Abstract
Abstract Method for automatically processing criminal cases, said method comprising gathering data including digitalised form, analysing the data, comparing the analysed data results internally for inconsistencies and externally for breaching of any pre-set rules which are dynamically updated and comprised of institutional rules, statutory rules and case law rules, prompting court trial issues by compare new information with existing information and rules, and generating sentencing submission and penalty range, and options that might be taken to the users.

Criminal Case Intelligent Management and Processing System (CCIMPS)
The invention is described in the following statement
1. Backgrounds
For many years, communities are lack of access to criminal law defence services, because of the high legal costs involved, and a limited number of experienced criminal defence lawyers in Australia. From the other hand, the number of applications for granting of criminal law related legal aid climbs yearly, following population growth in Australia.
2. System Purpose
Criminal Case Intelligent Management and Processing System (CCIMPS) is a software system that aims to be used by all relevant parties to a criminal proceeding, including but not limited to the court, defence, prosecution, to automate the entire process of a criminal proceeding, especially to assist the defence, by adopting modern information technologies.
3. System components
A. Proceeding Management Component
This component receives information from the Crown, either via its letter notification or any electronic notification, and generate relevant submissions/reports/analysis accordingly.
B. Case file digitalisation Component
This component can process any paper documents, scanned documents, photos, videos of a single case file, and digitalise any such information into ready to process digital data.
C. Digital File Processing Component
All digitalised case file will be further classified and analysed sentence by sentence, with its key information pulled out to be stored in a comparable information table for further analysis.
D. Analysis Component
a. Any tables classified as evidence, will be cross-checked, to find out any inconsistencies of evidence, against pre-set rules.
b. Any tables classified as evidence will also be cross-checked with charging particulars, to find out any unsubstantiated elements, against pre-set rules.,
c. Any tables classified as evidence will also be cross-checked against the laws of evidence as pre-set rules, to find out any irrelevant and inadmissible evidence, with possible weight scores to be assigned to each relevant element substantiated by evidence.
d. Any tables classified as history (criminal or traffic) will be analysed against pre-set rules.
E. Trial Component
a. all questions and answers during a trial, will be typed into the system, cross-checking against any previously stored information, and promoting like issues, further crossexamination questions for both parties.
b. an automatic submission to the court will also be generated based upon the analysis result and available information.
F. Sentencing Component
a. aggravating factors and mitigating factors will be analysed and prompted to the users.
b. relevant statutory and case laws will be compared to indicate a possible sentencing range, and what options the defence may take, such as making a working licence application.
G. Rules Component
a. Laws of evidence, relevant statutory and common laws will be used to set-up rules database.
2018101652 04 Nov 2018
b. an auto-searching engine will be deployed to automatically add rules to this system.
c. manual input function can be used to manually add rules to this system.
3. List of features
The system can also contain the following features of:
• assigning cases by taking into consideration factors such as case complexity, charge numbers.
• generating both general and personalised case report, either at institutional and individual level.
• sending auto-emails/reminders/submissions/requests to the relevant parties, depending on the progress of the case.
• Artificial intelligence and data science will be positively implemented in this system.
4. Benefits
This system is aimed at assisting and providing a low-cost solution to a large percentage of unrepresented cases, while also providing more senior intelligent services to criminal lawyers. Ultimately it is aimed to reduce the overall costs for communities to access criminal legal services, and improve efficiencies and accuracies for all parties involved by applying legal technology.
