2. Statement motivated according to articles 29.6 and 29.7 of the Regulations for the execution of Law 11/1986, of March 20, on Patents on novelty and inventive activity; quotes and explanations in support of this statement

The purpose of the application is a cross-country ski with anti-reverse means.

The document considered closest is D01. Said document discloses (references in parentheses correspond to said document):

A cross-country ski with anti-reverse means; At least one anti-backstroke means is fixed on the ski, which has a frame (defined by 22,24,30), inside of which there is a tilting angular plate (34,40), a first section (40), and with a second section (52), arranged angularly in relation to the first, the angular plate being connected to the frame by means of a joint, through which an axis (36) of the angular plate rotates, counting on the face of the frame facing the joint with a stop (48), which limits the tilting of the tilting angular plate.

The differences between document D01 and the one in question are the following:

The first, that the free end of the first section has a smaller thickness than the rest of the first section. The second, which is not the vertex of the angular plate, which joins with an articulation to the frame, but the end of the first section (40).

If document D02 is observed, there is a cross-country ski with anti-reverse means, in which figure 5, reference 17 represents a section of the brake whose free end has a smaller thickness than the rest of the section.

In the opinion of the undersigned, locating the joint in one or another vertex has no technical effect, it is enough to adapt that location to the specific design being made. See, for example, the document D02 itself in which the brake consists precisely of a sheet with two parts, whose joint of union to the ski is in the vertex between both sections.

For all the foregoing, it is considered that claim 1 lacks inventive activity in view of document D01, said claim also supporting in document D02.

Claim 2: at least one window () is housed on the ski floor in which the anti-reverse means are housed and fixed by means of the frame. The content of this claim is deduced from document D01, figures 2 and 4.

Claim 3: the anti-reverse means is fixed or on the tail of each ski and / or on its sides, being fixed by screws. Documents D01 and D02 contemplate the possibility of installing the anti-reverse means on the tail of the ski, as derived from the figures.

Claim 4: It has a spring with sufficient force to make the first section of the tilting angular plate coplanar with the rest of the surface and not prevent its interlocking in case of recoil. This function is done by the spring indicated with reference 46.

Claim 5: the spring tension can be regulated. Adjustable tension springs are widely known and therefore said feature is not considered inventive.

For all the above, in the opinion of the undersigned, the content of claims 1 to 5 is not inventive in accordance with the definition of article 8 of patent law 11/1986, although new according to article 6 of the same law . The other documents cited are considered a reflection of the state of the art and are not considered to affect the novelty or inventive activity.
