Description

Editorial Note for 2009101052 There is one description page.
Remote Witnessing System Current legal process requires that an authorised witness be in the physical presence of the deponent(person who wishes to make a legal declaration). This innovation relates to a process for allowing people in remote areas or who are incapable of directly accessing an authorised witness for the purposes of witnessing legal documents. This process will allow the people mentioned above to have an alternate method to access authorised witnesses. Changes in technology have allowed the creation of a process by which an authorised witness can reliably witness a declaration by use of webcams, scanners and printers. 1. The deponent would sign up for the remote witnessing system at a suitable location where suitable ID would be stored electronically for later access during the witnessing process. 2. The deponent would connect to the system with specific credentials that will allow an authorised witness to view the deponent's identification and confirm that they are speaking to the deponent. 3. The deponent would sign the document in view of the webcam which the witness would be monitoring. 4. The deponent would then follow the witnesses instructions for any legally required verbal oaths. 5. The deponent would then follow the instructions to scan the signed document and make it electronically available to the witness. 6. The witness would then either: 1. Place their official seal and sign the document electronically and make it available for printing by the deponent. 2. Print the received document and place their official seal and sign the document and send the document onto the appropriate person.

Claims (9)

1. That a person would signup to a remote witnessing system at a defined location.
2. That at the location the person would have identifying documents scanned and securely stored for later viewing by an authorised witness.
3. That when a person wishes to have legal documents witness remotely would use software to connect to a remote system.
4. That the person would sign documents within the view of the webcam with an authorised witness monitoring.
5. That the person would then perform any legally required oaths in view of the webcam which is being monitored by the authorised witness from point 4.
6. That the person would follow specific instructions by the authorised witness from point 4 to scan the signed documents and make them electronically available to the authorised witness.
7. That the authorised witness from point 4 would then electronically place their official seal and place a digitised signature on the document.
8. That the file would then be made available for the person to print a copy of the electronically signed document.
9. That alternatively to point 7 the authorised witness from point 4 would print the document and place their official seal on the document and sign it to be passed on to the appropriate person.
