现有一种具有保健功能的鞋，其结构为2001年3月7日公告的公告号为CN2421867Y的中国实用新型专利；在该专利公开的技术中，为使鞋具有保健的功能，在鞋帮1和鞋底3上的鞋底最上层2全由珍珠串连而成，因而在穿用时能与皮肤接触，达到按摩保健的功效。此种现有的结构，虽然具有保健的功能，但是由于鞋底最上层2全由珍珠串连而成；因此，在穿用时，人体脚底的脚掌和脚跟中部会长期与不平的表面接触，尤其时长时间步行时；从而使脚掌和脚跟中部容易疲劳而产生疼痛感，无法达到保健而又舒适的目的。
实用新型内容：
本实用新型解决的技术问题在于提供一种既舒适由具有保健功能的鞋。
本实用新型的技术问题是通过如下技术方案实现的：鞋底最上层由平面状和非平面状两部分构成。

见附图1，本实用新型鞋底最上层2由平面状22和非平面状21两部分构成；该平面状22部分设置于与脚掌和脚跟中部相对应的位置或者与脚掌或脚跟中部相对应的位置；在穿用时，人体脚底的脚掌和脚跟中部与平的表面接触，从而使脚掌和脚跟中部不容易疲劳。非平面状21部分为若干小的球面状或其他的非锋利曲面组合而成，以对人体脚底进行按摩；为实现该结构，可以用珍珠串连而成；利用珍珠富含二十多种微量元素等对人体的保健作用，实现保健的功能。
因此，采用本实用新型的结构可以实现既具有保健功能，同时使用时又舒适的目的。
前述的结构可以应用于凉鞋、拖鞋等多种鞋中，实现鞋底最上层2由平面状22和非平面状21两部分构成的方式亦不局限于上述说明；凡本领域技术人员依前述说明可以实现之结构，皆属于本实用新型之保护范围。

4、根据权利要求1、2或3所述鞋，其特征在于：非平面状(21)为若干小的球面状或其他的非锋利曲面组合而成。
