"ENERGY SAVING CHIMNEY CAP ASSEMBLY"
ABSTRACT OF THE DISCLOSURE
Even when no fire is burning in a grate, there is a consistent heat loss from the house through the chimney.
Attemps have been made to detachably seal the chimney at the upper end thereof but condensation and freezing often occurs in cold climates tending to cause an ice seal to form between the closure plate and the seat thus making it difficult to open when it is desired to use the fireplace.
The present device consists of a cap assembly engageable within the upper end of the chimney having a seat on the main body portion and disc or plate secured to a rod mov-able vertically. It may be actuated from a sealed seat en-gaging position to an open seat disengaging position and the plate is normally maintained open by means of a spring.
Actuation is by means of a cable attached to a rod which extends downwardly to the fireplace. An asbestos seal is provided to reduce icing but also, when closed against pressure of the spring, the disc "oilcans" downwardly so that, when released, the oilcanning action assists in breaking any ice which may have formed on the seal.

~ACKGROUND OF THE INVENTION
This invention relates to new and useful improvements in chimney cap assemblies, particularly chimney cap assemblies designed for use with open fireplaces and the li~e although of course it will be appreciated that it can be used with any chimney construction.
It is well known that when no fire is burning in a fireplace, considerable heat losses occur up the chimney from the house or room due to the heat from the room rising through the chimney. Also, under certain circumstances, par-ticularly in relatively cold areas, a column of cold air can descend the chimney and cause a cold draft to occur, depending upon the direction of the wind and surrounding str-uctures.
Attemps have been made to detachably seal the upper end oE the chimney when a fire is not burning but these often freeze in the closed position due to condensation and icing occurring particularly in cold climates and such free~ing :Ls often not noticed untLl a f:Lre is lit and smoke carmot escape throLIgh the chimney.
SUMMARY OF TH¢ INVENTION
The present invention overcomes these disadvantages by providing a device which is easily attached to existing chimney structures and which can be operated remotely in the vicinity of the fireplace and in accordance with the invention there is provided a chimney cap assembly engageable with the
2 8 ~ 5 upper end oE a chimney venting a fireplace or the like; comprising in combination a main body portion engageable with the upper end of the chimney, a cover, means to ma~ntain the cover in open sided spaced relationship above said body portion, a closure plate between said cover and the upper end of said body portion, means to move said closure plate vertically from a body portion engaging closed posltion to an open position spaced upwardly from said body portion and vice versa, a spring operatively connected between said closure plate and said cover normally urging said closure plate to the open position, means adjacent the fireplace and operatively connected to said plate, to de-tachably secure said plate in the closed position against pres-sure of said spring and means to mount said plate for said vertical movement.
Another advantage of the present invention is to provide a closure disc which may be provided with an "oilcanning"
effect so that when the closure plate is released, the oilcanning tends to break away any ice which may have Eormed although, with the seal provided, such formation is remote.
A still further advantage of the invention is to provide a devlce of the character herewithln described which is simple in construction, economical in manufacture and otherwise well suited to the purpose for which it is designed.

DETAILED DESCRIPTION
Proceeding therefore to describe the invention in detail, reference should first be made to Figure 1 in which 10 illustrates generally, the main body portion which may be either rectangular or circular in configuration depending upon the configuration of the chimney to which khe device is to be attached. In the present drawings, it is assumed to be _ 1 17289~

circular and consists of a cylindrical sleeve 11 having an upper end 12 and a lower end 13 by which it can be engaged within the upper end of a chimney and retained frictionally in position.
A plurality of straps 14 are secured by the lower ends thereof as by rivets 15 (or welding) equidistantly around the outer surface of the main body portion and these straps extend upwardly and outwardly terminating in attaching ends 16 by which they are secured to a cap or cover 17 which may be square or rectangular and which is provided with a down turned lip 18 to act as a rain cap for the assembly.
A closure plate 19 is provided, the shape of which is similar to the cross sectionalconfiguration of the main body portion 10. In the present instance, it is in the form of a disc and is made from a material which has sufficient resiliency to permit oilcanning as will hereinafter be de-scribed.
It is adapted to engage over the upper end of the main body portion 10 when in the closed position and to seal off same from the exterior thus sealing the chimney into which the device is inserted. An annular seal ring 20 is secured to the underside of the disc around the perimeter thereof and although other materials can be used, it has been found that asbestos is an excellent seal as it is not prone to freezing due to condensation when used in relatively cold climates.
A rod 21 is secured centra]ly of the closure plate ~`- 1 17~g5 19 and extends vertically downwardly therefrom. Washers 22 are provided on each side of the closure plate and surround the rod which may be welded in position or otherwise secured with a relatively short portion 23 extending upwardly from the plate and being secured to a small bracket 24 which in turn is secured to one end of a relatively heavy ~ension spring 25, with the other end of the tension spring being anchored to an anchor 26 centrally of the underside of the rain cap 17 so that this spring normally maintains the closure plate 19 in the raised or open position illustrated in Figure 1.
Means are provided to mount the rod 21 for vertical movement and in this embodiment take the form of a cross strap 27 extending across the interior of the casing or main body portion 10, said strap being apertured to bearingly mount the rod for vertlcal movement therein. A stirrup type strap 28 is secured by the ends thereof to strap 27 by means of rivets 29 or welding or the like and the cross piece 30 of this stirrup is spaced below the strap 27 and the rod 21 bearingly engages an aperture w:Lth:Ln this cross piece thus providing a spaced apart mounting for the rod and maintaining same in t'ne vertlcal position.
Within the fireplace area 31, there is mounted a mounting plate 32 having a lever 33 pivoted by one end thereof to the plate as shown by pivot 34. A flexible cable 35 extends from the lower end 36 of the rod 21, with the lower end of the cable passing downwardly through the chimney and being 3l 1 rj~ 2 ~3 9 ~

anchored to the lever 33 adjacent the distal end 3~A there-o~. A small shock absorber spring 37 may be provided be-tween the upper end of the cable and the lower end of the rod.
With the closure disc 19 in the released position shown in Figure 1, the lever is in the uppermost position against stop 38 extending from the plate 32, it being under-stood that the closure disc 19 is being maintained in the uppermost or open position by means of spring 25 thus pro-viding sufficient opening for smoke and exhaust gases to pass upwardly through the flue or chimney, through the hous-ing 10 and outwardly from under the rain cap between the strap 14.
However when no fire is burning and it is desired to close off the chimney or flue, the lever 33 is moved downwardly and over a stop 39 to a position shown in phan-tom in Figure 5 th~ls moving the rod 21 and the disc down-wardly against pressure oE spring 25. Under these circum-stances, the seal 20 engages the upper end 12 o~ the main housing 10 in a sealing relationship and the length of the rod and cable 3S is adjusted so that when in the lowermost position, additional pressure is placed upon rod 21 thus causing the central portion of the closure disc l9 to de-flect downwardly relatively to the perîmeter thereof to a position shown in exaggerated form in Figure 1 thus causing the aforementioned oilcanning effect. When released, this - ~ 17~9~

oilcanning returns the disc to the original position and Elexes the seal and perimeter sufficiently to crac~ any ice which may have formed between the seal 20 and the upper end of the main body portion 10 whereupon spring 25 may return the disc to the open or released position.
Spring 25 preferably consists of flat coil springs anchored centrally to the upper side of the disc 19 and being coiled around pins 2SA with the ends secured to these pins which are located centrally of the cap 17 as hereinbefore described.
Since various modifications can be made in my invention as hereinbefore described, and many apparently widely different embodiments of same made within the spirit and scope of the claims without departing from such spirit and scope, it is intended that all matter contained in the accompanying specification shall be interpreted as illus-trative only and not in a limiting sense.

Claims

CLAIMS:
(1) A chimney cap assembly engageable with the upper end of a chimney venting a fireplace or the like; comprising in combination a main body portion engageable with the upper end of the chimney, a cover, means to maintain the cover in open sided spaced relationship above said body portion, a closure plate between said cover and the upper end of said body portion, means to move said closure plate vertically from a body portion engaging closed position to an open position spaced upwardly from said body portion and vice versa, a spring operatively connected between said closure plate and said cover normally urging said closure plate to the open position, means adjacent the fireplace and operatively connected to said plate, to detach-ably secure said plate in the closed position against pressure of said spring and means to mount said plate for said vertical movement.
(2) The assembly according to Claim 1 in which said means to mount said plate for vertical movement includes a rod secured by one end thereof centrally of said plate and extending downwardly therefrom, means to mount said rod within said body portion for vertical movement, said plate being flexi-ble sufficiently to allow downward movement of the central area thereof relative to the perimeter thereof when said peri-meter is engaged with the upper end of said body portion and additional downward pressure is applied to said rod and to regain the normal position when said additional pressure is removed thereby causing an oilcanning effect to said plate.
(3) The assembly according to Claim 1 in which said means to mount said cover includes a plurality of straps extending upwardly and outwardly from said body por-tion to said cover.
(4) The assembly according to Claim 2 in which said means to mount said cover includes a plurality of straps extending upwardly and outwardly from said body por-tion to said cover.
(5) The assembly according to Claim 2 in which said means to mount said rod for vertical movement includes a pair of spaced apart cross member spanning said body por-tion, said rod passing freely through said cross members and being maintained vertically thereby.
(6) The assembly according to Claim 4 in which said means to mount said rod for vertical movement includes a pair of spaced apart cross member spanning said body por-tion, said rod passing freely through said cross members and being maintained vertically thereby.
(7) The assembly according to Claim 1 which in-cludes a flexible seal around the underside of the peri-meter of said plate sealably engaging with the upper side of said main body portion when said plate is in the closed position (8) The assembly according to Claim 2 which in-cludes a flexible seal around the underside of the peri-meter of said plate sealably engaging with the upper side of said main body portion when said plate is in the closed position.
(9) The assembly according to Claim 3 which in-cludes a flexible seal around the underside of the peri-meter of said plate sealably engaging with the upper side of said main body portion when said plate is in the closed position.
(10) The assembly according to Claim 4 which in-cludes a flexible seal around the underside of the peri-meter of said plate sealably engaging with the upper side of said main body portion when said plate is in the closed position.
(11) The assembly according to Claim 5 which in-cludes a flexible seal around the underside of the peri-meter of said plate sealably engaging with the upper side of said main body portion when said plate is in the closed position.
(12) The assembly according to Claim 6 which in-cludes a flexible seal around the underside of the peri-meter of said plate sealably engaging with the upper side of said main body portion when said plate is in the closed position.
(13) The assembly according to Claims 1, 2 or 3 in which said means adjacent said fireplace operatively connected to said plate to detachably secure said plate in the closed position against pressure of said spring includes a lever movable from a detachable locked position whereby said plate is in the closed position, to a release position whereby said plate is in the open position and a flexible cable extending from said lever and being operatively con-nected to said plate.
(14) The assembly according to Claims 4, 5 or 6 in which said means adjacent said fireplace operatively con-nected to said plate to detachably secure said plate in the closed position against pressure of said spring includes a lever movable from a detachable locked position whereby said plate is in the closed position, to a release position whereby said plate is in the open position and a flexible cable extending from said lever and being operatively con-nected to said plate.
(15) The assembly according to Claims 7, 8 or 9 in which said means adjacent said fireplace operatively con-nected to said plate to detachably secure said plate in the closed position against pressure of said spring includes a lever movable from a detachable locked position whereby said plate is in the closed position, to a release position whereby said plate is in the open position and a flexible cable extending from said lever and being operatively con-nected to said plate.
(16) The assembly according to Claims 10, 11 or 12 in which said means adjacent said fireplace operatively con-nected to said plate to detachably secure said plate in the closed position against pressure of said spring includes a lever movable from a detachable locked position whereby said plate is in the closed position, to a release position whereby said plate is in the open position and a flexible cable extending from said lever and being operatively con-nected to said plate.
