rate will be calculated upon, and, fourth enters a number representing the amount of united states dollars for the rate per pound (or kilogram, as selected above) that the customer will be charged for shipping to the destination the merchant has selected or entered above, if, by both, electronic and physical shipping, then, the merchant completes the electronic and physical shipping items as noted above for each of these options, and when the escrow electronic commerce order form is created by compiling it will give the customer the option to have the product(s) shipped by one or the other method or by both methods, this option is only available far products that can be shipped by downloading as determined by an entry in the kilobyte or megabyte item in the product information section;
    and the order form maker program requires the merchant to select a tax option from the following:
    - a, automatic tax calculation method;
    - b, standard tax calculation method;
    - c,do not make any tax calculations, a. if the automatic tax calculation method option is selected, then, the following options are available to be selected:
    - a-1, for state or provincial taxes;
    - a-2, for federal vat or gst taxes;
    - a-3, for other charges such as surtax or discount, a-1, if, for state or provincial taxes, option is selected, then, the merchant completes the displayed form as follows:
    - select country from the items in a drop down list;
    the choices are:
    -canada:
    - united states;
    - other, if canada, is selected, then, firstly:

    the province drop down list is populated with the names of the canadian provinces and territories, and, the merchant selects one of these for the tax to apply to, secondly:
    the merchant enters the percent amount of the provincial tax for the selected province or territory in a text box, thirdly;
    the merchant selects one of the following options to determine the condition that the tax will be calculated into a particular customers purchase amount:
    ~ always apply this tax, regardless of shipping or billing address;
    ~ only apply when customer billing address is in selected province;
    ~ only apply when shipping address is in selected province;
    ~ apply when billing or shipping address is in selected province;
    ~ never apply this tax, if any of these tax condition options are selected, then, the merchant does nothing more in this item, if, united states, is selected, then, firstly, two drop down boxes appear populated with the names of the states and territories in the united states, the first one is titled: select the first letter of the state you want, and lists the following otter sequences:
    ~ a to e;
    ~ f to j;
    ~ k to o;
    ~ p to t;
    ~ u to z.
    the second one is populated with the names of the states that begin with the letters in the selected sequence and is titled: select a state, and the merchant selects one of these for the tax to apply to, secondly, the merchant enters the percent amount of the state tax for the selected state or territory in a text box, thirdly.
    the merchant selects one of the following options to determine the condition that the tax will be calculated into a particular customers purchase amount:
    ~ always apply this tax, regardless of shipping or billing address;
    ~ only apply when customer billing address is in selected state;
    ~ only apply when shipping address is in selected state;
    ~ apply when billing or shipping address is in selected state;
    ~ never apply this tax, if any of these tax condition options are selected, then, the merchant does nothing more in this item, if, other, is selected, then, a message appears telling the merchant to please use the standard tax method as the automatic method is only set up for the countries of canada and the united states at this time, a-2, if, for federal vat or gst tax, option is selected, then, the merchant completes the displayed form as follows:
    - select country from the items in a drop down list;
    the choices are:

    - other, if, canada, is selected, then, firstly, the merchant enters the percent amount of the Canadian federal gst tax in a text box, secondly, the merchant selects one of the following options to determine the condition that the tax will be calculated into a particular customers purchase amount:
    - always apply this tax, regardless of shipping or billing address;
    - only apply when customer billing address is in selected country;
    - only apply when shipping address is in selected country;
    - apply when billing or shipping address is in selected country;
    - never apply this tax, if any of these tax condition options are selected, then, the merchant does nothing more in this item, if united states, is selected, then, firstly, the merchant enters in the percent amount of the united states federal vat tax in a text box, secondly.

    ~ only apply when shipping address is in selected country;
    ~ apply when billing or shipping address is in selected country;

    - do not give customer any right to hold funds after the shipping declaration affidavit has been sent to the escrow agent;
    - give customer the right to hold funds after the shipping declaration affidavit has been sent to the escrow agent for a period of days as selected, if, do not give customer any right to hold funds after the shipping declaration affidavit has been sent to the escrow agent, is selected, then the merchant does nothing more in this item if, give customer the right to hold funds after the shipping declaration affidavit has been sent to the escrow agent for a period of days as selected, is selected, then the merchant selects a time period from a drop down list as follows:
    - 1 day (24 hours);
    - 2 days (48 hours);
    - 3 days (72 hours);
    - 4 days (96 hours);
    - 5 days (120 hours);
    - 6 days ( 144 hours);
    - 1 week (168 hours);
    - 2 weeks (336 hours);
    - 3 weeks (504 hours), the relevance of this time period is explained in steps h and i, below, secondly, with respect to:
    privacy of customer information, the following options are available:
    - display: no privacy policy in effect;
    - display: our privacy policy is never to use customer information for uses outside our company such as for mailing lists or data mining;
    - display: our privacy policy is to use customer information for in-house promotions only, if any of these options are selected, then the merchant does nothing more in this item, thirdly, with respect to:
    discounts for customers, the following options are available:

    - none, no discount is available;
    - discount available to customers with password;
    - discount available to anyone who enters a company name and a valid e-mail address;
    which are determined by:
    - more than three characters in a company name text box;

    entered in the e-mail address text box, if, none, no discount is available, option is selected, then, the merchant does nothing more in this item, if, discount available to customers with password, option is selected, then, the merchant enters a password in a text box, up to a 100 different passwords may be entered, edited and deleted, if, discount available to anyone who enters a company name and a valid e-mail address, option is selected, then, the merchant does nothing more in this item, fourthly, with respect to: notes to display on the order form, the following option is available:
    - display a note that: dealer enquires are welcome if this option is selected, then the merchant does nothing more in this item, fifthly, with respect to:
    background colors of the order form, the following buttons are available:
    - top and bottom area of the order form;
    - center area of the order form, if, top and bottom area of the order form, button is selected, then, a background color dialog appears and the merchant may select any color form the displayed palette, or, the merchant may select the make custom color option and make any custom color by moving the red, green, and blue slider bars, whatever color is left visible on the background color dialog will be used as the color for the background of the top and bottom area of the order form, if, center area of the order form, button is selected, then, a background color dialog appears and the merchant may select any color form the displayed palette, or, the merchant may select the make custom color option and make any custom color by moving the red, green, and blue slider bars, whatever color is left visible on the background color dialog will be used as the color for the background of the center area of the order form, and the order form maker program requires the merchant to approve or modify the following information, or help, files:
    - what is escrow e-commerce?
    - no payment until product shipped by merchant?

    - hold payment: how do i do this?
    - how do i contact the merchant?
    - what about privacy of my information?
    - what will my purchase cost me?
    - how important is the order number?
    - what happens when i click the submit button?
    - how will it be shipped to me?
    - how long will the shipping take?
    - is the shipping insured?
    - what about refunds or replacements?
    - how do i get my password for discounts?
    - do i have to fill in all the boxes?
    - create a new text file, these text files are created in a generic sense and the merchant must:
    - select each title:
    -- to select its text file for inclusion in the current version of the escrow electronic commerce order form, and, -- to cause the text file to be displayed in a separate editable text box, and, if, the merchant edits it, enable the merchant to save the changes to the text file, the merchant can always reestablish the original text of the generic file by clicking the default text button, if the merchant selects, create a new text file, then, two text boxes appear:
    one for entering the title of the new file, and, the other for entering the body text of the new file, and, an apply button is visible for the merchant to select, when the merchant selects the apply button, then, the title as entered in the title box, and, the body text as entered into the body text box, are applied as a text file in the list with the other text files, and, will appear in the escrow electronic commerce order form for the customer to read, and the order form maker program require the merchant to click the show order form button to:
    - compile the order form into heml and java script code for display in popular web;
    browsers, this compiled order form is called the escrow electronic commerce order form , and, - compile the hyperfine order form heml submit code which includes the merchant's identification number, a call to open a secure socket layer between the customer's computer and the escrow agent's server computer, and a code sequence to activate the re-direct program; see step c, below, and the order form maker program require the merchant to upload the created heml and java code to their web host server computer using FTP protocol included in the order form maker program, and the order form maker program require the merchant to either.
    -- manually copy the code comprising the hyperfine order form heml submit code from the order from maker program to their web site and place it in the appropriate place in the web site code sequence, to create the order form hyperfine submit button, or, -- if the merchant is using a web site maker program which has this order form maker program integrated into it, to click the required sequence of buttons to cause the hyperfine order form heml submit code generate by this order form maker program to be automatically put in the appropriate place in the web site made by the web site maker program;
    step b:
    action is required by the visitor, hereinafter called the customer, who is viewing the merchants web site, when a customer selects the order form hyperlink submit button, described above, which is located on the merchants web site, the embeded code causes the following actions to occur:
    firstly, it opens a secure socket layer between the customer's computer and the escrow agent's server computer, and, secondly, sends a string of data to the escrow agent's server computer, through the secure socket layer, inside this string is the merchants identification number and a call to activate the re-direct program, step c:
    a second compute program, called the re-direct program, which resides on the escrow agent's server computer, is automatically activated by the call in the hyperlink submit string, and, firstly, finds the merchant's universal resource locator address by comparing the submitted merchants identification number with the information in the merchant lookup table residing on the escrow agents server computer, this merchant lookup table is created, or added to, when the merchant obtains their identification number from the escrow agent as part of the merchant's certification process described in step a, above, secondly, once the re-direct program finds the merchant's universal resource locator address it sends a request to that address, which is to a specific directory inside the merchant's web site on the merchant's web host server computer and retrieves the merchant's most recent escrow electronic commerce order form, and, brings this code back to the escrow agent's sever computer where:
    thirdly, this code is modified by adding an encrypted order number into this code sequence, this order number:
    ~ contains date;
    ~ merchant identification number;
    ~ order sequence number, ~ escrow condition; and, ~ escrow time period, if any, the merchant identification number, the escrow condition, and the escrow time period are obtained from reading the escrow electronic commerce order form code, which the merchant entered or selected in step a, above, fourthly, this modified escrow electronic commerce order form is then sent to the customers computer through the secure socket layer for display in their browser;
    step d:
    action is required by the customer, when a customer selects the order form submit button on the modified escrow electronic commerce order form which has been sent to the customer in a secure socket layer from the escrow agent the following action occurs:
    the order form submit button sends a string of data to the escrow agents server computer through the opened secure socket layer which contains information entered and selected on the modified escrow electronic commerce order form by the customer, and includes the order number and a call to activate the credit card processor program, step e:
    a third computer program, called the credit card processor program, which resides on the escrow agent's server computer, is automatically activated by a call in the order form submit button when the customer selectes the order form submit button on the modified escrow electronic commerce order form, discussed above, and, firstly, it checks to see if the order form has been filled out properly, by checking that the required fields have appropriate character types and sequences in them, and, if not, then, it sends a web page message to the customs which appears in their browser and requests that they fix any problems noted and then re-submit the order form, if ok, then, the credit card processor program assembles some of the information found in the order form submit string into a credit card transaction string, this string is made according to the required and confidential protocol that the escrow agent obtained when they were awarded certified credit card processor status, secondly, it dials up the appropriate credit card company and following the credit card transaction request protocol, which is also confidential and was also obtained when the escrow agent was awarded certified credit card processor status, and, submits the credit card transaction string, and, if, the request is rejected, then, a reject code is sent back from the credit card company, and, the credit card processor program checks its lookup table for a definition of the reject code and sends a web page to the customer with a request to correct the noted problem, the common problems are:
    -- incorrect entry of credit card information, and, -- not sufficient funds available for the requested transaction, if the rejection is because of not sufficient funds available, then, the web page message sent to the customer suggests they try a different credit card and re-submit the order form, if, the request is accepted, the, the credit card processor program records the credit card companies verification transit number code as an add on to the order number and enters the order form submit string into a database called the order form submit string database which is referenced by the order number, and, thirdly.
    it sends a request to make a certified merchant order, step f:
    a fourth computer program, called the certified merchant order maker program which resides on the escrow agent's server computer, is activated by a request from the credit card peocessor program to:
    firstly, the certified merchant order maker program assembles the rest of the information in the order form submit string database, except for the customers credit card information, and makes up a certified merchant order request which includes:
    - the list of items ordered;
    - their quantity;
    - their cost;
    - the shipping method and shipping address, including customer name;
    - the taxes and discounts if any;
    - the total amount of the order;
    - any special instruction message;
    - the modified order number; and, - a declaration by the escrow agent that the funds for this order are being held in escrow, secondly, the certified merchant order maker program then sends the certified merchant order request, it has made, to the merchant by e-mail, according to the merchant's e-mail address noted in the merchant lookup table that was created, or added to, when the merchant obtained their identification number from the escrow agent as part of the merchant's certification process described in step a, above, and, thirdly.
    sends a complete unaltered copy of this certified merchant order request to the customer by e-mail;
    step g:
    action is required from the merchant, the merchant must send an e-mail to the escrow agent at a confidential e-mail address on a custom made form, called the shipping declaration affidavit, that is included in the certified merchant order request, the shipping declaration affidavit includes:
    - customer's name;
    - customer's address;
    - products shipped;
    - order number;
    - shipping companies way bill number;
    step h:
    a fifth computer program, called the escrow release program which resides on the escrow agent's server computer, is activated when the escrow agents's server computer receives the shipping declaration affidavit e-mail to do the following:
    firstly, it forwards the shipping declaration affidavit to the customer after using the order number to find the customer's e-mail address which is in the order form submit string database, secondly, ~
    it checks to see what escrow level is in effect, this was determined by the merchant when the escrow electronic commerce form was made, in step a, and, is determined from the existence of the character a or the character b in the order number, which was put into the order number in step c, above:
    if, the character a is present, then, the escrow release program:
    directs the funds held in escrow for this particular order number to be sent to this particular merchant's merchant bank account which is determined by looking up the merchant's merchant bank account transit number in the merchant look up table on the escrow agents server computer by using the merchant's identification number contained within the order number on the shipping declaration affidavit, and, the escrow release program closes this order transaction by:
    - entering the credit card processing reference transit number the order number and the total dollar amount of this transaction in the current month summary database, for future reference, and - deletes the customers credit card information and all other data that was sent to the escrow agent in the modified escrow electronic commerce order form, including the entry in the order form submit string databse for this order number, and, if, the character b is present, then, the escrow release program:
    firstly, checks the order number to find the time period that must elapse from the time the shipping declaration affidavit arrived at the escrow agents server computer, which is the current time on the server computer's internal clock, and adds the current time to the end of the order numb and enters this modified order number into the escrow hold time lookup table, secondly, the escrow release program shuts down;
    step i:
    the escrow release program self activates every four hours and checks the escrow hold time lookup table to see if any hold time periods have expired by calculating the number of hours that must elapse from the time stamp recorded as the last entry in the order number, and, if no time periods have expired after checking all the entries in the escrow hold time lookup table, then, the escrow release program shuts down;
    if one or more have expired, then, the escrow release program handles each expired entry as follows:
    it checks to see if a hold funds notice for this particular order number has arrived at the escrow agents confidential e-mail address, if none has arrived, then, the escrow release program directs the funds held in escrow for this particular order number to be sent to this particular merchant's merchant bank account which is determined by looking up the merchant's merchant bank account transit number in the merchant look up table on the escrow agents server computer by using the merchant's identification number contained within the order number on the shipping declaration affidavit, and, the escrow release program closes this order transaction by:
    - entering the credit card processing reference transit number, the order number and the total dollar amount of this transaction in the current month summary database, for future reference, and, - deletes the customers credit card information and all other data that was sent to the escrow agent in the modified escrow electronic commerce order form, including the entry in the order form submit string databse for this order number, and, if, one has arrived, then, the escrow release program, creates and sends an e-mail to the merchant, called a notice of hold on escrow funds, telling them of this fact, included, in the notice of hold on escrow funds e-mail is a note that the only solution to getting the funds released is:
    - according to the terms and conditions of the signed escrow electronic commerce contract, to send a fax copy of the shippers receipt, signed by the customer, to a special escrow agent fax number where it will be looked at by a human and checked for visual authenticity and possibly contacting the customer to verify that the shipment has actually been received, or, - by the escrow agent receiving an e-mail from the customer sent to the same e-mail address they sent the hold funds notice on the release of hold funds notice form which is also included in the shipping declaration affidavit which was sent to the customer earlier, the human evaluator determines if either of these are acceptable proof to release the escrow funds to the merchant, and, if they decide yes, then, the funds are then directed by the human to be released to the merchant as discussed above, and, an e-mail is sent to the merchant advising them of this event, and, an e-mail is sent to the customer advising them of this event, if they decide no, then, an e-mail is sent to the merchant advising them of this fact and further human to human proceedings are conducted to solve this matter by communication with the custom, when this order transaction is finally closed the human manually selects this order number in the escrow release program and selects the close transaction button which:

    - enters the credit card processing reference transit number, the order number and the total dollar amount of this transition in the current month summary database, for future reference, and - deletes the customers credit card information and all other data that was sent to the escrow agent in the modified escrow electronic commerce order form, step j, a sixth computer program, called the monthly summary program which resides on the escrow agent's server computer, is activated on the 2nd day of each new month and checks the previous month's summary database, and, creates a summary of all the order transactions completed during the past month for each merchant in the database, this summary creation process decodes the order numbers and includes the total dollar amount for each order transaction and a monthly total dollar amount for each merchant and then sends this to each merchant by e-mail.
  2. 2. An escrow electronic commerce process as claimed in claim 1, whereby the escrow release program in step i, can semi-automatically after a specific action from a human, determine if a release of hold funds notice has been received by the escrow agent at the confidential e-mail address and match this to the appropriate hold of escrow funds by using the order number, and, if a release of hold funds notice has arrived, then the escrow release program will:
    direct the funds held in escrow for this particular order number by way of a credit card pre-authorization to be sent to this particular merchant's merchant bank account which is determined by looking up the merchant's merchant bank account transit number in a look up table on the escrow agents server compute by using the merchant's identification number contained within the order number on the shipping declaration affidavit, if a release of hold funds notice has not arrived, then the escrow release program will:
    display a notice of this fact for the human to read.
  3. 3.An escrow electronic commerce process as claimed in claim 1, whereby the escrow release program in step i, will automatically, when the condition of:
    -- the escrow hold time period has expired, and, -- a hold funds notice notice has arrived check to see if a release of hold funds notice has been received by the escrow agent at the confidential e-mail address and match this to the appropriate hold of escrow funds by using the order number, and, if a release of hold funds notice has arrived, then the escrow release program will:
    direct the funds held in escrow for this particular order number by way of a credit card pre-authorization to be sent to this particular merchant's merchant bank account which is determined by looking up the merchant's merchant bank account transit number in a look up table on the escrow agents serve computer by using the merchant's identification number contained within the order number on the shipping declaration affidavit, if a release of hold funds notice has not arrived , then the escrow release program will:
    continue with its operations as stated in claim 1, step i at the point where:
    it checks to see if a hold funds notice for this particular order number has arrived at the escrow agents confidential e-mail address, and if, one has arrived, then:
    continue as above.
  4. 4. An escrow electronic commerce process as claimed in claim 1, whereby the surtax or discount option as discussed in a-3 and b-3 will include options, other than entering the name of the country, for the merchant to enter and/or set as conditions to determin when the surtax or discount will be applied.
