技术领域

提供一种带有版权保护信息并在其上存储数字数椐的介质。一个重放装

置在复制操作期间重放数字数据并将其输出到一个记录装置；但版权保护信 息允许或禁止记录该信号。记录介质中的复制允许信号与版权保护信息一起 起作用，以允许或禁止记录该数字数据。

图2示出保护信息、复制允许信息、和复制允许/禁止之间的关系表。如 上所述，在不传送保护信息的情况下，可以不考虑装入记录装置的记录介质 的复制允许信息，而对AV或DTV数据进行复制。另外，在重放装置传送 出表现为复制禁止的保护信息的情况下，且在记录介质中无复制允许信息或 该复制允许信息表现为复制禁止的情况下，不能进行复制。即使在从重放介 质传送出表现为复制禁止的保护信息时，在复制允许信息表明允许在记录介 措上进行复制的情况下，仍能够复制AV或DTV数据。在禁止复制的情况 下，通过使用例如监视器上的屏幕直接显示(OSD)或类似装置来通知用户。

图3A和3B是数字VCR记录和重放部分的示意图。如图3A所示，重 放装置1从记录/重放单元3重放记录在预录磁带上的AV数据，并将该数据 输出到控制单元5。保护信息读取单元4从预录^兹带上读取预先记录在预录 碌带上的保护信息，并将其输出到控制单元5。 从该控制单元输出AV数据 和保护信息。

图5是用于复制来自预录磁带的数据的数字VCR的方框图。图5中， 与图4中相同的元部件用相同的参考标号表示，下文不再描述。来自另一个 数字VCR (未示出）的数字数据和保护信息通过一个I/O选择器11提供给一 个信号处理装置16。该保护信息从该信号处理装置输入到控制器14。该控制 容根据该信号处理装置提供的保护信息，产生表明是否能转录该AV数据的 控制信号。如果无保护信息，或如果提供了表明允许复制的保护信息，则能 够进行复制，而不考虑存储在空白磁带上的复制允许信息。

当表现为复制禁止的保护信息被提供给控制器14时，该控制器从装入记 录和重放装置13的空白磁带读取复制允许信息。如果该复制允许信息表明允 许复制，该信息从记录和重放装置输出到控制器。因此能够进行复制。如果 复制允许信息表明复制禁止，则不能进行复制。

当保护信息与DTV数据一起传送并且在记录装置中的空白磁带上存储 有复制允许信息时，如图7D所示，存在四种可能性。

第一，当表现为复制禁止的保护信息被传送，并且复制允许信息表现为 复制禁止时，不能进行记录。第二和第三，当保护信息表明允许复制，而复 制允许信息表明允许或禁止复制时，允许进行记录。第四，当保护信息表明 禁止复制，而复制允许信息表明允许复制时，则允许进行记录。图7D中， 当依据第四种可能性允许进行记录时，保护信息与该DTV数据一起被记录， 以便能够使被转录的数据同样保持保护和复制允许。

图8A、 8B、 8C和8D示出当从一数字VCR复制数据时保护信息和复制 允许信息之间关系的系统示意图。

如图9B所示，当具有第二级保护信息的重放介质被装入重放装置，并 且无复制允许信息的记录介质被装入该记录装置时，不能进行复制。

如图9C所示，当具有第一级保护信息的重放介质被装入重放装置，并 且具有复制允许信息表明允许记录的记录介质被装入该记录装置时，允许进 行复制。这种情况下，保护信息与数字数.据被一起记录到空白磁带上。因此 能够使被复制的数据同样保持保护和复制允许。

如图9D所示，如杲具有第二级保护信息的重放介质被装入重放装置，

并且具有复制允许信息的记录介质被装入该记录装置时，不能进行复制。提 供两级保护信息，以便能够制止违法复制。第一级保护信息被设定在与复制 允许信息相同的级，而第二级保护信息被设定在比复制允许信息的更高的级。

在前面的说明中，本发明采用录像带作为介质，然而，本发明也可以通 过以光盘或类似装置作为重放和记录介质来实现。

下面六种信息能够作为版权保护信息存储在条件存储器209中：（l)表明 是否允许进行记录或表明禁止或限制记录的信息；（2)与允许转录的记录持续 时间信息或指定的记录持续时间对应的预付费信息；（3)表明是否允许重放或 表明禁止或限制重放的信息；（4)与允许重放的重放持续时间信息或指定的重 放持续时间对应的预付费信息；（5)表现为与记录节目的单位记录持续时间收 取6々版权使用费对应的费用类别的信息；和(6)表现为记录数据的单位重放持 f时间收取的版权使用费对应的费用类别的信息。

在记录状态中，条件判断逻辑电路203根据条件存储器209中的版权保 护信息以下列三种方式控制记录电路204。 （l)当输入信号中无表现为复制禁 止或限制的保护信息时，记录电路204能够对输入信号进行正常记录。（2) 当保护信息表现为禁止或限制复制，并且条件存储器中没有表明允许进行记 录的信息时，该记录电路不能对输入信号进行正常记录。例如，可以通过使 录像机AGC的操作失真，或对输入到录像机的信号进行扰频，或禁止对重放 信号解扰，和类似措施来禁止或中断记录。（3)如果输入信号中的保护信息表 现为禁止或限制进行复制，并且条件存储器中的信息表明允许进行记录，记 录电路204能够根据记录时间信息或与记录持续时间对应的预付费信息对输 义信号进行正常记录。记录输入信号时，输入信号中的版权保护信息被存储在条件存储器和/或磁带211的预定领域，后者与条件存储器不同。

也可以将有关该输入信号的版权保护信息从数字VCR外部输入到条件 判断逻辑电路203 ，以代替输入信号中的版权保护信息。

在重放状态中，条件判断逻辑电路203根据条件存储器209中的版权保 护信息以下列两种方式控制重放电路205。 （l)当条件存储器中不存在表明是 吝允许进行重放，或表明禁止或限制重放的保护信息时，重放电路205能够 对记录信号进行重放。（2)当条件存储器中存在保护信息，并且表明是否允许 裤行重放，或表明禁止或限制重放时，重放电路依据重放持续时间信息或预 付费信息能或不能对记录信号进行重放。上述禁止或失真技术可以用于防止 重放。

下面将描述输入信号中的保护信息表明为禁止或限制复制，而条件存储 器中存在表明允许记录的保护信息的情况下条件判断逻辑电路203的控制操 作。

现有假设在版权保护信息中将记录持续时间信息设定为RTO,与记录持 禁对间对应的预付费信息被设定为RMO。另外还假设将对受版权保护的输 入信号进行记录的每单位时间收取的版权使用费设定为RCi(i = 1 - n:n > 1)。 ^!权使用费RCi可以被设定为单值。也可以针对每个预录节目收取不同的版 S/使用费RCi，以使，例如，对最新发行的资料，例如软件程序、录像带或 类似资料将版权使用费设定为高值，而对发行时间较长的资料或类似材料将 版权使用费设定为低值。

现在将描述被记录了某一特定持续时间RT1、 版权使用费等于RCi的 输入信号。通过时间信息构成单元206获取记录持续时间RT1。通过下式获 取针对持续时间RT1收取的版权使用费RCP。

RCP = RCi x RT1

记录完成时，条件存储器209中的版权保护信息中的记录持续时间信息 或与记录持续时间信息对应的预付费信息被重写。RTO或RMO的重写可以 i每次复制结束时进行，或者隔一预定时间进行一次。通过下式重写记录持 蜂时间信息RTO

条件判断逻辑电路203识别RT0或RM0是否等于0，因此，RTO或RMO 可以作用表明是否允许记录或表明禁止或限制记录的信息。

该记录持续时间信息RTO、与记录持续时间对应的预付费信息RMO、和 针对受版权保护的输入信号的记录持续时间收取的版权使用费RCi(i= 1-n:n >1)可以分别由表明允许对该数据进行记录的次数的信息RTO、与数据允许 凝记录的次数对应的预付费信息RMO、和针对受版权保护的输入信号允许被 记录的次数收取的版权使用费RCi(i = 1 - n:;》l)来代替。

复制时，针对输入信号的记录持续时间收取的版权使用费RCi或从数字 VCR外部输入的版权使用费可以被存储在条件存储器中，作为表明与预录节 目的版权使用费对应的费用类别信息。

另外，针对重放输入信号的每单位时间收取的版权使用费RCi或从数字 VCR外部输入的版权^使用费可以被存储在条件存储器中，作为表明与预录节 目的版权使用费对应的费用类别信号。

现在将说明在条件存储器中存在确定是否允许重放或是否禁止或限制重 煞的保护信息的情况下条件判断逻辑电路203的操作。

Claims (6)

1. 一种用于控制在记录介质中使用数字数据的控制设备，该设备包括：获取装置，用于获取与所述数字数据相关的第一信息，所述第一信息表示为了使用所述数字数据，所述记录介质必须具有的保护等级；读取装置，用于读取与记录介质相关的第二信息，所述第二信息表示所述记录介质对应的保护等级；比较器，用于比较所述第一信息和所述第二信息；以及控制装置，用于通过生成控制信息来控制所述数字数据的使用，所述控制信息表示所述控制设备根据比较结果是否允许所述数字数据的使用。
2. 按照权利要求l的设备，其中根据比较结果允许的使用是将数字数据 复制到所述记录介质。
3. 按照权利要求2的设备，其中所述记录介质被设置在记录装置上而不 是再现装置上，所述再现装置存储要复制到所述记录装置上的数字数据，及其中所述获取装置还从所述再现装置接收数字数据。
4. 按照权利要求3的设备，还包括：转换装置，用于将数字数据转换为可以由所述记录装置再现的形式。
5. 按照权利要求l的设备，其中所述第二信息被表示为对应于保护等绂 的每个值的表示方式。
6..按照权利要求1的控制设备，其中如果由所述第二信息表示的保护等 级小于由所述第一信息表示的保护等级则禁止所述数字数据的使用。
