本発明は、不動産物件・動産物件もしくは物品等の販売・賃借の取引を、通信システムを利用してリアルタイムに売手・貸主と買手・借主の双方が売買・賃借の取引に参加できるよう構成された、販売・賃借の取引システムに関するものである。

【従来の技術】
従来の不動産物件・動産物件もしくは物品等の販売・賃借に関する取引システムとして、物件・物品の情報を印刷物による広告と同業種の協会・組合など、協力者を介し情報などを共有化して、買手・借主を募る方法と販売物件の敷地内に看板広告を設置し、買手・借主を募る方法が一般に知られている。またインターネットによる物件情報の提供やオークションなどの競売システムがある。

【発明が解決しようとする課題】
しかしながら、従来の不動産物件・動産物件もしくは物品等の販売・賃借の取引の場合、一般に広告宣伝費用がかかりすぎる上、売手・貸主の販売・賃借の価格の設定が買手・借主の望む適正な市場価格を算出設定できないなどのことから取引を困難にさせている。
【0004】そのため価格の値下げを強いられデフレ化してしまうことで、買手もしくは借主は慎重になり購入・賃借の意欲を差し控えるなどの傾向にある。またオークションの競売システムがあるが、これは最高額に達したとき落札されるため、個人の財力に大きく左右されるなど、不公平さを生じさせる問題があった。
【0005】さらに不動産等の販売・賃借の物件については敷地内にある掲示広告に価格が表示されないなど、不動産の物件・賃借の価格の不透明さが、より一層取引を困難なものにしているなどのことにより、不動産の不良債権化が進行している。
【0006】そこで本発明は従来の取引方法の欠点を鑑み、不動産物件・動産物件もしくは物品の売買・賃借の取引を一定の期間行なうための上昇システムと入札上昇システムと下降システムの価格変動プログラムと、区分システムと、入札システムと、指値入札システムと、抽選システムと、先着・応談システムと、入札抽選システムと、取引仮想システムと、オークションシステム等の複数のシステム手段を有する機能を、構築し格納したホストコンピュータと端末デジタル看板を設け、不動産物件・動産物件もしくは物品の売買・賃借の取引システムを提供することを目的とする。

【課題を解決するための手段】
すなわち本発明は、消費者心理に基づき、良い物件、良い物品を安価で取得したいなどの欲求を価格変動させることで可能にした。さらに売手・貸主側の高額で売買・賃借の取引の期待も前記複数のシステムと前記価格変動プログラムの機能を構築したことで確率を高めた。このように物価が上昇する時、消費者心理は物価が上がる前に入手したいと購買意欲を高めるが、物価が下降する時は逆に慎重になり、購入意欲を差し控えてしまう。このような消費者心理に基づき次のようなシステム手段及びプログラム機能を構築した。
【0008】売手または貸主の取引に対し、販売・賃借の一定の取引期間を設け、入札価格が入札毎に上昇する入札上昇システムと、一定の期間上昇する上昇システムと、下降する下降システムの3つのシステムを、売主・貸主の希望によって選択と数値を自由に設定できる価格変動プログラムと、事前に取引期間中の経緯と仮想の推移を取引前にシミュレーション確認できる取引仮想システムと、大型物件または大量物品を区分販売・区分賃借の取引を行なうための複数の取引を必要とする区分システムと、入札権利価格で契約を締結する入札システムと、予め希望の入札価格と回数を登録できる指値入札システムと、競売入札のオークションシステムと、一般抽選または条件付抽選を選択できる抽選システムと、入札権利受付番号を抽選し落札者を選定する入札抽選システムと、入札以外の取引を行なう先着・応談システム等の複数のシステムとプログラムを構築し格納したホストコンピュータと双方向の通信を可能とする通信システム手段を備え、さらに端末デジタル看板による物件もしくは物品に関する取引の詳細情報を表示する機能を備えた。
【0009】これにより取引期間中は価格変動プログラムにより、物件もしくは物品の時価価格の変動波(昇降)が生じ、買手・借主は希望価格に達した時点で、入札システムにより時価価格の入札が行なえ、さらに指値入札システムにより希望価格を事前に登録できる。また入札以外の物件・物品の取引においても、先着または応談などの取引ができることから、市場価格(希望価格)を適正に算出でき、かつ物件または物品に関する販売・賃借の詳細情報と価格を、通信システム手段を活用して端末コンピュータ及び端末デジタル看板等の端末装置にリアルタイムに表示させる機能を備えたことを特徴とする。

【発明の実施の形態】
以下、本発明の実施の形態について図面に基づき説明する。図2おいて不動産物件・動産物件もしくは物品等に関する売買・賃借の取引を行なうための制御手段1・メインプログラム2・入札価格ファイル3・イメージファイル4・物件ファイル5・価格ファイル6を構築し格納したホストコンピュータ10と、図1が示すように詳細情報及び価格等の文字情報等の入出力を行なう前記ホストコンピュータ10と、通信システムを介して前記ホストコンピュータと接続された複数の端末コンピュータ20・21・22・23・24と、端末デジタル看板30・31・32の各端末装置に表示された販売・賃借の物件または物品の取引の詳細情報と価格に対して、検索を行なうための検索キーと入札を行なうための入札キーと、その他必要に応じての登録キー・確認キー・入力キー・削除キー等を有する手段キーを備え、売手・貸主が物件または物品の販売・賃借に関する詳細情報と価格を入力する入力キーと、システムを選択する選択キーと、取引期間中に販売・賃借の価格の変動させるための複数のシステム数値を入力する設定キーと、その他必要に応じての登録キー・確認キー・入力キー・削除キー等を有する手段キーを備え、前記ホストコンピュータ10に対して識別コードを送信するために各端末コンピュータ内蔵された各個人のID(識別番号)を記憶した記憶手段と、前記ホストコンピュータ10から送信される物件情報を格納するためのデーター記憶手段と前記通信システム手段とからなり、
【0011】ホストコンピュータ10と前記端末コンピュータはオンライン状態において図6が示すように、売手・貸主は取引を行なう場合、端末コンピュータ画面100から売手・貸主専用画面フォーム101の販売・賃借の申込102を行ない、運営管理者の所定の審査を経て審査合格後に、販売・賃借の契約の承諾確認103を経て、運営管理者から売手・貸主の各個人(法人)ID及びパスワードを発行されることで、売主・貸主の各個人(法人)ID及びパスワードを取得104することができる。なお運営管理者は目的に応じて売手・貸主に代わり、取引に関わる各システムの選択と設定と数値の入力し登録を行なうことができる。
【0012】図3が示すように売手・貸主はIDでログインし、取引を行なう物件・物品の情報登録105にて詳細情報などの登録をおこない、各システム数値設定入力106にて入札・区分・先着・応談・オークション等を取引の目的に応じ選択し、各システムの選択と数値を設定し登録することができる。
【0013】図4の示す、複数のシステムの手段と機能を下記1〜8の記号で説明する。
1.価格変動プログラム112は入札上昇システムと上昇システムと下降システムとからなり、取引前に売手または貸主が希望の選択と数値を設定することで、価格変動プログラム112が稼動するようにプログラムされている。これらのシステムを下記A〜Cの記号で説明する。
A.前記入札上昇システムは、パーセント数値を設定することで、入札毎に稼動し、設定された数値に応じ時価価格を上昇させると共に、入札の回数目を設定することにより、上昇システムbまたは下降システムbに切替わり、予め設定されたシステム切替・パーセント・稼働時間・タイムラグ等の数値の設定に応じ、その入札の回数目に稼動し自動変更させる入札上昇システムである。さらに入札回数の表示の有無を売手または貸主の意思より選択できる。
B.前記上昇システムは、上昇システムaと上昇システムbとからなり、上昇システムのaとbは取引期間中の時価価格をパーセント・下降システム切替・稼働時間・タイムラグなどを選択と数値の設定によって、時価価格を上昇させるシステムであり、上昇システムbは前記入札上昇システムと連動するようプログラムされていることから、入札毎に入札上昇システムが稼動し、設定により上昇システムaから上昇システムbにシステムが変更される。なお取引期間中は価格の変動波を小刻みにするためのパーセント・稼働時間・下降システム切替・タイムラグなどを数回に分けて設定できる。
C. 前記下降システムは、下降システムaと下降システムbとからなり、下降システムのaとbは取引期間中の時価価格をパーセント・上昇システム切替・稼働時間・タイムラグなどを選択及び数値の設定によって、時価価格を下降させるシステムであり、下降システムbは前記入札上昇システムの設定により連動するようプログラムされていることから、入札毎に入札上昇システムが稼動し、下降システムaから下降システムbにシステムが変更される。なお取引期間中は価格の変動波を小刻みにするためのパーセント・稼働時間・切替・タイムラグなどを数回に分けて設定できる。
以上のように、取引の時価価格を売手または貸主の意思(数値設定)によって変動(昇降)させ、かつ買手または借手の入札毎に時価価格(入札上昇システムにより)が変動するようプログラムされている価格変動プログラム112である。
2.入札システム206は、買手または借主が入札毎に入札権利受付番号と入札権利価格を取得することができ、これにより落札者は入札権利価格により、入札時の時価価格で売主または貸主と取引の契約を締結できる入札システム206である。なお同物件または同物品の入札は何度も行なえることから、売主または貸主の目的により入札の回数を制限できる。
3.区分システム200は、大型物件または大量物品などの複数の区分けした取引を必要とする場合に用い、入札・先着・応談・オークションなどのいずれか1つの取引手段によって、取引の契約を締結させる区分システム200である。
4.先着・応談システム400は、入札もしくはオークション以外の取引に対して、先着または応談のいずれかを取引手段とし、取引の契約を締結させる先着・応談システム400である。なお前記価格変動プログラム112の選択と数値の設定を入札同様に行なうことができる。
5.オークションシステム500は、競売を目的とする取引に用い、競合入札によって最高額を提示した者と取引の契約を締結させるオークションシステム500であり、初回入札価格を設定することで、取引が開始される。
6.抽選システム111は、一般抽選(一時抽選で落札者を選定する手段)と条件付抽選(落札候補者の人数の割合と価格範囲を設定することにより、落札候補者をその割合に応じて一時抽選で選出し、価格範囲の最高額・最低額・順位・価格指定などのいずれか1つを選択し設定することにより、予め希望の落札価格を設定する手段)のいずれかを選択し設定する抽選のシステム111である。なお買手・借主の取引情報フォームに抽選システム111の抽選方法(一般抽選と条件付抽選)の趣旨を表記する。
7.入札抽選システム300は、売手または貸主の意思により、予め予備の落札者人数を設定することができ、前記抽選システム111と前記入札システム206の設定において、入札権利受付番号を第三者機関によって、ランダムに抽選し落札者を決定させる入札抽選システム300である。
8.取引仮想システム109は、前記1・2・4・6・7のシステムを売手又は貸主は希望の選択と数値を設定することにより、図8の示すように、その数値の経緯をパターンとグラフで確認ができ、さらに幾とおりもの入札状況の入札パターンと入札グラフと入札権利受付番号と落札額と落札者などを、仮想プログラムにより、シミュレーション確認できる取引仮想システム109である。
【0014】さらに図11の端末デジタル看板の設置申込107は売手・貸主が任意及び有償にて、取引の敷地内または指定場所に、しかるべき設置工事をおこなうことで、物件または物品の取引情報が前記通信システムを介してリアルタイムに表示され、近隣地域に周知させることで地区住民の購入者層の潜在需要を高めることができることから、取引を活性化させることが期待できる。
【0015】図6に基づき各システムについて説明する。売手・貸主は予め収得したIDでログインし、取引を行なう物件または物品の販売・賃借に関する詳細情報と価格に対して、取引方法の販売または賃借の選択と、入札・区分・先着・応談・オークションなどを目的に応じて選択すると共に、その条件(入札の場合は、同一人物に対して入札回数の制限)の選択と数値の設定と、前記価格変動プログラム112の上昇システムaと下降システムaのパーセント・上昇切替時間・下降切替時間・稼働時間・タイムラグなどの選択と数値の設定と、前記入札上昇システムの入札回数表示の有無を選択し、入札毎に時価価格を上昇させるパーセントの数値と、入札の回数目を設定することで、その回数目で稼動し自動変更させる上昇システムbと下降システムbの切替・パーセント・稼働時間・タイムラグなどの選択と数値の設定を、前記価格変動プログラム112に格納登録し、抽選方法の抽選システム111(一般抽選・条件付抽選の価格範囲と落札候補者の人数の割合)と、入札抽選システム300(落札候補者の人数)の数値の設定を行なうなど、取引に関するシステムを登録することにより、取引仮想システム109にて、その設定された数値の経緯をパターンとグラフで確認でき、さらに仮想の入札パターンと入札グラフと入札権利受付番号と落札額などを、シミュレーションにより最終確認を行ないホストコンピュータ10に格納し登録することにより、運営管理者の所定の調査と審査等を経て、審査合格後に取引が開始される。
【0016】以上のように、売手または貸主が取引に関する情報を目的に応じてホストコンピュータ10に格納し登録することにより、前記通信システムを介して、図10の端末コンピュータ20・21・22・23と図11の端末デジタル看板30・31・32に、取引の詳細情報と物件又は物品の販売・賃借の価格の変動を所定の範囲で取引期間中、自動的に繰り返し、入札毎に変動する価格と入札回数・グラフと前日との価格差などの数値が自動的に変換され、買手・借主の物件情報の検索と入札が可能となる。
【0017】図8の示すように、前記上昇システムは数値の設定入力によって取引の開始から終了までの一定期間、取引価格が上昇し続けるようプログラムされ、最終取引価格を予め設定することから、一直線の右肩上がりBを描くが、前記入札上昇システムの数値の設定により、入札毎にAのようなランダムな右肩上がりを示す。このように取引価格の上昇(右肩上がり)を希望する場合の設定となる。なおタイムラグ(上げ止まり時間)の時間設定によって、一時的に上昇を停止させることができる。さらに稼働時間の設定により、下降システムの切替えが可能となる。
【0018】下降システムは数値の設定により、一定の期間下がり続けることから最終価格を予め設定するものであるが、タイムラグ(下げ止まり時間)の時間設定により、一時的に下降を停止させることができる。また入札毎に前記入札上昇システム(下降システムaと異なる設定)により、下降システムaから下降システムbに変更されることにより、予め設定された上昇システム切替・パーセント・タイムラグ(下げ止まり時間)・稼働時間などの数値の設定によって、下降システムaとは異なる価格の変動波(昇降)を設けることができる。このように上昇システムから下降システムと、下降システムから上昇システムと稼働時間を設定することで、取引期間中においても上昇と下降のシステムの切替えが可能となり、入札期間中これを繰り返すようプログラムをされているのでCのような線を描き、応札がない場合は右肩下がりのDの線となる。
【0019】また入札上昇システムは、パーセント数値の設定によって、入札毎に一定の上昇をするようにプログラムされ、上昇システムbと下降システムbのいずれにも属し、連動することで図8のAとCが示すように、販売価格を高騰させるため、目的に応じて同時に連動しないよう上昇システムbと下降システムbにタイムラグを設けた。
【0020】このように上昇システムと下降システムを複合することにより、取引時の時価価格を複雑に変動(昇降)させることができる。さらに入札上昇システムによって、市場価値の高い物件もしくは物品は、プレミア評価されることから売手または貸主は高額取引の期待ができる。
【0021】また取引の目的に応じ入札に適さない物件・物品等を入札以外の先着・応談システム400を備えたことで入札以外の取引を可能にした。
【0022】さらに売手・貸主は抽選の方法を一般抽選と条件付抽選のどちらかを選択でき、一般抽選は一次抽選により落札者の選定となるが、条件付抽選では予め応札者の割合と価格範囲を想定して事前に数値を設定することで、その割合に応じて複数の入札者を落札候補者として一次抽選し、その入札価格の最高額・最低額・指定価格・順位などの設定に応じて、最も適し該当する者を落札者とする抽選システム111であることから、例えば、条件付抽選の数値の割合を30%で設定すると、応札された入札権利受付番号の30%(少数切捨て)をランダムに1次抽選し、価格範囲の設定に応じて落札者を決定させることができる。そのため割合を100%で最高額と設定することによって、すべての入札権利受付番号をランダムに一次抽選し、その最高額の入札者が落札者となり、オークションのような最高額で落札される仕組みとなる。

【0025】以上のようにホストコンピュータ10に格納し登録された取引に関する詳細情報は自動的に物件・物品の情報検索205に入力変換され、図7が示すように、買手・借主は前記通信システムを介して、買手・借主専用フォーム201から自由に物件・物品の情報検索ができ、物件・物品の詳細情報に対しての販売・賃借・地区・価格と入札・先着・応談・オークションなどの希望の条件を指定し検索キー検索することで、物件・物品の情報検索205を閲覧できる。取引に参加する場合は取引権利の申込202を行なうことで、運営管理者は所定の調査と審査を行ない、審査合格後に買手または借主と取引契約の承諾確認203を締結することで、買手・借主の各個人(法人)IDとパスワードを発行し、買手・借主は各個人(法人)IDとパスワードを取得できる。これにより買手・借主はIDでログインし、希望の物件または物品の取引の方法を入札・先着・応談・オークションなどのいずれか1つを選択し設定キーで入力し登録するにより、希望の物件または物品の取引に参加することができる。
【0026】入札を行なう場合は、対象の物件または物品の入札を入札キーの入力と設定確認キーで登録することで何回も入札が行なえ、入札毎に入札権利受付番号と入札権利価格を得ることができる。さらに希望の価格範囲と入札回数を事前に登録することができる指値入札システム207により、希望の金額範囲と回数の数値を入力し設定キーと登録キーで登録することで、その指値価格が時価価格に達した時点で自動的に応札され、入札権利受付番号と入札権利価格を得ることができる。このように同じ物件又は物品に対して複数の入札権利受付番号と入札権利価格を取得することができ、落札者は入札時の価格の入札権利価格で取引の契約を締結できる入札システム206である。
【0027】またオークションシステム500は、競合入札により希望の価格(入札価格の高値)を数値入力し設定キーと登録キーで登録することで、入札システム206によって入札権利受付番号を取得できる。取引期間中に最高額を提示した者が落札者となり、取引終了後に落札者の入札権利受付番号が発表され、落札者は売主または貸主と落札価格で取引の契約を締結するオークションシステム500である。

【0029】抽選は公共性のある場所で、かつ公平を規するため、たとえばNPOのような非営利団体などの第三者機関にて、取引期間後に物件または物品ごとの入札権利受付番号の抽選を宝くじの抽選方法(弓矢)などを用い、必要によっては生中継放送を各端末装置に伝送する。またキャンセル防止策として2次3次まで予備の入札権利受付番号の抽選を同時に行なうなどの予防策を設け、同一人物以外の落札者を選出するための入札抽選システム300を備えた。なお売手・貸主は目的に応じて落札候補者の人数を設定できる。
【0030】落札の発表は個人(法人)の希望により売手・貸主・買手・借主の名前、電話番号などの個人情報は公開されず、落札価格と入札権利受付番号が表示され、落札者は入札権利価格で購入もしくは賃借の権利を得ることができ、売手・貸主は落札者に対して入札権利価格で売買・賃借の契約を締結する。さらに販売・賃借の取引期間中は公平を規する為、売手・貸主に入札価格や入札者等の情報と経緯は報告されず、販売・賃借の取引期間終了後に入札者と入札経緯などの情報を売手または貸主に提供する。
【0031】また不動産物件販売・賃借については公図・測量図、土地登記簿謄本、建物登記簿謄本、建物間取図等を必要とし、動産物件等の販売もしくは賃借の情報物件登録は、取引内容により必要に応じて店頭での書類審査等を行なうなどの接客対応をおこなう。なお図の6・7・8・9・10・11の示す仮想フォームは不動産物件を仮定したものであるが実際のフォームとは異なる。また動産物件などの物品も趣旨に応じて異なるものとする。
【0032】運営管理者は不動産物件・動産物件もしくは物品の売買・賃借の取引システの運営において、取引を円滑に行なう為に売手・貸主・買手・借主の取引の申込に対して、その取引に関わる物件・物品・人物などの調査及びトラブルを発生させない厳格な審査基準を規定し、取引期間中においても必要に応じて所定の審査を行ない、さらに取引の趣旨に応じての契約事項を備えた契約書を設けるなど取引に支障を与えぬよう配慮する。また取引よっては預託金を必要とする場合は徴収し保管する。さらに運営に関わる費用は取引の仲介手数料と基本登録費用と申込手数料とその他手数料などの収入によって運営される。

【発明の効果】
以上のように本発明は、市場価格を算出するため価格の変動波を設けることで、買手・借主の希望価格を適正に算出でき、購入・賃借の取引が入札時の時価価格として、落札者の購入・賃借の権利価格となる複数のシステムとプログラムによって様々な手段と機能を備えた。すなわち、市場原理により決定される値段構造となる。
