Description
- Die Erfindung betrifft ein Verfahren zur Authentifizierung eines einzelnen Produkts eines Herstellers durch einen Dritten. Ein Verfahren nach dem Oberbegriff des Anspruchs 1, ist aus
WO 2005/036504 bekannt. - Für die Kunden von Markenprodukten besteht ein Bedürfnis, ein einzelnes gekauftes Produkt aus einer Serie von Markenprodukten zu identifizieren und zu authentifizieren. Die Kunden wollen, gerade in einer Zeit der blühenden Produktpiraterie, feststellen, ob es sich bei einem bestimmten, von ihnen erworbenen Produkt um ein Originalprodukt des Markenherstellers oder um eine Fälschung, also ein Plagiat, handelt.
- Aus diesem Grunde gibt es eine Reihe von Methoden zur Authentifizierung von Produkten auf dem Vertriebsweg, bei denen in der Regel zunächst ein Code erstellt wird, wie es beispielsweise in der
WO 03/007252 A1 - Hier hilft dem Fachmann auch nicht die Tatsache, dass es beispielsweise aus der
DE 199 41 362 A1 bekannt ist, einen Datenträger mit einer den darauf angebrachten Code verbergenden Abdeckung zu versehen, um diesen Code (nach Entfernen der Abdeckung, z.B. einer Rubbelschicht) nur dem berechtigten Benutzer zu offenbaren. In dieser Schrift ist lediglich ein Datenträger mit einer entfernbaren Abdeckung, z.B. zum Verbergen von Pin-Codes durch unberechtigte Dritte beschrieben. - Die
DE 199 45 760 A1 hat ein Prüfsystem zum Prüfen eines Gegenstandes auf seine Herkunft aus einer angenommenen Herkunftsquelle zum Gegenstand, wobei der Gegenstand mit mindestens einer von einem Erkenner erkennbaren Markierung versehen ist und die vom Erkenner erkannte Markierung mit die Herkunftsquelle individualisierenden Merkmalen vergleichbar ist. Auch dieses Prüfsystem ist nicht fälschungssicher und bleibt hinter dem oben (unter Bezugnahme auf dieWO 03/007252 A1 - Die
DE 198 38 913 A1 hat ein Verfahren zur Orginalitätsprüfung eines Erzeugnisses zum Gegenstand, bei welchem ein hierfür spezifischer Zufallskode auf einem als Etikett ausgebildeten Datenträger angebracht wird, welcher in einem Datenspeicher, bei dem es sich auch um eine öffentlich zugängliche Datenbank handeln kann, gespeichert wird. Dieser Code kann von einem Dritten abgelesen und in den Datenspeicher eingegeben werden. Worauf auf Grund eines Vergleichs dieses eingegebenen Codes mit den in der Datenbank gespeicherten Codes aller Produkte einer Serie die Datenbank eine Ausgabe dahingehend erzeugt, ob der angegebene Code mit einem gespeicherten Code identisch ist/oder vorher bereits abgefragt wurde. Ein ähnliches Verfahren und Prüfsystem ist derDE 199 45 760 A1 zu entnehmen. - Völlig unabhängig von den vorab beschriebenen Prüfsystemen mit Datenbanken zeigt die
EP 1 176 562 A2 ein Verfahren zur Verhinderung der Produktpiraterie, insbesondere zur Authentifizierung eines einzelnen Produkts aus einer Serie, unter Verwendung einer offiziellen Banknote einer staatlichen Notenbank. Bei diesem Verfahren wird ein Gegenstand mit der Banknote versehen und zusätzlich mindestens ein Teil der Seriennummer dieser Banknote physisch auf dem Gegenstand selbst oder einem mit diesem fest verbundenen Etikett angebracht. Die der genannten Druckschrift zugrunde liegende Idee besteht darin, dass ein Fälscher, der das Etikett kopiert, in der Regel nicht zufällig die passende Banknote dazu haben wird (Abschnitt [0026] der Beschreibung). Die in der genannten Druckschrift beschriebene Idee liegt somit darin, die Seriennummer der Banknote zumindest teilweise auf dem Gegenstand oder dessen Etikett zu kopieren und einen Vergleich der Seriennummer der Banknote mit der des Etiketts anzustellen. Nachteilig ist hierbei, dass der Fälscher, ausgehend von einem Satz Banknoten, ohne weiteres entsprechende, gefälschte Etiketten herstellen kann und das eine Überprüfung und Verifikation über eine Datenbank nicht stattfindet. Diese ist bei dem beschriebenen Verfahren auch nicht notwendig, da sich dieses in dem Vergleich der Seriennummer der Banknote mit der auf dem Gegenstand bzw. dessen Etikett aufgebrachten Nummer erschöpft. - Damit bieten die bestehenden Möglichkeiten zwar dem Markenhersteller einen gewissen Überblick über den Vertriebsweg, sofern die daran Beteiligten die Nummern bzw. Codes regelmäßig abfragen. Die Systeme bieten jedoch keine ausreichend sichere Möglichkeit, für die Beteiligten des Vertriebswegs, insbesondere den Endkunden, sicher zu stellen, ob sie ein Originalprodukt oder ein Plagiat erworben haben. Dies gilt insbesondere auch für den Gegenstand der
EP 1 176 562 A2 , da es leicht möglich ist, Etiketten mit bestimmten Banknotennummern zu fälschen. - Es besteht daher die Aufgabe, ein Verfahren zur Authentifizierung so weiterzubilden, dass mit höchstmöglicher Sicherheit Originale von Plagiaten unterschieden werden können und ein entsprechendes Produkt zur Verwendung in einem derartigen Verfahren bereitzustellen.
- Gelöst wird diese Aufgabe mit den Merkmalen der Ansprüche 1 bzw. 5. Vorteilhafte Ausgestaltungen sind den jeweiligen Unteransprüchen entnehmbar.
- Ein Ausführungsbeispiel der Erfindung wird im folgenden näher erläutert.
- Das erfindungsgemäße Verfahren baut prinzipiell auf einem Verfahren auf, wie es in der Beschreibungseinleitung dargestellt ist.
- Der Markenhersteller erzeugt jedoch selbst keinen Code und auch kein diesen Code tragendes Etikett, sondern verwendet als Datenträger Banknoten einer staatlichen Notenbank und als Code die ohnehin auf diesen Banknoten vorgesehenen Seriennummern, die aufgrund der notwendigen Unterscheidbarkeit der Banknoten absolut einmalig sind. Diese Seriennummern bestehen beispielsweise aus einer Zahlen- und/oder Buchstabenfolge oder aus anderen sichtbaren und der Datenverarbeitung zugänglichen Zeichen. Der Code ist bei allen staatlichen Banknotensystemen ausreichend lang und komplex, um sicherzustellen, dass er nur mit ausreichend geringer Wahrscheinlichkeit zufällig von einem Dritten benutzt wird. Die Banknote, deren Wert selbstverständlich wesentlich geringer gewählt wird als der Wert des Produkts, wird von dem Markenhersteller dem Produkt beigefügt, beispielsweise in seine Verpackung gegeben, auf seine Verpackung aufgebracht, oder mit dem Produkt oder der Verpackung lösbar verbunden, was zweckmäßig durch Kleben, Nähen, Tackern oder Nieten erfolgen kann.
- Wie bereits aus dem Stand der Technik bekannt, führt der Markenhersteller eine öffentlich zugängliche, beispielsweise im Internet abrufbare, Datenbank für die Serie. Diese enthält die Codes (also die Serien nummern der verwendeten Banknoten) jedes einzelnen Markenprodukts. Ferner ist die Datenbank vorzugsweise in der Lage, bei einem Abruf der Codes eine Marke zu setzen, die angibt, ob der Code bereits einmal abgerufen wurde. Auch diese Information kann bei einem erneuten Abrufen der Datenbank ausgegeben werden. Die Datenbank kann in an sich bekannter Weise gegen "Hacker" geschützt sein, z.B. durch einen Zugriffscode.
- Ist das Produkt im Handel und wurde es von einem Kunden erworben, kann dieser den Code, also die Seriennummer der dem Produkt beigefügten Banknote, in an sich bekannter Weise in die öffentlich zugängliche Datenbank eingeben.
- Daraufhin erhält der Kunde als Rückmeldung der Datenbank beispielsweise, dass der Code nicht für ein Original-Produkt vergeben wurde. Es handelt sich dann um ein gefälschtes Produkt, dem vermutlich eine echte Banknote beigefügt wurde.
- Eine andere Rückmeldung der Datenbank könnte darin bestehen, dass der Code zwar für ein Original-Produkt vergeben, jedoch bereits mindestens einmal abgefragt wurde. In diesem Fall ist mit großer Wahrscheinlichkeit von einer Fälschung sowohl des Produkts als auch der Banknote auszugehen. Es kann zwar nicht ganz ausgeschlossen werden, dass es sich um ein Original handelt, wenn die gefälschte Nummer zuerst von einem Dritten abgerufen wurde. Dies ist jedoch sehr unwahrscheinlich, da die Originalnummer jeweils nur einmal existiert, jedoch identische, gefälschte Nummern häufig existieren werden. Der Fälscher hat sich in diesem Fall der Geldfälschung schuldig gemacht weshalb der Eintritt des Falls eher unwahrscheinlich ist.
- Schließlich kann die Datenbank eine Rückmeldung dahingehend ausgeben, dass der Code für ein Original-Produkt vergeben und noch nicht abgefragt wurde. Es handelt sich in diesem Fall mit höchster Wahrscheinlichkeit um ein Original-Produkt mit einer Original-Banknote.
- Die Banknote wird dem Produkt in geeigneter Weise beigefügt, z.B. in seiner Verpackung gebracht, so dass die Seriennummer nicht sofort erkennbar ist oder an dem Produkt oder seiner Verpackung befestigt. Als Befestigungsmethoden bieten sich Kleben (durch Haftkleber oder Klebestreifen), Nähen, Tackern oder Nieten an, wobei auch alle anderen Befestigungsmöglichkeiten in Betracht kommen. Nähen wird insbesondere bei textilen Materialien und Schuhen in Betracht kommen.
- Vorzugsweise wird die Banknote so an dem Produkt oder seiner Verpackung befestigt, dass sie davon ablösbar ist und anschließend wieder als Zahlungsmittel Verwendung finden kann.
- Gegenstand der Erfindung ist neben dem beschriebenen Verfahren auch ein Produkt aus einer Serie, dem eine Banknote beigefügt ist bzw. an dem die Banknote befestigt ist, sowie die beschriebene Verwendung einer Banknote zum Zwecke der Authentifizierung eines Produkts aus einer Serie.
- In einer bevorzugten Ausgestaltung der Erfindung weist die Ausgabe der Datenbank auf Eingabe der Seriennummer auch Merkmale des Produkts, z.B. dessen Größe, Farbe, Modell oder Bauart und/oder eine oder mehrere Fotografische Darstellungen des Produkts auf. Ferner kann die Datenbank in an sich bekannter Weise protokollieren ob, wie oft, wann und von welcher IP-Adresse aus der Code oder ein anderer eigener Code bereits abgefragt wurde was wiederum Rückschlüsse auf die Distribution eines Produkts und eventuelle Piraterieware zulässt. Besonders hervorzuheben ist das Internet als Zugangsmedium zu der Datenbank des Herstellers, da dort ein Domainname - in der Regel der des Herstellers - nur einmal vergeben wird und es für den Käufer transparent und ersichtlich ist, dass er auf der richtigen Domain ist, und nicht auf der eines Fälschers.
- Die Befestigung der Banknote auf dem Produkt erfolgt vorzugsweise in einer Art und Weise die das beschädigungslose oder jedenfalls weitgehend Ablösen der Banknote ermöglicht, um die Banknote wieder als Zahlungsmittel einsetzen zu können. Im Falle einer Abstimmung mit einer Notenbank können für eine Firma oder Produktserie Banknoten mit fortlaufender Nummerierung und/oder gleichen Anfangszahlen- bzw. -buchstaben eingesetzt werden, so dass eine unmittelbare Zuordnung von der Banknote auf den Markenhersteller möglich ist.
- Ein besonderer Vorteil des beschriebenen Verfahrens bzw. Produkts besteht schließlich in der Materialersparnis. Es ist nicht mehr nötig, eigens aufwändige Etiketten, Hologramme oder andere Sicherungsmechanismen herzustellen, sondern man greift einfach auf handelsübliche und gleichzeitig maximal sichere Banknoten zurück.
Claims (8)
- Verfahren zur Authentifizierung eines einzelnen Produkts aus einer Serie, welchem mindestens ein hierfür spezifischer Code auf einem Datenträger zugeordnet wird, dieser Code in einer öffentlich zugänglichen Datenbank gespeichert wird, von einem Dritten abgelesen und in die Datenbank eingegeben wird, und aufgrund eines Vergleichs des eingegebenen Codes mit den in der Datenbank gespeicherten Codes aller Produkte der Serie die Datenbank eine Ausgabe dahingehend erzeugt, ob der Code mit einem gespeicherten Code identisch ist und/oder vorher bereits abgefragt worden ist, dadurch gekennzeichnet, dass der Datenträger eine offizielle Banknote einer staatlichen Notenbank ist und der Code deren offizielle Seriennummer ist.
- Verfahren nach Anspruch 1, dadurch gekennzeichnet, dass die Banknote mit dem Produkt oder seiner Verpackung, z.B. durch Kleben, Nähen, Tackern oder Nieten verbunden ist.
- Verfahren nach Anspruch 2, dadurch gekennzeichnet, dass die Banknote lösbar mit dem Produkt oder seiner Verpackung verbunden ist wodurch sie nach Lösung wieder als Zahlungsmittel verwendbar ist.
- Verfahren nach einem der voranstehenden Ansprüche, dadurch gekennzeichnet, dass die Ausgabe der Datenbank Detailinformationen über das Produkt enthält dessen spezifischer Code eingegeben wurde, z.B. das genaue Modell, die Größe, Farbe und/oder eine oder mehrere bildliche Darstellungen.
- Verwendung einer mit einer offiziellen Seriennummer ausgestatteten offiziellen Banknote einer staatlichen Notenbank bei einem Verfahren zur Authentifizierung eines einzelnen Produkts aus einer Serie, welchem die Seriennummer der Banknote zugeordnet wird, diese in einer öffentlich zugänglichen Datenbank gespeichert wird, von einem Dritten abgelesen und in die Datenbank eingegeben wird, und aufgrund eines Vergleichs der eingegebenen Seriennummer mit den in der Datenbank gespeicherten Seriennummern aller Produkte der Serie die Datenbank eine Ausgabe dahingehend erzeugt, ob die Seriennummer mit einer gespeicherten Seriennummer identisch und/oder vorher bereits abgefragt worden ist.
- Verwendung nach Anspruch 5, dadurch gekennzeichnet, dass die Banknote mit dem Produkt oder seiner Verpackung, z.B. durch Kleben, Nähen, Tackern oder Nieten verbunden ist.
- Verwendung nach Anspruch 6, dadurch gekennzeichnet, dass die Banknote lösbar mit dem Produkt oder seiner Verpackung verbunden ist, wodurch sie nach Lösung wieder als Zahlungsmittel verwendbar ist.
- Verwendung nach einem der Ansprüche 5 - 7, dadurch gekennzeichnet, dass die Ausgabe der Datenbank Detailinformationen über das Produkt enthält, dessen Seriennummer eingegeben wurde, z.B. das genaue Modell, die Größe, Farbe und/oder eine oder mehrere bildliche Darstellungen.
