专利信息管理的方法和装置 技术领域
本公开涉及信息管理领域，尤其涉及一种专利信息管理的方法和装置。
背景技术
在提案人提出专利申请时，为了确保提出的专利申请的创造性，对于新提出的专利申请，在进行提案时往往需要进行检索，在进行专利检索时，提案人一般需要通过专门的检索引擎进行检索。而大多数检索引擎都需要用户具有一定的检索技能才能进行相应的检索，检索过程比较复杂，因此很多提案人根本不愿意做检索。
发明内容
本发明提供一种专利信息管理的方法和装置，解决在进行专利提案时，根据输入的专利提案信息进行专利检索。
为了实现上述目的，根据本公开实施例的第一方面，提供一种专利信息管理的方法，包括：获取用户在专利提案界面上输入的专利提案信息；所述专利提案信息包括所述用户提出的专利申请的相关信息；根据所述专利提案信息生成专利检索要素信息；根据所述专利检索要素信息进行检索处理，得到对应的检索结果并输出。
可选地，所述根据所述专利提案信息生成专利检索要素信息包括：仅在满足预设条件时，根据所述专利提案信息生成专利检索要素信息；其中，所述预设条件包括如下任意一种或者任意几种；所述专利提案信息的字符数量大于或者等于预设数量；所述专利提案信息包括预设信息类型指示的信息；获取到用户输入的检索指令。

采用上述技术方案，在获取到用户在专利提案界面上输入的专利提案信息后，根据该专利提案信息生成专利检索要素信息，并根据该专利检索要素信息进行专利检索，得到检索结果，这样，能够根据提案人的提案信息为提 案人进行相关的专利检索，并且由于在提案时，提案人本身就需要输入专利提案信息，因此，本发明在实现检索的同时，不会增加提案人的工作量，且无需提案人具有一定的检索技能。

目前企业往往通过专利管理软件对企业的专利进行管理，现有的专利管理软件一般都会支持提案管理功能，即提案人通过该专利管理软件填写专利申请的相关信息，以便由企业的专利工程师对提案人提出的专利申请进行审核，具体来说，向提案人展示的界面包括提案人进行提案的按钮，当提案人点击该按钮时，会进入到一个提案界面，在该提案界面中填写要提案的信息。 一般来说，这些提案信息，会包含技术领域，具体方案，应用场景等，还会出现关键词输入框，要求提案人在提案时输入关键词。
在实现本发明的过程中，本发明的发明人发现，这些信息恰恰可以作为检索要素实现相应的检索过程，这样在用户输入提案信息时，就可以实现相应的检索过程。基于此，本发明提供一种专利信息管理的方法和装置，该方法能够通过用户在专利提案界面上输入的专利提案信息，生成专利检索要素信息，并根据该专利检索要素信息进行检索，这样，本发明能够根据提案人的专利提案信息为提案人进行相关的专利检索，并且由于在提案时，提案人本身就需要输入专利提案信息，因此，本发明在进行专利提案时，能够根据专利提案信息进行检索，不会增加提案人的工作量，且无需提案人具有一定的检索技能。
下面结合具体的实施例对本发明进行详细的说明。
图1为本发明实施例提供的一种专利信息管理的方法，如图1所示，该方法可以应用于专利提案客户端，该方法包括：
S101、获取用户在专利提案界面上输入的专利提案信息。
其中，该专利提案界面用于获取用户输入的专利提案信息，该专利提案信息可以包括该用户提出的专利申请的相关信息，例如，该专利提案信息可以包括提案的技术领域，技术关键词，应用场景等信息，当然，这里的专利提案信息只是举例说明，本发明对此不作限定，其他与该提出的专利申请的相关的信息也可以，例如，该专利提案信息还可以包括提案的申请人和/或发明人信息、提案所应用的产品或者项目等信息。
在本步骤中，该专利提案界面可以向用户展示专利提案信息的输入区域，用户在该输入区域中输入专利提案信息，由于该专利提案信息往往是由发明人进行输入的，而发明人可能并不了解相关的专利知识，因此，用户输入的专利提案信息可能并不能够准确反应提出的专利申请的相关信息，基于此， 在本公开另一实施例中，该专利提案界面展示的专利提案信息的输入区域可以通过提示信息提示用户输入，示例地，该提示信息可以包括预设信息类型，用于提示用户按照预设信息类型输入对应的信息，相应地，该专利提案信息的输入区域可以包括预设信息类型的输入提示和该预设信息类型的输入区域，例如，如图2所示，图2示出了一种专利提案界面的示意图，该界面包括该专利提案信息的输入区域和创意发布区域，其中，该专利提案信息的输入区域用于输入提案的基本信息(如提案人信息或者提案的技术关键字，技术领域或者应用场景等信息)，创意发布区域用于输入详细的技术方案，以帮助专利工程师理解该提案。在图2所示的示例中，该专利提案信息的输入区域可以包括：技术领域的输入提示21以及技术领域的输入区域22，技术关键词的输入提示23以及技术关键词的输入区域24，应用场景的输入提示25以及应用场景的输入区域26，这样，用户根据不同的预设信息类型的输入提示在对应的输入区域中输入相关的信息，如，用户根据技术领域的输入提示21在技术领域的输入区域22中输入提案的技术领域，用户根据技术关键词的输入提示23在技术关键词的输入区域24中输入提案的技术关键词，用户根据应用场景的输入提示25在应用场景的输入区域26中输入提案的应用场景，这样，能够帮助用户进行专利提案信息的输入，从而获得准确的专利提案信息，提高了获取的专利提案信息的价值。

其中，由于专利的检索结果与生成的专利提案信息有关，而专利提案信息是由步骤S101中获取到的专利提案信息生成的，因此，在步骤S101中获取到的专利提案信息的内容越多，则生成的专利检索要素信息也越多，得到的检索结果越准确。
因此，在本发明一种可能的实现方式中，在步骤S101中用户输入的专利提案信息可以包括技术关键词，这样，在本步骤中，可以从该专利提案信 息中提取该技术关键词，并根据提取的技术关键词生成该专利检索要素信息。从而在后续检索时，根据专利检索要素信息中的技术关键词进行检索，能够准确检索到与该用户提出的专利申请技术相关度最高的专利文件，
在本发明另一种可能的实现方式中，该专利提案信息还可以包括专利申请人的申请人和/或发明人信息，则根据该专利提案信息生成的专利检索要素信息也包括该专利申请的申请人和/或发明人信息，如图3所示，在图3所示的专利提案界面中，还包括申请人提示信息31和申请人输入区域32，以及发明人提示信息33和发明人输入区域34，用户只需要在相关区域输入对应的发明人和审核人信息即可，从而在后续检索时，可以根据该专利申请的申请人和/或发明人信息进行检索，使得检索到与该专利申请的申请人和/或发明人相关的文件，提高检索结果的准确度。
在本步骤中，可以仅在满足预设条件时，根据该专利提案信息生成专利检索要素信息；其中，该预设条件包括如下任意一种或者任意几种；
条件一：该专利提案信息的字符数量大于或者等于预设数量。
其中，该字符可以是用户输入的文字，在本实施例中，该预设数量可以设置为组成具有实际语义需要的文字的数量，例如，以中文输入为例，由于常见的中文词组至少由两个文字组成，因此，该预设数量可以设置为2，从而在用户输入该专利提案信息的过程中，当用户输入了两个字符时，则满足该条件一。又如，该预设数量也可以设置为1，即在检测到用户输入一个字符时，就满足该条件一，从而提高检索的敏感度。
条件二：该专利提案信息包括预设信息类型指示的信息。
示例地，若该预设信息类型指示的信息为提案的技术领域、技术关键词以及应用场景，则仅当用户输入的专利提案信息包括技术领域、技术关键词以及应用场景的相关信息时，才满足条件二，若用户输入的专利提案信息不完全包括上述技术领域、技术关键词以及应用场景，例如只包括技术领域和 技术关键词的信息，或者只包括技术领域和应用场景的信息，则不满足条件二。
条件三：获取到用户输入的检索指令。
这里，可以在专利提案界面上设置一个检索按钮，如将该检索按钮设置在与该专利提案信息的输入区域相邻的位置，以方便用户在输入专利提案信息时，注意到该检索按钮；如图4所示，在图4示出的一种示例性地专利提案界面中包括一检索按钮41，仅在用户触发(如点击)这个检索按钮后，才满足该条件三，这样能够使得用户可以自主选择是否进行检索，避免自动检索引起用户的反感。
这样，在满足上述预设条件后，即可生成专利检索要素信息。
需要说明的是，在该预设条件为条件一和/或条件二时，可能在满足条件一和/或条件二时，用户对专利提案信息的输入还未完成，此时，则可以继续根据用户后续输入的信息与用户之前输入的全部信息生成新的专利检索要素信息。
另外，在该预设条件为条件一和条件三，或者条件二和条件三，或者条件一和条件二以及条件三时，此时，可能在满足条件三时，还不满足条件一或者条件二，则在本实施例中，可以通过提示消息提示用户继续输入信息以满足条件一或者条件二，例如，当用户点击检索按钮后(即满足条件三)，可能用户输入的字符数量还未达到预设数量(即不满足条件一)，或者，可能用户输入的专利提案信息还不完全包括预设信息类型指示的信息(即不满足条件二)，则可以向用户展示输入提示信息，以提示用户继续在专利提案界面上输入专利提案信息，并通过步骤S101继续获取该用户输入的专利提案信息，直至满足预设条件后，根据用户输入的专利提案信息生成专利检索要素信息。
其中，该输入提示信息可以以提示框的形式展示给用户，用于提示用户 哪些信息还需要完善，该输入提示信息还可以是在用户未填写或者填写不完全的区域进行反色设置，即将用户未填写或者填写不完全的区域的颜色设置为与专利提案界面的背景色不同的颜色，以方便用户感知到该区域，使得用户准确获知还需要补充的信息。上述输入提示信息只是举例说明，本发明对此不作限定。
S103、根据该专利检索要素信息进行检索处理，得到对应的检索结果并输出。
在得到该专利检索要素信息后，本步骤中的检索处理可以进行以下两方面中的任一方面的处理：一方面，通过专利检索引擎进行检索处理，另一方面，为了避免隶属于同一局域网内的特定用户之间，对相同专利申请的重复提案，可以通过该局域网内设置的本地服务器进行检索处理。
在通过该局域网内设置的本地服务器进行检索处理的情况下，在本发明一种可能的实现方式中，该检索处理可以包括：向本地服务器发送专利检索请求消息，该专利检索请求消息包括该专利检索要素信息，该本地服务器存储有特定用户在该专利提案界面上输入的历史专利提案信息，以便该本地服务器根据该专利检索要素信息在该历史专利提案信息中进行检索，得到该检索结果；并接收该本地服务器发送的专利检索响应消息，该专利检索响应消息包括该检索结果。
示例地，该特定用户可以是一个企业内部的用户，该企业内部可能存在多个提案人，当该企业内部的一个用户通过该专利提案界面进行提案后，可以将该提案的专利提案信息保存到本地服务器中，即为历史专利提案信息。这样，在其他用户进行专利检索时，能够根据得到的专利提案信息在本地服务器中存储的历史专利提案信息进行检索，从而使得用户根据检索结果确定当前提案是否已经被提出过。
另外，用户还可以通过在本地服务器上的检索获知与提出的专利申请相 关的专利布局信息，例如，仍然以上述一个企业内部的用户为例进行说明，如图5所示，上述专利提案界面还可以包括用户所属部门的输入区域，应用产品的输入区域以及提出的专利申请所属项目名称的输入区域，该企业内部的用户在提案时还可以输入提出的专利申请所应用的产品或者项目名称以及该用户所属的部门，如用户所属部门为硬件部门，则在所属部门的输入区域输入“硬件”；提出的专利申请所应用的产品为手机，则在应用产品的输入区域输入“手机”；提出的专利申请的所属项目为无线安全，则在所属项目名称的输入区域输入“无线安全”，上述输入的信息只是举例说明，这里不作限定，这样，在获取到输入的产品或者项目名称以及用户所属的部门时，通过本地服务器进行检索处理，得到检索结果，则用户根据该检索结果，可以获知该用户所属的部门中与该专利申请相关的专利布局信息，该专利布局信息可以是：针对该项目或者产品所布局的专利的数量，细分领域，提案人，进展等多个信息，当然，由于专利布局信息可能涉及企业的研发机密，因此，在本发明另一实施例中，该专利布局信息可以根据用户的权限向用户进行展示，如领导的权限和普通员工的权限不同，则该专利布局信息向领导展示的内容和向普通员工展示的内容也不相同。
在通过专利检索引擎进行检索处理的情况下，在本发明一种可能的实现方式中，该检索处理可以包括：向专利检索引擎发送专利检索请求消息，该专利检索请求消息包括该专利检索要素信息，以便该专利检索引擎根据该专利检索要素信息进行检索得到该检索结果；并接收该专利检索引擎发送的专利检索响应消息，该专利检索响应消息包括该检索结果。
其中，专利检索引擎在进行检索时，可以根据专利检索要素信息得到检索条件进行检索，例如，可以用技术领域确定分类号，利用技术关键词确定技术内容。
在本实施例中，该专利检索要素信息还可以包括专利申请的申请人和/ 或发明人信息，示例地，在得到该专利申请的申请人和/或发明人信息后，根据该申请人信息和/或发明人信息获取关联申请人的关联信息；其中，该关联申请人为与该专利申请人关联的申请人，并根据该关联信息进行检索处理，得到该检索结果。
其中，可以预先设置与该申请人信息和/或发明人信息对应的关联申请人，则在得到该申请人信息和/或发明人信息后，即可获取到对应的关联申请人，在本实施例中，该关联信息可以是关联申请人的名称。
示例地，若用户提出的专利申请的申请人为A公司，并预先设置有与该A公司互为竞争对手的B公司的对应关系，则在生成的专利检索要素信息中的申请人为A公司时，获取与该A公司对应的B公司的名称(即关联信息)，并根据该B公司的名称通过专利检索引擎进行检索处理，得到该检索结果。从而得到该A公司的竞争对手B公司的专利申请的相关信息，方便用户根据检索结果制定相关的专利申请战略。
需要说明的是，在通过专利检索引擎进行专利检索时，向专利检索引擎发送的专利检索请求消息中还可以包括账户信息，该账户信息是用户在登陆该专利提案界面后得到的，专利检索引擎在接收到该账户信息后，对该账户信息表示的账户进行计费，例如，可以根据检索的次数进行计费，在接收到一次包含该账户信息的专利检索请求消息时，则将该账户信息对应的账户的检索次数加一，在进行结算时，可以按照该检索的次数作为上一年度或者下一年度收费的依据。
在本发明另一实施例中，为了方便用户查看检索结果，本地服务器或者专利检索引擎在进行检索时，可以对检索到的检索信息进行统计处理得到检索结果。
示例地，该检索信息可以是检索到的专利文件，则该统计处理可以是统计专利文件的数量，每个专利文件所在的国家，以及每个专利文件的申请人 和发明人的信息等信息，从而得到检索结果。
在通过本步骤S103得到对应的检索结果后，可以通过展示该检索结果实现检索结果的输出。
在一种可能的实现方式中，可以将当前界面切换至检索结果界面，该检索结果界面用于展示该检索结果。
为了方便用户对检索结果展示的控制，在该当前界面上展示检索结果提示窗口；该检索结果提示窗口用于展示该检索结果的提示信息，并在接收到该用户对该检索结果提示窗口的触发消息后，将该当前界面切换至该检索结果界面。这样，用户能够根据提示信息决定是否切换至检索结果界面查看检索结果。
为了方便用户查看该检索结果提示窗口，该检索结果提示窗口可以覆盖在当前界面的上方，例如，如图6所示，该检索结果提示窗口覆盖在当前界面的上方，展示的提示信息为“检索已完成，点击查看”，此时，用户在看到该提示窗口展示的提示信息后，确定检索已完成，从而通过点击该检索结果提示窗口，将当前界面切换至检索结果界面。
另外，该检索结果提示窗口可以包括摘要窗口，则在该当前界面上展示该摘要窗口，其中，该摘要窗口展示该检索结果的相关信息，
例如，该摘要窗口可以展示检索到的文件的数量等信息；或者也可以直接展示检索的文件的内容，比如展示检索到的专利文件的摘要等。
为了进一步强迫用户感知该检索结果展示窗口，防止用户忽略该检索结果提示窗口，在本发明另一实施例中，在该当前界面上展示检索结果提示窗口后，获取该用户在该当前界面上输入的操作指令；确定该用户是否已经对该检索结果提示窗口执行预定操作；若该用户已经对该检索结果提示窗口执行该预定操作，则执行该操作指令；若该用户未对该检索结果提示窗口执行该预定操作，则丢弃该操作指令。这样，只有在用户对该检索结果窗口执行 预定操作后，才能在该当前界面执行其他操作，从而强迫用户感知该检索结果窗口。
其中，该预定操作可以是关闭该检索结果提示窗口的操作。
由于用户可能在感知到该检索结果提示窗口后，直接将该检索结果提示窗口关闭，使得检索结果无法呈现给用户，因此，为了解决上述问题，在一种可能的实现方式中，在关闭该检索结果提示窗口的操作前，还可以接收该用户在该检索结果提示窗口上输入的滑动操作指令；并在根据该滑动操作指令对该检索结果提示窗口执行滑动操作后，关闭该展示窗口。这样，能够强迫用户查看检索结果提示框中的内容，避免检索结果被用户忽略。
采用上述方案，在进行专利提案时，能够根据专利提案信息进行检索，不会增加提案人的工作量，且无需提案人具有一定的检索技能。

第一获取模块701，用于获取用户在专利提案界面上输入的专利提案信息；该专利提案信息包括该用户提出的专利申请的相关信息；

    根据所述专利检索要素信息进行检索处理，得到对应的检索结果并输出。

    第二发送子模块，用于向专利检索引擎发送专利检索请求消息，所述专利检索请求消息包括所述专利检索要素信息，以便所述专利检索引擎根据所述专利检索要素信息进行检索得到所述检索结果；
    第二接收子模块，用于接收所述专利检索引擎发送的专利检索响应消息，所述专利检索响应消息包括所述检索结果。
  20. 根据权利要求14至16任一项所述的装置，其特征在于，所述输出模块，用于展示所述检索结果。
  21. 根据权利要求20所述的装置，其特征在于，所述输出模块，用于将当前界面切换至检索结果界面，所述检索结果界面用于展示所述检索结果。
  22. 根据权利要求21所述的装置，其特征在于，所述装置还包括：
    窗口展示模块，用于在所述当前界面上展示检索结果提示窗口；所述检索结果提示窗口用于展示所述检索结果的提示信息；
    所述输出模块，用于在接收到所述用户对所述检索结果提示窗口的触发消息后，将所述当前界面切换至所述检索结果界面。
  23. 根据权利要求21所述的装置，其特征在于，所述检索结果提示窗口包括摘要窗口，所述窗口展示模块，用于在所述当前界面上展示所述摘要窗口，其中，所述摘要窗口展示所述检索结果的相关信息。
  24. 根据权利要求22或23所述的装置，其特征在于，所述装置还包括：
    第二获取模块，用于在通过展示窗口展示所述检索结果后，获取所述用户在所述当前界面上输入的操作指令；
    判断模块，用于确定所述用户是否已经对所述展示窗口执行预定操作；
    执行模块，用于若所述用户已经对所述展示窗口执行所述预定操作，则执行所述操作执行；
    丢弃模块，用于若所述用户未对所述展示窗口执行所述预定操作，则丢 弃所述操作指令。
  25. 根据权利要求24所述的装置，其特征在于，所述装置还包括：
    窗口关闭模块，用于关闭所述检索结果提示窗口的操作。
  26. 根据权利要求25所述的装置，其特征在于，所述窗口关闭模块包括：
    第三接收子模块，用于接收所述用户在所述检索结果提示窗口上输入的滑动操作指令；
    关闭子模块，用于在根据所述滑动操作指令对所述检索结果提示窗口执行滑动操作后，关闭所述展示窗口。
  27. 一种非临时性计算机可读存储介质，其特征在于，所述非临时性计算机可读存储介质中包括一个或多个程序，所述一个或多个程序用于执行权利要求1至13中任一项所述的方法。
  28. 一种客户端，其特征在于，所述客户端包括：
    权利要求27中所述的非临时性计算机可读存储介质；以及
    一个或者多个处理器，用于执行所述非临时性计算机可读存储介质中的程序。
