Abstract

본 발명은 미래에 생성될 디지털 콘텐트를 위한 사용 권리들을 창설하기 위한 방법 및 장치를 개시한다. 본 발명에 따르면, 디지털 저작물에 대한 사용권리들이 대응하는 콘텐트가 생성되기 이전에 창설된다. 이 권리들은 상기 콘텐트가 생성된 후에 상기 콘텐트와 연관시킬 수 있다. 비디오 레코더나 스틸카메라와 같은 콘텐트 생성 장치는 상기 권리들의 라벨들을 저장할 수 있고 상기 콘텐트가 생성됨에 따라 사용권리들을 상기 콘텐트에 실시간으로 연관시킬 수 있다.

Description

미래에 생성될 디지털 콘텐트를 위한 사용 권리들을 창설하기 위한 방법 및 장치 {Method and Apparatus for Establishing Usage Rights for Digital Content to be Created in the Future}
전자적 수단, 특히 인터넷을 통한 디지털 저작물의 광범위한 배포를 저해하는 가장 중대한 문제 중 하나는 현재 디지털 콘텐트 배포 및 사용 중에 콘텐트 소유자의 지적재산권을 보호하는 장치가 부족하다는 점이다. 이 문제를 해결하기 위한 노력을 가리켜 "지적재산권 관리(Intellectual Property Rights Management, IPRM)", 디지털 재산권 관리(Digital Property Rights Management, DPRM)", 　"지적재산 관리(Intellectual Property Management, IPM)", "권리 관리 (Rights Management, RM)", "전자적 저작권 관리(Electronic Copyright Management, ECM)"　등의 용어로 칭해왔으며 이하에서는 디지털 권리 관리(Digital Rights Management, DRM)로 총칭하기로 한다.
최근 몇 년간 인터넷 확산과 프라이버시, 인증, 허가, 회계, 지불 및 금융결제, 권리 내역, 권리 검증, 권리 시행, 문서 보호, 라이센싱료 수금 등에 관련된 문제 때문에 DRM은 훨씬 더 중요해졌다. 인터넷은 다수의 컴퓨터 사용자들이 아이디어와 정보를 통신 및 교환하는 널리 사용되는 네트워크이기 때문에, 전자적으로 발행된 저작물을 복제 및 배포하는 자유가 널리 퍼져있고 보편적이 되었다.
상기 문서 보호문제를 해결하기 위하여 두 가지 기본적인 DRM 기법이 사용되어 왔는데, 시큐어 콘테이너(secure container)와 신뢰시스템(trusted system)이 바로 그것이다. 시큐어 콘테이너(혹은 간단하게, 암호화된 문서)는 인증조건 집합이 충족되고 저작권 조건(예를 들면, 사용료 지불)이 이행될 때까지 문서 컨텐츠의 암호화 상태를 유지하는 방법을 제공한다. 문서 제공자와 함께 여러 가지 조건이 검증된 후에 그 문서는 암호가 제거된 형태로 사용자에게 제공된다. CRYPTOLOPESTM및 DIGIBOXESTM와 같은 상용제품들이 이 범주에 속한다. 명백히, 시큐어 콘테이너식 접근방법은 안전하지 않은 채널을 통해 전달되는 동안에 문서를 보호하는 솔루션을 제공하지만, 합법적인 사용자가 암호가 제거된 문서를 획득한 후 컨텐츠 소유자의 지적재산권을 침해하는 사용 및 재배포 행위를 하는 것을 방지할 수 있는 메커니즘을 제공하지는 않는다.
암호화 메커니즘은 보통 문서를 암호화하는 데 사용되며 암호화된 문서는 공공연히 배포 및 저장되고 최종적으로 허용된 사용자에 의해 개별적으로 복호화 된다. 이는 불안정한 매체에서의 문서 저장 과정 뿐만 아니라 공공 네트워크에서 문서 배포자로부터 원하는 사용자에게로 문서를 전달하는 동안 기본적인 보호유형을제공한다.
"신뢰시스템" 접근방법에서는, 전체 시스템이 무단 사용과 배포를 방지하는 책임을 진다. 신뢰시스템의 구축은 통상, 시큐어 프로세서, 시큐어 스토리지 및 시큐어 렌더링 장치 등의 새로운 하드웨어의 설치를 수반한다. 이는 또한 신뢰시스템에서 작동되는 모든 소프트웨어 애플리케이션이 신뢰할 수 있는 것으로 증명될 것을 요구한다. 변경방지 (tamper-proof) 능력을 갖춘 신뢰시스템의 구축이 기존의 기술이 직면한 어려운 과제인 반면, 현재의 시장추세는, 웹에 접속하기 위한 브라우저를 사용하는 PC나 워크스테이션 등과 같은 개방형 및 비신뢰 시스템들이 디지털 저작물들에 접근하기 위해 사용되는 시장 지배적인 시스템이 될 것임을 시사하고 있다. 이러한 의미에서, 대중적인 운영체제들(예를 들면, 윈도우TM, 리눅스TM및 유닉스TM)과 브라우저 같은 렌더링 애플리케이션을 갖춘 PC와 워크스테이션과 같은 기존의 컴퓨팅 환경은 신뢰시스템이 아니며 그 아키텍처를 상당히 변경하지 않고서는 신뢰성을 갖출 수가 없다. 물론, 그 아키텍처를 변경할 경우 웹의 기본목적, 즉, 유연성과 호환성을 잃게 된다.
미국 특허 5,530,235, 5,634,012, 5,715,403, 5,638,443 및 5,629,980는 DRM에 관한 많은 기본 개념을 개시한다. 이들 모든 특허는 여기에서 그 전체로서 참조되고 있다. 미국특허 5,634,012는 디지털 문서의 배포를 제어하는 시스템을 개시한다. 각 렌더링 장치는 그와 관련된 저장소를 가지고 있다. 일정한 사용 거래 단계의 집합은 문서와 관련된 사용권리들을 집행하기 위하여 저장소들이 사용하는 프로토콜을 정의한다. 사용권리들은 상기 콘텐트와 함께 캡슐화되기도 하고 그렇지 않으면 상기 콘텐트와 함께 전송되기 위하여 상기 디지털 저작물과 연관지어진다. 사용권리들은, 열람만, 1회의 사용, 배포 등등 여러 가지 방법으로 사용을 허락할 수 있다. 사용권리는 요금의 지불이나 다른 조건에 따라 허여될 수 수 있다.
종래의 DRM 기법에서 콘텐트 소유자, 혹은 다른 권한있는 당사자는 상기 콘텐트가 생성된 후에 권리를 명시하며 이와 동시에 콘텐트를 보호, 즉 암호화한다. 프라이빗 키(private key)는 이 콘텐트를 암호화하는 데 사용되며 그 다음 사용권리를 명시하는 라벨이 생성된다. 그러면 권리 라벨과 보호되는 콘텐트는 연결되어 저장된다. 추후 상기 콘텐트에 대한 라이센스는 사용자가 콘텐트를 사용 혹은 접근할 수 있도록 사용자에게 생성될 수 있다. 이 라이센스는 알려진 방식으로 퍼블릭 키(public key)를 사용해 암호화된 프라이빗 키를 포함하고 있다.
해당 콘텐트에 액세스하기 위해 프라이빗 키는 암호화된 퍼블릭 키를 복호화하는 데 사용되며, 따라서 사용자가 해당 콘텐트를 복호화 할 수 있게 해준다. 이러한 기법은 콘텐트가 권리 사양의 시점에 제공될 때 보다 효과가 높다. 그러나 이러한 기법은 콘텐트가 만들어지기 전에 사용자가 콘텐트에 대한 권리를 명시하고 콘텐트에 대한 라이센스를 발행하기 원할 경우엔 소용이 없다. 예를 들어 앞으로 진행될 라이브 이벤트의 스트리밍 비디오나 향후 이벤트 사진 배포자는 이벤트가 시작되기 전에라도 콘텐트의 라이센스 판매를 원할 수 있다. 기존 DRM 시스템은 DRM 시스템의 보안, 사용자 인터페이스, 조직, 구조, 정확성을 향상시키기 위한 프로세스 제시 능력이 부족하며 특히 아직 존재하지 않는 저작물의 경우 더욱 그러하다.
본 발명은 디지털 저작물(works)에 대한 사용 권리들의 할당에 관한 것으로, 보다 구체적으로는 콘텐트가 생성되기 전에 상기 콘텐트에 대한 사용권리의 창설하는 방법에 관한 것이다.
본 발명은 첨부된 도면을 참조하여 상세히 설명되는데, 첨부된 도면은 다음과 같다.
도 1은 본 발명의 실시예에 따른 상기 콘텐트의 생성 이전에 디지털 콘텐트에 대한 사용권리들을 제공하기 위한 방법의 흐름도이다.
도 2는 본 발명의 실시예에 따른 미래에 생성될 디지털 콘텐트에 대한 사용권리들을 제공하기 위한 콘텐트 생성 장치를 보여주는 도면이다.
본 발명의 목적은 종래 기술의 상기한 문제를 해결하기 위한 것으로 저작물의 생성 이전에 저작물에 할당될 수 있는 사용권리들을 허용하는 것을 목적으로 한다.
본 발명의 한 가지 측면으로서, 콘텐트와 이에 관련된 사용권리를 구비하는 디지털 저작물을 생성하는 방법이 제공된다. 상기 방법은 상기 콘텐트가 생성되기 전에 디지털 저작물의 콘텐트와 관련된 사용권리들을 구비하는 라벨을 생성하는 단계, 상기 콘텐트가 생성된 후에 상기 라벨을 상기 콘텐트와 연관시키는 단계 및 상기 콘텐트와 상기 라벨을 안전화(securing)하는 단계를 구비한다.
본 발명의 두 번째 측면으로서, 콘텐트와 사용권리들을 구비하는 디지털 저작물을 생성하는 시스템이 제공된다. 상기 시스템은 디지털 콘텐트를 생성하기 위한 콘텐트 생성 장치, 상기 콘텐트 생성 장치와 연관되며, 자동적으로 일정한 사용권리들을 상기 콘텐트에 부착하고 상기 콘텐트에 상기 사용권리와 함께 안전화하는 권리 할당 엔진 및 상기 콘텐트 생성 장치의 사용자를 확인하고 상기 권한있는 사용자가 그 사용권리에 따라 상기 디지털 콘텐트에 접근할 수 있도록 하는 동일성 확인 장치를 구비한다.
본 발명의 세 번째 측면으로서, 콘텐트와 이에 관련된 사용권리를 구비하는 디지털 저작물을 생성하는 방법이 제공된다. 상기 방법은 상기 콘텐트가 생성되기 전에 디지털 저작물의 콘텐트와 관련된 사용권리들을 구비하는 라벨을 생성하는 단계, 콘텐트 생성 장치에 상기 라벨을 저장하는 단계, 상기 콘텐트 생성 장치를 가지고 상기 콘텐트를 생성하는 단계, 상기 콘텐트가 생성된 후에 상기 라벨을 상기 콘텐트와 연관시키는 단계 및 상기 콘텐트와 라벨에 안전화하는 단계를 구비한다.
여기에서 사용되는 "디지털 저작물(digital work)"이라는 표현은 컴퓨팅 처리된 판독가능한 형태의 콘텐트를 갖는 모든 유형의 요소를 지칭한다. 여기에서 사용되는 "콘텐트"는 디지털 저작물의 열람가능한 부분 또는 그 밖의 방법으로 이용가능한 부분을 지칭한다. "사용권리들"이라는 표현은 기존의 디지털 저작물 또는 미래에 생성될 디지털 저작물의 사용자에게 주어진 그 저작물의 콘텐트의 사용, 접근, 배포 등에 관한 허가를 지칭한다. 또한 사용권리는 그러한 허가된 권리를 행사하기 전에 충족되어야 하는 하나 이상의 조건을 가질 수 있다.
도 1은 디지털 저작물의 콘텐트의 생성 이전에 그 콘텐트에 대한 사용권리들을 제공하기 위한 방법의 실시예를 도시한다. 100단계에서, 사용권리들을 기술하며아직 생성되지 않은 콘텐트와 연관될 라벨이 생성된다. 상기 사용권리 라벨은 상기 디지털 저작물의 인쇄, 복사, 변경, 편집 또는 열람 등과 같은 사용권리를 포함할 수 있고 또한, XrMLTM언어나 그 밖의 사용권리 문법에 포함된 것과 같은 그 밖의 다른 권리, 허가, 또는 제한을 포함할 수 있다. 택일적으로, 상기 사용권리 라벨은 단순히 상기 저작물의 동일성 정보와 기타 설명적 자료만 포함할 수 있고 상기 특정적으로 허여된 사용권리들이 아래에서 설명되는 라이센스에 포함될 수 있다. 상기 XrMLTM언어를 사용하는 경우에, 상기 라벨은 상기 사용권리들을 지정하는 확장성 생성 언어(XML) 문서일 수 있다. 또한, 상기 미래의 콘텐트는 사용권리들의 서로 다른 많은 버전들을 가질 수 있고 따라서 라벨이 각 버전마다 생성될 수 있다.
110단계에서, 종래의 퍼블릭 키와 같은 키가 알려진 방식으로 생성되어 상기 라벨과 연관지어진다.
120단계에서, 생성될 상기 콘텐트의 사용, 즉, 상기 콘텐트에 대한 라이센스에 대한 사용자 요청이 수신된다. 상기 콘텐트 자체는 아직 존재할 필요가 없다는 점을 유의해야 한다. 예를 들면, 상기 콘텐트는 미래에 예정된 스포츠 이벤트의 비디오 레코딩 또는 스트림일 수 있다. 130단계에서, 상기 콘텐트의 배포자, 또는 또 다른 권한있는 당사자는 상기 사용자에게 라이센스를 발급한다. 상기 라이센스는 110단계에서 생성된 상기 퍼블릭 키에 대응하는 프라이빗 키를 포함할 수 있고 사용권리들이나 다른 설명적인 데이터를 포함할 수 있다. 다시 한번, 상기 콘텐트 자체는 아직 존재할 필요가 없다는 점을 유의해야 한다. 따라서, 상기 배포자는 상기이벤트 이전에 상기 이벤트를 관람할 수 있는 라이센스를 판매할 수 있다.

160단계에서 상기 안전화된 디지털 콘텐트에 대한 접근요청이 있는지를 판단한다. 만약 요청이 없으면, 상기 단계에서 요청을 기다린다. 그러나, 접근 요청이 있는 경우, 상기 단계는 170단계로 진행하여, 상기 디지털 저작물 및/또는 라이센스와 연관된 상기 사용권리들을 체크하여, 상기 사용권리와 연관된, 지불 등과 같은 모든 조건들이 충족되었는지 여부를 판단한다. 만약 모든 조건들이 충족되었으면, 상기 단계는 180단계로 진행하여 상기 콘텐트에 대한 접근이 허여된다. 즉 상기 콘텐트가 다운로드 되거나, 스트리밍되거나, 그 밖의 다른 방식으로 상기 사용자에게 전달된다. 190단계에서, 상기 사용자의 프라이빗 키를 사용하여 알려진 방식으로 상기 콘텐트를 복호화한다.
상기 사용권리들의 상기 콘텐트로의 연관동작은 여러 가지 방식으로 수행될 수 있다. 예를 들면, 상기 사용권리들이 디지털 저작물의 전체 콘텐트에 대하여 동일한 경우, 상기 사용권리들은 다른 장치의 배포 서버에 저장되기 위하여 상기 디지털 저작물이 처리될 때 첨부될 수 있다. 그러나, 상기 디지털 저작물의 상기 콘텐트가 여러가지 컴포넌트들에 대하여 다양한 서로 다른 사용권리를 가지고 있는 경우, 상기 사용권리들은 상기 저작물이 생성되면서 부착될 수 있다. 상기 사용권리를 부착하기 위한 자동화된 과정을 제공하기 위하여 다양한 저작도구 (authoring tools) 및/또는 디지털 저작물 어셈블링 툴들이 사용될 수 있다. 디지털 저작물의 각 부분은 그 자체의 사용권리들을 가질 수 있기 때문에, 어느 한 "부분"의 사용권리들이 그 전체 저작물과 다르게 되는 경우가 있을 수 있다. 따라서 한 권리가 언제 어떤 식으로 행사될 수 있는가를 지시하기 위하여 충돌 규칙들이 창설될 수 있다.
도 2는 본 발명의 바람직한 실시예에 따른 콘텐트 생성 장치의 하나인 비디오 레코더를 보여주는 도면이다. 상기 콘텐트 생성 장치(300)는 제어기(302), LCD디스플레이(304), 스마트-카드 리더(306), 메모리(307), 키패드(308), 권리할당 엔진(310), 눈/홍채 인식 센서(312), 케이블 접속(313), 핸들(314) 및 대칭적 지문인식 센서들(316, 318)을 구비한다. 또한, 렌즈 시스템(320)은 비디오 이미지의 녹화를 가능하게 한다. 상기 바람직한 실시예의 제어기(302)와 권리할당 엔진(310)은 요구되는 방식으로 프로그램 된 마이크로프로세서 기반의 장치를 통해서 구현된다.
도 2에서 상기 제어기(302)와 권리할당 엔진(310)이 별개의 장치로 도시되어있지만, 이들 장치들이 수행하는 상기 기능들은 하나의 프로세서 내에 결합될 수 있다. 또한, 디지털 신호처리기들 등의 복수의 처리기 사이에 더욱 세분화되거나 하드와이어(hardwired) 전자 또는 논리 회로나 프로그래머블 로직 디바이스 등의 주문형 반도체(ASIC) 등의 전용 하드웨어에 의해 수행되거나 그 밖의 하드웨어나 소프트웨어 구현에 의하여 수행될 수 있다. 또는 이들 모두를 채용할 수도 있다.
상기 스마트-카드 리더는 그 안에 삽입되는 카드들을 읽기 위해 사용될 수 있다. 예를 들면, 라이센스, 사용권리들, 또는 동일성 정보가 상기 카드에 내장되어 상기 제어기(302) 및/또는 상기 권리할당 엔진(310)으로 전달될 수 있다. LCD디스플레이(304), 스마트-카드 리더(306), 키패드(308) 및 소프트웨어 인터페이스들은 생성 서버(300)의 사용자 인터페이스를 구성한다. 상기 사용자 인터페이스는 사용자가 동일성확인(identification) 데이터와 접근 요청과 같은 정보를 입력하고, 생성 장치(300)의 동작에 대한 피드백을 제공한다. 상기 바람직한 실시예의 상기 콘텐트 생성 장치(300)는 비디오 레코더이지만, 예를 들면, 스틸-이미지 카메라, 애니메이션 작성기, 혹은 오디오 레코더 등, 어떤 형태의 레코딩 장치라도 될 수 있다.
상기 권리할당 엔진(310)은 상기 케이블 접속(313)을 통하여 접근될 수 있다. 예를 들면, XrMLTM및 관련 툴을 실행하는 컴퓨터 등의 권리할당 컴퓨터(도시되지 않음)는 상기 권리할당 엔진(310)에 연결되어 미래에 상기 콘텐트 생성 장치(300)에 의해 생성될 콘텐트에 대한 사용권리를 표시하는 사용권리 라벨이나 상기한 라벨과 유사한 템플릿을 다운로드할 수 있다. 상기 콘텐트 생성 장치(300)에 의해 생성되는 어떠한 콘텐트도 자동적으로 권리할당 엔진(310)에 저장된 상기 사용권리 라벨이나 라벨들과 연관지어지게 된다. 택일적으로, 상기 사용권리 라벨은 생성 장치(300)의 상기 사용자 인터페이스를 사용하여 작성될 수 있다. 어느 경우에서나, 하나 또는 그 이상의 라벨과 대응하는 키들이 생성되어 생성 장치(300)에 의해 기록된 콘텐트에 상기 라벨들이 어떻게 할당할 것인가를 지시하는 명령들과 함께 권리할당 엔진(310)에 저장된다.
이러한 명령들은 상기 사용권리들이 어떤 방식으로든 할당되게 할 수 있고 허락 및/또는 제한을 포함할 수 있다. 예를 들면, 비디오 레코더의 경우에 있어서, 비디오 시퀀스 또는 프레임의 각 부분은 서로 다른 권리들을 선택적으로 할당받을 수 있다. 이는 상기 권리할당 과정을 매우 유연하고 동적인 것으로 만들며, 콘텐트가 생성됨에 따라 또는 생성 이전에 권리할당이 실시간으로 이뤄질 수 있게 한다.
상기 콘텐트 생성 장치(300)는 상기 사용자의 동일성 정보, 상기 레코딩 장치 그 자체, 상기 스마트 카드에 있는 데이터 등등에 기반하여 권리들을 할당하기 위하여 고유의 장치ID, 사용자 스마트 카드, PKI기술, PIN, 또는 생체측정 시스템 등을 사용할 수 있다. 예를 들면, 권리할당 엔진(310)이 상기 사용자와 연관된 대응하는 권리의 집합을 사용할 수 있도록 하기 위하여, 지문 인식 센서들(316, 318) 또는 홍채 인식 센서(312)가 상기 사용자의 동일성의 인식 또는 인증을 위하여 사용될 수 있다. 예를 들면, 개인A에 의해 기록된 모든 콘텐트가 하나의 권리 집합을 가지고 개인B에 의해 기록된 모든 콘텐트가 다른 하나의 권리 집합을 가지게 되는 것이다.
상기 콘텐트 생성 장치(300)는 편리한 방법으로 콘텐트를 기록한다. 그러나, 100 및 110 단계에서 생성되는 전술한 라벨과 키들은 저장된 후 콘텐트 레코더(300)에 의해 기록된 콘텐트와 연관지어진다. 따라서 전술한 140 및 150단계들은 또한 콘텐트 생성 장치(300)에 의해 수행완료된다. 보안을 위한 목적으로, 토큰 또는 선불 카드(또는 자기카드나 스마트 카드, 혹은 메모리-타입, 동기 통신 카드, ISO 7816-준수 카드, EMV-타입 카드 등의 그 변형들)가 상기한 요금과 소액 지불(micro-payments)의 저장이나 권리와 관련된 그러한 요금의 추적을 위하여 사용될 수 있다. 그러한 카들들은 상기 스마트-카드 리더(306)을 사용하여 판독할 수 있다.
본 발명이 콘텐트의 생성 이전에 저작물에 대한 사용권리를 생성하고 상기 콘텐트에 연관시킬 수 있음을 알 수 있다. 상기 사용권리들은 미래의 디지털 저작물의 이용 및 배포 방식을 정의한다. 이러한 미리 창설된 사용권리들은 미래의 디지털 저작물의 일부가 되고 그러한 저작물의 콘텐트의 사용과 배포를 제어한다.
상기한 바람직한 실시예에서, 미래의 콘텐트에 대한 상기 권리들이 창설된 후에 상기 미래의 콘텐트와 연관된 프라이빗 키가 할당되고 권리 라벨이 생성된다.이 프라이빗 키는 권리라벨과 함께 저장된다. 사용자는 상기 라벨이 상기 메인 서버에 제공된 후에 상기 콘텐트(현재의 또는 미래의)를 구입할 수 있다. 상기 콘텐트가 구입된 후에, 상기 콘텐트 소유자는 프라이빗 키에 의해 암호화된 상기 퍼블릭 키를 포함하고 있는 암호화를 위한 라이센스를 얻을 수 있다. 택일적으로, 단일 대칭형 키가 사용될 수 있다.
본 발명은, 콘텐트의 미래의 출판물들이 아직 출판되지 않았지만 그 출판물에 대한 권리들이 이미 할당되고 저장된 가입 모델(예컨대, 잡지나 마케팅리포트 등에 관한)에서도 사용될 수 있다. 적절한 미래의 어느 시점에서, 상기 권리들을 해당 콘텐트들과 연관시키게 된다. 예를 들면, 그 실제의 이벤트가 있기 전에 웹사이트 상에서의 미래의 이벤트의 콘텐트를 판매함으로써, 상기 웹사이트의 트래픽을 현저하게 감소시킬 수 있으며 긴 시간대에 걸쳐 분산시킬 수 있게되어 서버들과 상기 웹사이트에 대한 조건들을 훨씬 충족시키기 쉽게 만들고 작동비용을 저렴하게 만든다. 그러나, 상기 권리나 티켓, 즉 라이센스를 판매하는 상기 웹사이트가 나중에 상기 콘텐트를 제공하는 웹사이트와 다를 수도 있다는 점을 유의해야 한다.
또한, 본 발명은 신문 편집인이, 예를 들면, 사진의 품질이 어떤 식으로든 저하되는 것(예를 들면, 변경, 편집, 권한 없는 자에 의한 열람, 또는 감춰져서 별도로 또다른 신문사 조직에 판매되는 등의 일)에 관해 걱정할 필요가 없이 콘텐트를 기록하기 위하여 사진기자를 보낼 수 있도록 한다. 실제로, 상기 카메라 기자는 상기 콘텐트가 기록되자마자 그 콘텐트에 관해서 아무런 권리도 가질 수 없게 될 수 있다.
택일적으로, 상기 편집인은 예컨대, 최초의 10매의 사진은 상기 신문사에 속하게 되고 (업무 관련으로), 그 다음 5매는 사진기자에게 (개인용도로) 속하게 되는 식으로 상기 권리를 설정할 수 있다. 이 예는 유연성, 안전성, 기밀성, 확실성 및 당사자들(이 사례에서는 사진기자와 편집인) 사이에 전개될 수 있는 여러가지 관계를 보여준다.
모든 미래의 콘텐트는 그 콘텐트가 실제로 존재하기 이전에 하나의 콘텐트 ID를 할당받을 수 있다. 상기 콘텐트 ID와 암호화를 위한 라이센스가 주어지면, 상기 콘텐트는 생성된 후에, 상기 라이센스를 구입한 사용자들이 사용할 수 있는 것이 가능한 방식으로 암호화될 수 있다. 그러나, 상기 콘텐트 ID정보 및 암호화를 위한 상기 라이센스가 이용가능한 상태가 아니라면, 상기 콘텐트에 대한 접근은 거부될 것이다.
또한, 일정한 대칭형 키가 콘텐트 생성 전에 미리 생성되어 상기 권리 라벨과 함께 저장될 수 있다. 나중에 콘텐트가 생성된 후에 동일한 키가 상기 콘텐트를 암호화하기 위해 사용될 수 있다. 그러나, 상기한 바와 같이, 사용자마다 서로 다른 키를 수신할 수 있다. 또 다른 방식으로, 상기 사용자는 인가 토큰을 받을 수 있으며, 이를 나중에 상기 라이센스와 교환할 수 있다.
상기 제어기(302)는 상기 보안 매개변수들과 상기 권리 관리 단계들을 처리할 수 있다. 분실 카드 검증, 분실 카드 리포트, 카드 사용 리포트, 보안 경고 리포트 및 추적 리포트 등이 취소된 권리, 거부된 권리, 갱신 된 권리, 사용 패턴 및 소액 결제 등의 상기 권리 관리 리포트와 연관되거나 결합될 수 있다.
본 발명은 객체를 사용하는 소프트웨어에서 또는 다양한 컴퓨터 하드웨어 플랫폼들 상에서 사용될 수 있는 포터블(portable) 소스코드를 제공하는 객체 지향 소프트웨어 개발 환경에서 쉽게 구현될 수 있다. 예를 들면, 상기 소프트웨어는 JAVATM언어로 작성될 수 있고 JAVATM가상 머신에서 실행될 수 있다. 택일적으로, 상기 개시된 동작들은 표준 논리회로나 VLSI 설계를 사용하는 하드웨어에서 부분적으로 또는 전체적으로 구현될 수 있다. 상기 하드웨어는 어떤 유형의 범용 컴퓨터, 전용 컴퓨터, 그 밖의 장치라도 포함할 수 있다.
상기 배포, 회계 기타 상기 배포자 및 클리어링하우스의 다른 기능들은 어느 장치 상에 있는 어떤 당사자에 의해서라도 수행완료될 수 있다. 예를 들면, 상기 콘텐트는 코드의 입력 또는 스마트 카드를 리더에 입력하는 것에 대한 응답으로서, 전자책 리더(ebook reader) 또는 PDA에 제공될 수 있으며, 상기 디지털 저작물이나 회계데이터가 특정 소스로 반환될 때, 회계처리가 완료될 수 있다. 여기에서 개신된 업무의 분화는 단지 예시적인 것에 불과하다. 사용권리 및/또는 회계데이터는 디지털 저작물과 함께 캡슐화될 수 있고 혹은 별도로 저장될 수 있다. 콘텐트의 제공, 복호화, 또는 그 밖에 상기 콘텐트의 사용을 허가하거나 제한하기 위한 코드는 어떤 장치에라도 저장될 수 있고, 또는 상기 디지털 저작물과 함께 캡슐화될 수도 있다. 어떠한 배포를 위한 배치라도 본 발명과 함께 사용할 수 있으며, 그러한 배치는 개인용 컴퓨터들, 서버들, PDA들 등, 원하는 정보를 전달하는 데 필요한 방식으로 다른 장치와 통신하는 모든 장치들의 어떠한 결합도 포함할 수 있다.

Claims (25)

  1. 콘텐트와 이에 관련된 사용권리를 구비하는 디지털 저작물을 생성하는 방법으로서,
    상기 콘텐트가 생성되기 전에 디지털 저작물의 콘텐트와 관련된 사용권리들을 구비하는 라벨을 생성하는 단계;
    상기 콘텐트가 생성된 후에 상기 라벨을 상기 콘텐트와 연관시키는 단계; 및
    상기 콘텐트와 상기 라벨을 안전화 하는 단계를 구비하는 것을 특징으로 하는 디지털 저작물을 생성하는 방법.
  2. 제 1항에 있어서, 상기 안전화 단계는 상기 콘텐트와 라벨을 암호화하여 저장하는 것을 특징으로 하는 디지털 저작물을 생성하는 방법.
  3. 제 1항에 있어서, 상기 사용 권리들에 따라 상기 콘텐트에 접근을 허여하는 단계를 더 구비하는 것을 특징으로 하는 디지털 저작물을 생성하는 방법.
  4. 제 1항에 있어서, 상기 라벨 생성 단계는 상기 콘텐트의 변경, 편집, 복사, 인쇄, 또는 열람 중의 적어도 어느 하나를 할 수 있는 사용자의 권리를 기술하는(specifying) 사용권리들을 생성하는 단계로 구성된 것을 특징으로 하는 디지털 저작물을 생성하는 방법.
  5. 제 1항에 있어서, 상기 라벨 생성 단계 후에 그리고 상기 연관 단계 이전에, 서면, 청각적, 그래픽, 오디오, 그림, 또는 비디오 기반의 요소들 중의 적어도 어느 하나를 상기 콘텐트로서 생성하는 단계를 더 구비하는 것을 특징으로 하는 디지털 저작물을 생성하는 방법.
  6. 제 1항에 있어서, 상기 생성 단계는 상기 콘텐트와 연관되는 일정한 안전 키를 할당하는 단계를 더 구비하며, 상기 안전화 단계는 상기 콘텐트와 라벨을 상기 안전 키로 암호화하는 단계를 구비하는 것을 특징으로 하는 디지털 저작물을 생성하는 방법.
  7. 제 5항에 있어서, 상기 생성 단계는 레코딩 장치를 이용하여 콘텐트를 레코딩하는 단계를 구비하고, 상기 연관 단계 및 안전화 단계는 상기 레코딩 장치에 의하여 수행완료되는 것을 특징으로 하는 디지털 저작물을 생성하는 방법.
  8. 제 7항에 있어서, 상기 생성 단계는 외부 컴퓨팅 장치에서 상기 라벨을 생성하는 단계 및 상기 연관 단계 이전에 상기 라벨을 상기 레코딩 장치로 다운로드하는 단계를 구비하는 것을 특징으로 하는 디지털 저작물을 생성하는 방법.
  9. 제 7항에 있어서, 상기 생성 단계는 상기 연관 단계 이전에 상기 레코딩 장치에서 상기 라벨을 생성하는 단계를 구비하는 것을 특징으로 하는 디지털 저작물을 생성하는 방법.
  10. 콘텐트와 사용권리들을 갖는 디지털 저작물을 생성하는 시스템으로서,
    디지털 콘텐트를 생성하기 위한 콘텐트 생성 장치; 및
    상기 콘텐트 생성 장치와 연관되며, 자동적으로 일정한 사용권리들을
    상기 콘텐트에 부착하고 상기 콘텐트에 상기 사용권리와 함께 안전화 하는 권리 할당 엔진을 구비하는 것을 특징으로 하는 디지털 저작물을 생성하는 시스템.
  11. 제 10항에 있어서,
    상기 콘텐트 생성 장치의 사용자를 확인하기 위한 동일성확인(identification) 장치; 및
    상기 사용자에 기반하여 상기 사용권리들을 결정하는 수단을 더 구비하는 것을 특징으로 하는 디지털 저작물을 생성하는 시스템.
  12. 제 10항에 있어서, 상기 콘텐트 생성 장치는 스틸-이미지 카메라, 오디오 레코더, 또는 비디오 레코더 중의 하나로 구성되는 것을 특징으로 하는 디지털 저작물을 생성하는 시스템.
  13. 제 11항에 있어서, 상기 동일성 장치는 생체측정 센서(biometrics sensor)로구성되는 것을 특징으로 하는 디지털 저작물을 생성하는 시스템.
  14. 제 11항에 있어서, 상기 사용권리들과 연관된 요금 및 지불정보의 저장을 위한 안전 저장 매체(secure storage medium)를 더 구비하는 것을 특징으로 하는 디지털 저작물을 생성하는 시스템.
  15. 제 11항에 있어서, 상기 콘텐트 생성 장치는 비디오 레코더로 구성되는 것을 특징으로 하는 디지털 저작물을 생성하는 시스템.
  16. 제 11항에 있어서, 상기 콘텐트 생성 장치는 스틸 픽처 카메라로 구성되는 것을 특징으로 하는 디지털 저작물을 생성하는 시스템.
  17. 콘텐트와 이에 관련된 사용권리를 갖는 디지털 저작물을 생성하는 방법으로서,
    상기 콘텐트가 생성되기 전에 디지털 저작물의 콘텐트와 관련된 사용권리들을 구비하는 라벨을 생성하는 단계;
    콘텐트 생성 장치에 상기 라벨을 저장하는 단계;
    상기 콘텐트 생성 장치를 가지고 상기 콘텐트를 생성하는 단계;
    상기 콘텐트가 생성된 후에 상기 라벨을 상기 콘텐트와 연관시키는 단계; 및
    상기 콘텐트와 라벨에 안전화 하는 단계를 구비하는 것을 특징으로 하는 디지털 저작물을 생성하는 방법.
  18. 제 17항에 있어서, 상기 안전화 단계는 상기 콘텐트와 라벨을 암호화하여 저장하는 단계를 구비하는 것을 특징으로 하는 디지털 저작물을 생성하는 방법.
  19. 제 17항에 있어서, 상기 사용 권리들에 따라 상기 콘텐트에 접근을 허여하는 단계를 더 구비하는 것을 특징으로 하는 디지털 저작물을 생성하는 방법.
