Abstract

Statement motivated according to articles 29.6 and 29.7 of the Regulations for the execution of Law 11/1986, of March 20, on Patents on novelty and inventive activity; quotes and explanations in support of this statement D01 is considered the prior art prior to the object of the invention document. Following the wording of claim 1, document D01 describes an electronic device (hub 1) for communicate smart mobile phones (9) through a conventional line (PSTN), which includes:

a connection (mobile radio access point) with a wireless router;

an audio converter mechanism (gateway 4), connected to the input of a telephone line (paragraph 29), the

which:

o capture of the telephone line data related to incoming / outgoing calls;

or acts as a receiver / transmitter and audio encoder / decoder, in charge of performing the numbering dialing to the fixed conventional telephone network (converting the voice signal with codes used for digital transmission in the fixed telephone network; also converts the signaling used in IP networks to the signaling of the PSTN);

There is a difference between D01 and the first claim. It details that the wireless connection is WiFi, while in D01 it is indicated that the connection is wireless via radio although a particular type is not cited. The technical effect produced by this difference is that since Wifi is a short-range standard, the mobile-device / hub connection is made only when the distance between them is reduced. However, the summary of D01 cites that the mobile will connect to the hub through the mobile radio interface when the user is located in the "neighborhood" (proximity) of the hub. That is, WiFi is one of the standard that D01 could use (WiFi, bluetooth ...). It has no inventive activity according to Art. 8 of Law 11/1986. The second claim states that the device also manages the information of the mobile phones connected to the network, reporting to the operator the information of the connected phone, so that it can redirect calls and status of the mobile number connected to the device, providing coverage through the fixed telephone network. D01 explicitly cites that session management devices are used, such as SIP Servers (6). These servers use SIP protocol (Session Initiation Protocol) for the initiation, modification and termination of interactive user sessions; It also allows the location of user agents or clients (terminals) to redirect calls. Therefore, the operator has the information to send the calls of the connected mobiles. It is considered to lack inventive activity. The third claim indicates that the device manages an internal WiFi connection mechanism, creating a WiFi network through which mobile devices that have WiFi can connect to the internal network and optimize the WiFi bandwidth.  WRITTEN OPINION In D01, this detail could be performed by the wireless access adapter module (2) of the hub, since it has a standard interface and is compatible with the usual mobile terminals on the market. Therefore, you could manage the devices that connect to it using the WiFi standard. It is not indicated that it is optimized for WiFi bandwidth but since it is capable of connecting via WiFi, D01 would be suitable for that effect. This characteristic does not contribute to the technical result of the invention and therefore does not present inventive activity. Claim number four defines that the application, or firmware, loaded on mobile devices, sends to the central processing unit (CPU) the parameters necessary for it to enable auxiliary channels for the forwarding of the incoming or outgoing call as well as the diffusion of it together with the authorized mobile devices. This claim does not add additional features to the object of the invention, that is, they are peculiarities necessary for the system to function: the parameters necessary for operation must be communicated and that the system be allowed to be authorized by authorized users. It is disclosed in paragraph 37 of D01. In the light of the aforementioned documents, it would be obvious for a person skilled in the art to obtain the object of the request submitted from the cited documents. In conclusion, it is considered that it lacks inventive activity, according to Article 8.1 of the Spanish Patent Law.
